HomeMy WebLinkAbout1970-01-21 455 Bozeman, Montana 21 January 1970 The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal Building, 21 January 1970 at 1:00 o'clock p.m. Present were Mayor Langohr, Commissioner Morrow, Commissioner Sedivy,Acting City Manager Keyes, City Attorney Berg and the Clerk. I Commissioner Morrow opened the meeting with a prayer and the following proceedings were had: Minutes of the regular meeting held 14 January 1970 were read and it was moved by Commissioner Sedivy, seconded by Commissioner MOrrow, that the minutes be approved as read and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Morrow and Mayor La~8ohr; those voting No, none. Request for Refund of Moving Permit No. 282 Fee - Wallace Diteman, Inc.,: A letter from John Diteman requesting a refund of the $100.00 fee paid for Moving Permit No. 282 to move the Don Norem Warehouse across West Main Street was presented. Following a thorough discussion and in view of the circumstances explained, the Commission con- curred with the City Attorney and the Building Inspector, that the $100.00 moving permit in accord- ance with the Bozeman Municipal Code, Sections 9.20.030 and 9.20.060 not be applied in this instance due to the short distance in moving the building and since the fee of $100.00 had not been deposited with the City Treasurer, but held by the Building Inspector pending action by the City Commission. It was moved by Commissioner Morrow, seconded by Commissioner ~edivy, that $25.00 be re~ained for moving the warehouse and that a return of $75.00 be authorized on the above basis and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Commiss- I ioner Sedivy and Mayor Langohr; those voting No, none. It was moved by Commissioner Morrow, seconded by Commissioner Sedivy, that the City Manager and the Building Inspector consider the revision of Ordinance No. 785 and that the City Attorney be instructed to draw up the amended ordinance and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner Sedivy and Mayor Morrow; those voting No, none. Reports for December: The Following Reports were presented for December: Cemetery Water Collector The Acting City Manager commented on the reports and recommended their approval. It was moved by Commissioner Sedivy, seconded by Commissioner Morrow, that the reports be approved and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being Commiss- ioner Sedivy, Commissioner Morrow and Mayor Langohrj those voting No, none. Commission Resolutin No. 1426 - Intent to Annex Land Lying West of North Seventh: In accordance with the Commission's instructions, Commission Resolution No. 1426 extending the boundaries of the City of Bozeman lying west of North Seventh Avenue, entitled A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN DECLARING IT TO BE TO THE BEST INTEREST OF THE CITY OF BOZEMAN AND '!liE INHABITANTS THEREOF AND OF THE INHABITANTS OF A TRACT OF LAND CONTIGUOUS TO THE SAID CITY OF BOZEMAN AND HEREIN MORE PARTICULARLY DESCRIBED TO EXTEND THE BOUNDARIES OF THE SAID CITY I OF BOZEMAN SO AS TO INCLUDE THE SA ID CONTIGUOUS TRACT WITHIN THE CORPORATE LIMITS THEREOF. prepared by the City Attorney was presented. The Acting City Manager recommended that the Commission adopt the resolution and it was moved by Commissioner Morrow, seconded by Commissioner Sedivy, that the resolution be passed and adopted and that 18 February 1970 be set as the date for public hearing and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner Sedivy and Mayor Langohr; those voting No, none. 456 Adjournment: There being no further business to come before the Commission at this time, it was moved by Commissioner Morrow, seconded by Commissioner Sedivy, that the meeting be adjourned and the motion was carried by the following Aye and No vote: those voting issioner Sedivy and Mayor Langohrj those voting No, none.
