The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal
Build ing, 1 April 1970, at 1:00 o'clock p.m. Present were Mayor Langohr, Commissioner Morrow,
Commissioner Sedivy, City Manager Fryslie, Ass't. City Manager Keyes, City Attorney Berg and the Clerk.
I Commissioner Sedivy opened the meeting with a prayer and the following proceedings were had:
Minutes of the regular session held 25 March 1970 were read and it was moved by Commissioner
Morrow, seconded by Commissioner Sedivy, that the minutes be approved as read and the motion was
carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner
Sedivy and Mayor Langohrj those voting No, none.
Q'p.e.~ Bid s - Refuse Collection Unit:
This was the time and place set for opening bids on a Truck-Mounted Refuse Collection Unit
for use by the Sanitation Department. The affidavit of Publication of the "Call for Bids" was
presented. It was moved by Commissioner Sedivy, seconded by Commissioner Morrow, that the bids be
opened and read and the motion was carried by the following Aye and No vote: those voting Aye being
Commissioner Sedivy, Commissioner Morrow and Mayor Langohr; those voting No, none.
The following bids were then opened and read:

I Upon recommendation of the City Manager, it was moved by Commissioner Morrow, seconded by
Commissioner Sedivy, that the bids be referred to the City Engineer and the Sanitation Department
for checking and recommendation to be made to the Commission at their next meeting on Wednesday,
8 April 1970, and the motion was carried by the following Aye and No vote: those voting Aye being
Commissioner Morrow, Commissioner Sedivy and Mayor Langohr; those voting No, none.

In accordance with the action of 25 March 1970, the bid of six percent (6%) by the First
National Bank for the purchase of bonds for Special Improvement District No. 493 in the amount of
$52,000.00 was presented. Following the recommendation of the Director of Finance, concurred in by
the City Manager, it was moved by Commissioner Sedivy, seconded by Commissioner Morrow, that the
bid of the First National Bank, Bozeman, Montana, it being the only bid submitted, the sale of the
bonds be awarded to the First National Bank, Bozeman, at the rate of 6% on the $52,000.00 bond sale
SID No. 493 and the motion was carried by the following Aye and No vote: those voting Aye being
Commissioner Sedivy, Commissioner Morrow and Mayor Langohr; those voting No, none.
Continued_Bond Sale - SID No. Lf9Lf:
In accordance with the action of 25March 1970, there being no one present to bid on the bonds
I for SID No. 494, this was the time and place set for the sale of bonds for Special Improvement
District No. 494. Affidavit of publication of the Notice of the sale of the bonds was presented.
The Mayor and the City Manager outlined the proceedure for conducting this bond sale and stated
that the amount of bonds to be sold would be in accordance with the advertisement as follows:

Mayor Langohr announced the City was ready to conduct oral bidding on the bonds of Special
Improvement District No. 494 in the amount of $53,000.00.
The following bidder qualified by depositing with the Clerk of the City Commission the necessary
bid security.

Mr. Ted Witzel Security Bank & Trust Company I
Mr. Witzel of the Security Bank & Trust Company being the only bidder, bid six percent (6%)
as the lowest effective interest rate accruing to the City of Bozeman. Following the recommendation
of the Director of Finance, concurred in by the City Manager, it was moved by Commissioner Morrow,
seconded by Commissioner Sedivy, that the bid of the Security Bank & Trust Company, Bozeman, Montana,
being the only bid submitted, the sale of the bonds for Special Improvement District No. 494 be
awarded to the Security Bank & Trust Company and the motion was carried by the following Aye and No
vote: those voting Aye being Commissioner Morrow, Commissioner Sedivy and Mayor Langohr; those voting
No, none.

The City Engineers and the engineers representing Thomas, Dean & Hoskins, Inc., having com-
pleted their study of the bids submitted for the construction of paving improvements on South Montana
Avenue, SID No. 493 and 494, South Willson Avenue and West Garfield Street and having prepared a
final tabulation of the bids recommended that Long Construction Company of Billings, Mottana, be
awarded the contract for construction of SID No. 493 and 494 an the basis of its bid in the amount
of $89,474.00 it being the lowest and best bid for Schedule I and that Long Construction Company
be awarded the contract for construction of Bid Schedule II on the basis of their low bid of I
$'j5,566.00 and the bid security of the unsuccessful bidder be returned. A letter from the Director
of the Division of the Physical Plant of Montana State University recommended that the Long Con-
struction Company be awarded the construction of paving improvements on West Garfield. It was moved
by Commissioner Sedivy, seconded by Commissioner MorroW, that the paving of South Montana Avenue,
SID No. 493 and 494, West Garfield Street be awarded to Long Construction Company and tha t the paving
of South Willson between Garfield and Willson be awarded to Long Construction Company contingent
upon receiving the Montana State Highway's written approval and the motion was carried by the follow-
ing Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Morrow and Mayor
Langohr; those voting No, none.
OpcI1 Bids - 20,000 lb. G.V.W. Dump Truck:
This was the time and place set for opening bids on a new 20,000 pound G.V.\I1. Dump Truck for
use by the Street Department. The affidavit of publication of the "Call for Bids" was presented.
It was moved by Commissioner Morrow, seconded by Commissioner Sedivy, that the bids be opened and
read and the motion was carried by the following Aye and No vote: those voting Aye being Commiss-
ioner Morrow, Commissioner Sedivy and Mayor Langohr; those voting No, none.

Upon recommendation of the City Manager, it was moved by Commissioner Sedivy, seconded by
Commissioner MorroW, that the bids be referred to the City Engineer and the Street Superintendent
for checking and recommendation to be made to the Commission at their next meeting on Wednesday,

License Bond - William Lynas1 plumbers License:

In compliance with Chapter 15 of the Bozeman Municipal Code, the plumbers license bond of
I Wi 11 iam Lynas, Bozeman, was presented. The City Manager stated the building Inspector had recomm-
ended the approval of the ahove mentioned bond and the City Attorney had approved the bond as to
form. It was moved by Commissioner Morrow, seconded by Commissioner Sedivy, tha t the bond be
approved and the motion was carried by the following Aye and No vote: those voting Aye being Comm--
issioner Morrow, Commissioner Sedivy and Mayor Langohrj those voting No. none.
Proclam<:tion - "Census Day" 1 !\pr il 1970:
Mayor Langohr announced his proclamation of "Census Day" in Bozeman on 1 April 1970 in accord-
ance with a request of Mr. Robert S. Hanson, District Manager, Bureau of Census. It was moved by
Commissioner Sedivy, seconded by Commissioner Morrow, that the Commission concur in the proclamation
and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner
Sedivy, Commissioner Morrow and Mayor Langohr- those voting No, none.
Repor ts for February and March "Con tinued:"
The following reports were presented for February and March:

The City Manager commented on the reports and recommended their approval. It was moved by
I Commissioner Morrow, seconded by Commissioner Sedivy, that the reports be approved and ordered filed
and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner
Morrow, Commissioner Sedivy and Mayor Langohr; those voting No, None.
Death of Dr. B. L. Johnson:
The Commission took note of the sudden and untimely passing of Dr. B. L. Johnson and directed
that an appropriate letter be sent to Mrs. Johnson expressing sympathies of the City Commission.

There being no further business to come before the Commission at this time, it was moved by
Commissioner Sedivy, seconded by Commissioner Morrow, that the meeting be adjourned and the motion
was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Comm-
