HomeMy WebLinkAbout1969-11-26 I I I Bozeman, Montana 26 November 1969 The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal Building, 26 November, 1969, at 1:00 o'clock p.m. Present were Commissioner Sedivy, Commissioner Langohr, City Manager Fryslie, Ass't. City Manager Keyes, City Attorney Berg and the Clerk. Commissioner Langohr opened the meeting with a prayer and the following proceedings were had: Minutes of the regular session held 19 November, 1969, were read and it was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that the minutes be approved as read and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy and Commiss- ioner Langohrj those voting No, none. Designation of President Pro Termpore: In concurrence with the recommendation of the City Manager, it was moved by Commissioner Lan- gohr, seconded by Commissioner Sedivy, that the absence of Mayor Morrow be authorized in compliance with Section 11-3245, R.C.M., 1947, and that Commissioner Sedivy be designated to act as President Pro Tempore of the Commission and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr and Commissioner Sedivy; those voting No, none. Proc lamation "Operation Appreciation Day" _ - 7 December , 1969: Several members of the Junior Chamber of Commerce appeared before the Commission to ask the Acting Mayor to declare 7 December, 1969, as "Operation Appreciation Day" paying tribute to our Service Men who have died in the service of our Country and expressing appreciation to those men now serving our Country throughout the world. Acting Mayor Sedivy accordingly announced his proclamation of 7 December, 1969, as "Operation Appreciation Day" and sincerely urged all citizens of the community to join in honoring the Service Men serving our Country throughout the world. It was moved by Commissioner Langohr, seconded by Commissioner Sedivy, that the proclamation be endorsed and that the Junior Chamber of Commerce con- tact and coordinate with the Fire Department in regard to the lowering of the flag (Retreat) program and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner Sedivy and those voting No, none. Bozeman Creek Watershed, Limited Public Opening: Following a thorough study of the proposal made by the U.S. Forest Service at the Commission Meeting 12 November, 1969, to open the Bozeman Creek Watershed for limited Public Access was again presented for consideration. Following a through discussion and in concurrence with the recommendation of the City Manager, it was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that the propo~ made by the U. S. Forest Service to open the Bozeman Creek Watershed for limited Public Access be accepted with the following condifions and stipulations, all of which have been discussed with representatives of interested public agencies, including the Forest Service; I) Public access to Bozeman Creek Watershed is to be limited to foot or horseback travel. Motorized vehicles are expressly prohibited. 2) No public traffic is to be permitted on the road through the canyon to Mys tic Lake. 3) No boating, swimming or bathing is to be permitted in Mystic Lake. 4) The U.S. Forest Service will accept responsibility for maintenance of comfort stations and refuse disposal within health and sanitation regulations of the State and Federal Governments. 437 438 5) Limited Public Opening of the Watershed is on a two year trial basis, during which time studies of water quality will continue. Should, in the opinion of the City of Bozeman, evidence show a deterioration of water quality due to public traffic in the watershed, the area will immediately be closed to any public access. The above is provided for your information and such action as deemed appropriate within your jurisdiction. Presumably, actual opening of the watershed, will be accomplished by ammendment of the 19l7 cooperative agreement with the U.S. Government which closed the Water- shed under Regulation U-6, and, by reclassification of Bozeman Creek from A-closed to A-Open by the Water QUality Standards Committee. Announcement of these actions, it seems, should best be made by the respective agencies, namely the U.S. Forest Service and the Montana Board of Health, if and when the action is taken. The motion was carried by the following Aye and No vote: those voting Aye being Commissiner Sedivy, Commissioner Langohr and those voting No, none. B:es_:!:..&.nation of Ass't. Park St~erintendent ~ E. Merle Chandler, employed 5 J~--.!.950=- A letter addressed to the City Manager by the Ass't. Park Superintendent, E. Merle Chandler, requesting that his resignation as Ass't. Park Superintendent due to physical disability be accepted effective as of 26 November, 1969, was presented. The City Manager paid tribute to Mr. Chandler who has served the City of Bozeman since 5 July 1950, and stated that it is with regret that he has found it necessary to accept Mr. Chandlers resignation. Acting Mayor Sedivy and Commissioner Langohr further praised and commended Mr. Chandler and it was moved by Commissioner Langohr, seconded by Commissioner Sedivy, that a letter be addressed to Mr. Chandler accepting his resignation with regret as of 26 November, 1969, and the motion was carried by the following Aye and No vote: Those voting Aye being Commissioner Langohr and Commission- er Sedivy; those voting No, none. ~e~rt of the Director of Finance for the Month of October: The Director of Finance report for the month of October was presented. It was moved by Comm- issioner Sedivy, seconded by Commissioner Langohr, that the report be approved and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Langohr and those voting No, none.
