The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal
Building, 20 May 1970 at 1:00 o'clock p.m. Present were Mayor Langohr, Commissioner MOrrow, Comm-
issioner Sedivy, City Manager Fryslie, Ass't. City Manager Keyes, City Attorney Berg and the Clerk.
Mayor Langohr opened the meeting with a prayer and the following proceedings were had:
I Minutes of the regular meeting held 13 May 1970 were read and it was moved by Commissioner
Sedivy, seconded by Commissioner Morrow, that the minutes be approved as read and the motion was
carried by tbe following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner
Morrow and Mayor Langohr; tbose voting No, none.
Authority to Attend Attorney General Conference, 21-22 May 1970, Helena: Chief of Police Cutting:
The fifteenth Annual Attorney General's Law Enforcement Conference is scheduled to be held in
Helena, 21-22 May 1970. The Chief of Police requested that he be authorized to attend the confer-
en ce . It was moved by Commissioner Morrow, seconded by Commissioner Sedivy, that the Chief of
Police be authorized to attend the Conference and, it being in the public interest his expenses be
charged to the General fund and the motion was carried by the following Aye and No vote: those voting
Aye being Commissioner Morrow, Commissioner Sedivy and Mayor Langohrj those voting No, none.
Acceptance of Crime Control Grant - $1,283.68:
A letter received from the Governor's Crime Control Commission informing the Chief of Police
that the application for Federal financial assistance under the provisions of the Omnibus Crime
Control and Safe Streets Act of 1968 (PL-35l) had been approved was presented.
Following a discussion, the Commission concurred in the recommendation of the Chief of Police,
I also concurred in by the City Manager and it was moved by Commissioner Sedivy, seconded by Commiss-
ioner Morrow, that the grant not to exceed $1,283.68 to help fund attendance of Police Officers at
various M.L.E.A. courses, 69-2-55 Police Management School, 1 Man, Latent Fingerprinting School,
1 man, Photography School, 1 man, Classification of Fi.ngerprints, 1 man, Narcotics School, 1 man,
Major Case, 2 men, Recruit, 2 men and 69-2-65 Basic School, 1 man, until 1 July 1970 as directed by
the Governor's Crime Control Commission be accepted and the requet for its payment be approved and
that the Mayor be authorized to sign the Grant in behalf of the City of Bozeman and the motion was
carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner
Morrow and Mayor Langohr; those voting No, none.
Request to conduct Mem~orial Day Parade & Services - American Legion No. 14:
A request from Gallatin Post No. 14 of the American Legion, for permission to conduct the 1970
Memorial Day Parade and services at the Sunset Hills Cemetery on Saturday, 30 May 1970, at 10:00
a.m. was presented. It was moved by Commissioner Morrow, seconded by Commissioner Sedivy, that
the.quest be granted and the motion was carried by the following Aye and No vote: those vo Hng
Aye being Commissioner Morrow, Commissioner Sedivy and Mayor Langohr; those voting No, none.
It was moved by Commissioner Sedivy, seconded by Commissioner Morrow, that permission be granted
I the Bozeman Municipal Band to conduct a Memorial Day Concert on Saturday, 30 May from 3:00 to 4:00
o'clock P.M. at no cost to the City of Bozeman and the motion was carried by the following Aye and
No vote: those voting Aye being Commissioner Sedivy, Commissioner Morrow and Mayor Langohr; those
voting No, none.
Orders to Install or Replace Walks and Curbs: Year 1970:
The City Engineer had completed bis survey of Walks and Curbs within the C j, ty of Bozeman and

recommendations for repair and/or installation for the year 1970.
Following a thorough discussion and in concurrence with the recommendation of the City Manager,
it was moved by Commissioner Morrow, seconded by Commissioner Sedivy, that consideration of install-
ation or replacement of the Walks and Curbs be delayed for one week for inspection and discussion
thereof and the motion was carried by the following Aye and No vote: those voting Aye being Comm-
issioner Morrow, Commissioner Sedivy and Mayor Langohrj those voting No, none. I
Reports for March and April "Continued:
The following reports were presented for March and April:

The City Manager commented on the reports and recommended their approval. I t was moved by
Commissioner Sedivy, seconded by Commissioner Morrow, that the reports be approved and ordered
filed and the motion was carried by the following Aye and No vote: those voting Aye being Comm-
issioner Sedivy, Commissioner Morrow and Mayor Langohr; those voting No, none.
Request for Leave - City Manager Fryslie, National Guard Camp, 29 May - 13 June 1970:
The City Manager requested that he be granted leave of absence from 29 May to 13 June 1970
for the purpose of attending National Guard Camp, and that the Ass't. City Manager be designated
to perform the duties of the City Manager during this period. It was moved by Commissioner Morrow,
seconded by Commissioner Sedivy, that the above request be granted and that the Ass't. City Manager,
Robert F Keyes, be designated as Acting City Manager during this period and the motion was carried
by the following Aye and No vote: those voting Aye being Commissioner Mottow, Commissioner Sedivy
and Mayor Langohrj those voting No, none. I
Request for Second Grant Payment - W. P. C. A. ~ Approximately $140,000. - Waste Water plant project:
The Applicant's Payment Request, Form No. CG-22 and Labor Standards Certificate Form No. CG-23
prepared for the Federal Water Pollution Control Administration, seeking the second Grant Install-
ment for the City of Bozeman for the construction of tbe Waste Water Treatment Plant and Sanitary
Sewer project in the approximate amount of $140,000.00 was presented.
Following a thorough discussion, it was moved by Commissioner Sedivy, seconded by Commissioner
Morrow, that the Form CG-22 (Applicant's Payment Request) and the Form CG-23 (Labor Standards Certi-
ficate), for the WPC-Mont.-125 construction grants be ppproved and forwarded to the Federal Water
pollution Control Administration for consideration of the payment request and the motion was carr-
ied by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner
Morrow and Mayor Langohr; those voting No, none.
Commission Resolution No. 1430 - Calling Special Elections, election of two additional Commissioners -
Three Year Term:
A resolution prepared by the City Attorney of the City of Bozeman, calling a Special Primary
Election on Tuesday, 25 August 1970, between the hours of 8:00 A.M. and 8:00 P.M. for the purpose
of nominating candidates for two additional City Commissioners of the City of Bozeman as follows was
presented:

It was moved by Commissioner Morrow, seconded by Commissioner Sedivy, that the Commission Re- I
solution No. 1430 be passed and adopted and the motion was carried by the following Aye & No vote:
