Municipal Building. 6 May 1970. at 1:00 o'clock p.m. Present were Mayor Langohr, Commissioner Morrow, Comm- issioner Sedivy, City Manager Fryslie, Ass't. City Manager Keyes, City Attorney Berg and the Clerk. I Commissioner Morrow opened the meeting with a prayer and the following proceedings were had: Minutes of the regular session held 29 April 1970 were read and it was moved by Commissioner Sedivy. sec seconded by Commissioner Morrow. that the minutes be approved as read and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy. Commissioner Morrow and Mayor Langohrj those voting No, none. Park Land Trade Proposal - Deeds & Plats for Approval: As direct~d by the City Commission at their regular meeting held 15 April 1970, the City Manager completed the negotiations involving the trade of a parcel of land in Kirk's Subdivision No.4 consisting of 5.5881 acres now owned by the City for 7.983 acres of land adjacent to the East Park near Westridge and Graf's third addition. A Warranty Deed drawn by the City Attorney conveying a tract of land containing 5.5881 acres from the City of Bozeman to Eugene Graf, Jr. and Genevieve T. Graf was presented. Following a discussion. it was moved by Commissioner Morrow. seconded by Commissioner Sedivy, that the Warranty Deed be approved as recommended by the City Manager and the City Attorney and that the Mayor and the Clerk of the Commission be authorized and Directed to execute the same for the City of Bozeman and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner Sedivy and Mayor Langohrj those voting No, none. I The plat containing 7.983 acres of land adjacent to the East Park near Westridge and Graf's Third Addition was presented together with a deed for the property from Eugene Graf, Jr. and Genevieve T. Graf to the City of Bozeman. Following a discussion, it was moved by Commissioner Sedivy, seconded by Commissioner Morrow. that the deed be accepted and the plat be approved as re- commended and the City Manager be authorized to sign the plat as Director of Public Service and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Morrow and Mayor Langohrj those voting No, none. Authority to Hold Circus performance - 9 July 1970 - M.S.U. Fieldhouse: A letter received from Mr. Bud Burdy. Fieldhouse Manager of Montana State University requesting permission to obtain the proper forms to stage Hubert Castles Three Ring International Circus, Thursday, 9 July 1970. in the Montana State University Fieldhouse was presented. It was moved by Commissioner Morrow, seconded by Commissioner Sedivy. that the subject request be approved with the instructions that this circus be fully licensed in the total amount of $220.00 in compliance with Chapter 3.04.080 of the Bozeman Municipal Code and the motion was carried by the following Aye and No votej those voting Aye being Commissioner Morrow. Commissioner Sedivy and Mayor Langohrj those voting No, none. I Authority to Conduct 'Broom Sale' Lions Club. 7-9 May 1970: A letter received from Charles H. Crouse of the Bozeman Lions Club, requesting permission to hold their annual broom sale 7-9 May 1970 was presented. It was moved by Commissioner Sedivy, seconded by Commissioner Morrow. that permission to hold their annual broom sale be granted and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Morrow and Mayor Langohrj those voting No, none. 492 Proclamation -"Poppy Days"'American Ledon Auxiliary, 22-23 May 1970: A letter received from Mrs. Mary McGuire. Poppy Chairman American Legion Auxiliary, requesting that the Mayor proclaim 22-23 May 1970 as "Poppy Day" in the City of Bozeman was presented. In accordance with the above request. Mayor Langohr proclaimed 22-23 May 1970 as "Poppy Day" and urged every citizen to give generous recognition to this program and to obtain and wear a Memorial Red Poppy on these days. It was moved by Commissioner MOrrow, seconded by Commissioner I Sedivy, that the Mayors proclamation be approved and endorsed and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner Sedivy and Mayor Langohr; those voting No, none. Orders to Replace Curb & Gutters - South Willson Avenue between Cleveland to Garfield Sts.: To facilitate the contract for widening of South Willson Avenue from West Cleveland to West Garfield Streets, a letter was addressed to all property owners advising them that the Commission has ordered replacement of curbs and gutters on South Willson Avenue from Cleveland to Garfield Streets as per Section 11-967 and 11-2226 of the R.C.M. 1947, and ordinance No. 561 of the Bozeman Municipal Code. The cost of the replacement of the Curbs and Gutters will be charged to the pro- perty owners as their share of such widening. Following a discussion, it was moved by Commissioner Sedivy, seconded by Commissioner Morrow, that the replacement of the Curbs and Gutters be oree~ed in and the property owners be charged for the replacement of same as their share of such widening and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Morrow and Mayor Langohr; those voting No, none. Ordinance No. 891 - Electric Code: I Ordinance No. 891 establishing a new Bozeman Electric Code to provide minimum standards to safeguard life, hellth. property and public welfare by regulating and controlling the installation repair, maintenance and inspection of electric wiring and amending Title No. 15, Chapter 15.04 of the Bozeman Municipal Code and repealing all ordinances and parts of ordinances in conflict here- with was presented as follows: ORDINANCE NO. 891 AN ORDINANCE ESTABLISHING A NEW BOZEMAN ELECTRIC CODE; ADOPTING mE NATIONAL ELECTRIC CODE; PROVIDING FOR SUB- ORDINATION OF BOZEMAN ELECTRIC CODE TO RULES AND REGUL- ATIONS OF 'mE MONTANA STATE ELECTRIC BOARD. AMENDING TITLE 15, CHAPTER 15.04 of THE BOZEMAN MUNICIPAL CODE AND REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT HEREWITH. Following a discussion. it was moved by Commissioner Morrow, seconded by Commissioner Sedivy. that the Ordinance be provisionally passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner Sedivy and Mayor Langohr; those voting No, none. Ordinance No. 893 ~ Amending Fire Zone Code: Ordinance No. 893 amending Title 14, Chapter 14.04 of the Bozeman Municipal Code for the pur~ pose of controlling and regulating the erection of buildings and other structures within the corporate limits of the City of Bozeman and promoting and protecting the safety of persons and property within its corporate limits was presented as follows: ORDINANCE NO. 893 AN ORDINANCE AMENDING TITLE 14, CHAPTER 14.04 OF THE BOZEMAN MUNICIPAL CODE, AMENDING THE FIRE ZONE BOUNDARIES OF THE CITY OF BOZEMAN, MONTANA, AND REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT HEREWITH. Following a thorough discussion, it was moved by Commissioner Morrow, seconded by Commissioner Sedivy, that the proposed Ordinance No. 893 be passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner Sedivy and Mayor Langohr; those voting No, none. Ordinance No. 894 ~ Building Moving Code: I Ordinance No. 894 amending title 9, Chapter 9.20 of the Bozeman Municipal Code to provide minimum standards by regulating and controlling the moving or relocating of buildings and structures was presented as follows: ORDINANCE NO. 894 AN ORDINANCE AMENDING TITLE 9, CHAPTER 9.20 OF THE BOZEMAN MUNICIPAL CODE AND REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT HEREWITH. Following a thorough discussion, it was moved by Commissioner Sedivy, seconded by Commissioner Morrow, that Ordinance No. 894 be passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Morrow and Mayor Langohr, those voting No, none. Ordinance No. 895 - Abandoned, Junked or Wrecked Vehicle Code: Ordinance No. 895 amending Chapter 6.38 of the Bozeman Municipal Code by adding removal of abandoned, wrecked or junked vehicles was presented as follows: ORDINANCE NO. 895 All ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, AMENDING CHAPTER 6.t8 OF THE BOZEMAN MUNICIPAL CODE BY ADDING REMOVAL OF ABANDONED, WRECKED OR JUNKED VEHICLES, SECTIONS 6. 38.220 THROUGH 6.38.260 DECLARING ABANDONED, WRECKED OR JUNKED VEHICLES OR PART (S) I mEREOF ON PRIVATE PROPERTY TO BE PUBLIC NUISANCES; PROHIBITING STOR~ AGE THEREOF; AUTHORIZING THE DIRECTOR OF PUBLIC WELFARE OF THE CITY OF BOZEMAN TO ABATE SUCH NUISANCES AFTER NOTICE BY SAID DIRECTOR OR BY PUBLIC NOTICE; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR AN EFFECTIVE DATE; AUTHORITY TO CODIFY; FOR A SAVINGS CLAUSE; AND FOR OTHER PURPOSES. Following a thorough discussion, it was moved by Commiasioner Morrow, seconded by Commissioner Sedivy, that Ordinance No. 895 be passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner Sedivy and Mayor Langohrt those voting No, none. 494 Reports for April: The following reports were presented for April: Fire Chief Fluoridation Police Judge Building Inspector The City Manager commented on the reports and recommended their approval. It was moved by I Commissioner Sedivy, seconded by Commissioner Morrow, that the reports be approved and ordered filed a~d the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Morrow and Mayor Langohrj those voting No, non~. Claims for April: Claim No's. 7307 thru 7569 inclusive were. presented on the various funds as follows: Band $ 34.32 Police Reserve $ 1,532.70 Cemetery 3,423.61 SDS 6,340.56 Cemetery Suspense 240.00 SID 493 2,582.95 Garbage 7,835.28 SID 494 2,689.51 General 35,983.27 Street 10,822.52 Library 2,825.25 Water 14,634.52 Park 4,868.42 Dr. Education 508.40 Parking Meter 1,443.24 pt & p 21.83 P.E.R.S. 1,694.25 New Sewer Construction 1,876.27 Planning Board 76.75 Total $99,433.65 The City Manager checked tbe claims and found them to be true and lawful claims against the City of Bozeman and recommended they be approved and the Director of Finance be directed to issue warrants in payment. It was moved by Commissioner Morrow, seconded by Commissioner Sedivy, that the claims be approved and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, CommiSSioner Sedivy and Mayor Langohrj those voting No, none.
