City Manager Keyes, City Attorney Berg and the Clerk. Commissioner Sedivy opened the meeting with a prayer and the following proceedings were had: I Minutes of the regular session held 15 April 1970 were read and it was moved by Commissioner Morrm-iT , seconded by Commissioner Sedivy, that the minutes be approved as corrected and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner Sedivy and Mayor Langohr; those voting No, none. Hr. Cowdrey's Social Studies Class: Assess Public for Littering: A letter received from Mr. Cowdrey's fifth period Social Studies Class requesting permission to charge any person seen littering the streets It and presenting them with a citation which reads "Please don't Litter," on Saturday, 2S April 1970, was presented. Monies so obtained are to be donated to the Bozeman Environmental Task Force. Several Social Studies students were present to answer questions. It was moved by Commissioner Sedivy, seconded by Commissioner Morrm-iT, that the Social Studies Class be granted permission to charge anyone seen littering the streets Ii and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Morrow and Mayor Langohr; those voting No, none. R~lest for Exception to Plumbing Code - n. Be rg, Jr. , 1119 N. Seventh: ~-~~_._~-~~_.'_._-~ Mr. Oswald Berg, Jr. , of 1119 North Seventh Avenue was present to apply for an exception to the I Plumbing Code with regard to the minimum slope of a building sewer. Since the invert of the sewer of his building structure is 7" lower than the nearest point of sewer connect, he requested that he be permitted to install the line at a given grade of 1/16" fall per foot to the main line. He pointed out that while the local Plumbing Code permitted a minimum of 1/8' per foot slope, the S ta te and National Plumbing Code did permit a minimum of 2' per. second flow velocity to the main line. He also stated the line could be laid at a minimum slope of 2' per second flow if he installed a 6" line. The City Manager concurred in the recommendation of the Building Inspector, that Mr. Berg be given permission to increase the size of the pipe and lay it on a 1/16" fall per foot to be installed to the manhole some thirty-two feet further north. It was moved by Commissioner Morrow, seconded by Commissioner Sedivy, that an exception be made to the Uniform Plumbing Code and that Mr. Berg be given permission to install a six inch pipe and lay it on a 1/16'1 inch grade as permitted by the State and Federal Plumbing Code and that the repair and maintenance of the line remain with Mr. Berg as owner and the motion was carried by the following Aye and No vote: those voting Aye being Comm-- issioner Morrow, Commissioner Sedivy and Hayor Langohr; those voting No, none. f~9pe~ativ.e Agreement \<lith U.,S. Forest Service - Bozeman Creek Hatershed: The Commission was reminded of the proposal made by the U. S. Forest Service and the Ci ty of I Bozeman at its meeting 26 November 1969, to open the Bozeman Creek Watershed for limited Public Access. Following a discussion, it was moved by Commissioner Sedivy, seconded by Commissioner Morrow, that the Cooperative Agreement dealing with the proposed opening of Bozeman Creek to limited access be tabled for one week for further discussion and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Morrow and Mayor Langohrj those voting No, none. Bog,art Subdivision llo. 2 for approval: The final plat of Bogart's Subdivision No. 2 was presented. The City Hanager in roncurrence 488 with the City-County Planning Board recommended that the plat be approved as presented and it was moved by Commissioner Morrow, seconded by Commissioner Sedivy, that the plat be approved and that the City Manager be authorized and directed to sign the plat as the Director of Public Service and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner Sedivy and Mayor Langohr; those voting No, none. .~ointt11cn t of N. Skerritt, Chief of University Police of the Montana State Uni- versity, requesting that the following members of the University Police be appointed Special police officers of the City of Bozeman for the purpose of issuing City of Bozeman Traffic citations for moving vehicle violations within the jurisdiction of the area of the University for a period of one year from 30 April 1970 to 30 April 1971 without cost to the City was presented. Decker It was moved by c'ommissioner Sedivy, seconded by Commissioner MorrO\v, that in concurrence with the recommendation of the police Chief, the Ci.ty Attorney and the City Manager, the appointments as requested be approved and the motion was carried by the following Aye and No vote; those voting Aye being Commissioner Sedivy, Commissioner Mnrrov and Mayor Langohrj those voting No, none. It was moved by Commissioner Sedivy, seconded by Commissioner Harrow, that the request he granted and that Mrs. Nelson contact the Police Department to advise them of the exact hours so that they may provide necessary barricades and traffic control and the motion was carried by the following Aye and No vote: those voting ~ye being Commiss- ioner SccH vy, Commissioner Horrmv and Hayor Langohr; those voting No, none.
