HomeMy WebLinkAbout1969-12-10 I I I Bozeman, Montana 10 December 1969 The commission of the City of Bozeman met in regular session in the Commission Room, Municipal Building, 10 December, 1969, at l:OO o'clock p.m. Present were Mayor Morrow, Commissioner Sedivy, Commissioner Langohr, City Manager Fryslie, Ass't. City Manager Keyes, Acting City Attorney O'Connell and the Clerk. Mayor Morrow opened the meeting with a prayer and the following proceedings were had: Minutes of the regular session held 3 December, 1969, were read and it was moved by Commissioner Langohr, seconded by Commissioner Sedivy, that the minutes be approved as corrected and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr and Comm- issioner Sedivy; those voting No, none. ~oval of Bond, Clerk of_~ity Commission - $15,000.00: A surety bond in the amount of $15,OOO.00 written by the Reliance Insurance Company for Erna V. Harding, Clerk of the City Commission, and for a period of three years from December 1, 1969, approved as to form by the Acting City Attorney was presented. It was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that the bond be approved as presented and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Langohr and Mayor Morrow; those voting No, none. ~b..'!.te~ent of Special Assessments: The following Applications for tax abatements were presented. B:esolutio.~__~_:_Jlf24 Certificate of Delinquent Taxes: #44,646.60: Resolution No. 1424 - Certifying delinquent taxes in the amount of $44,646.60 to the Gallatin County Treasurer was presented, entitled: 441 442 COMMISSION RESOLUTION 1424 A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN DECLARING CERTAIN SPECIAL ASSESSMENTS AND INSTALLMENTS OF SPECIAL ASSESSMENTS, DUE AND pAYABLE NOBEMBER 30, 1969, AND UNPAID AS OF THAT DATE, AND CERTAIN OTHER SPECIAL ASSESSMENTS AND INSTALLMENTS OF SPECIAL ASSESSMENTS, DUE AND PAY- ABLE NOVEMBER 30, 1969, AND UNPAID , DELINQUENT, AS PROVIDED BY CHAPTER 2.32 OF THE BOZEMAN MUNICIPAL CODE AND SECTION 11-2233, POLITICAL CODE, R . Upon recommendation of the City Manager, it was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that the resolution be passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Langohr and Mayor Morrow; those voting No, none. Amendrn_~r~....!:.o__~ngineer!-ng Contracts - Thomas Dean & Hoskins, a) Sanitary Sewer, ~ater and ~,?r~ Drainage: b) Paving~ An amendment to the Agreement made the 29th day of December, 1965, between the City of Bozeman and Thomas, Dean & Hoskins, Inc., Engineers of Great Falls, Montana as amended to be binding upon the City and the Engineers for a period of five years from lO December, 1969, but reserving the right of either party to call for a review of engineering fees, Section III, at any time was presented. The contracts extended are for Engineering Services for Paving Improvements and for Engineering Services on sanitary Sewer, Water and Storm Drainage Improvements. In concurrence with the City Engineer, The City Manager recommended that the City enter into an amendment to the contract so that engineering services can be rendered to the City for the Sanitary Sewer, Water and Storm Drainage Improvements within improvement districts that have been or may be established. It was moved by Commissioner Langohr, seconded by Commissioner Sedivy, that the contract amended as described above be approved and the Mayor and the Clerk of the Commission be authorized and directed to sign for the City and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner Sedivy and Mayor Morrow; those voting No, none. It was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that the City enter into the amendment to the contract so that engineering services can be rendered to the City for the construction of paving within improvement districts that have been or may be established and the Mayor and the Clerk of the Commission be authorized and directed to sign for the City and the motion was carried by the following Aye and No vote: those voting No, none. Flas~~Peace Parade, 7:30 p.m., 15 December, 1969: Organization for Advance- Advancement of CuI tural Ul)ders tc.mding: A request from the Organization for Advancement of Cultural Understanding to conduct a Flash- light Peace March at 7:30 p.m. Monday, 15 December, 1969, was considered by the City Commission. Following considerable discussion, the Commission concurred with the recommendation of the City Manager and it was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that the request be approved utilizing the same origin route and destination as were followed at the time of the first march that waS held on 14 November, 1969, specifically commencing at the Federal Building, proceeding along Babcock Street to Eighth Avenue Sounth, along Eighth Avenue to the University Campus. The City Commission expressed considerable interest and concern about whether or not the 'Peace March' activity was to become a monthly occurrence, and if so it was the fee1- ing of the Commission that unusually policing burden migI-t"accrue to the City and conflict with other activities. It was moved by Commissioner Langohr, seconded by Commissioner Sedivy, that the claims be approved and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner Sedivy and Mayor Morrow; those voting No, none. Mayor Morrow reported on his attendance at the 46th Annual Congress of Cities held in San Diego, California, 1-4 December, 1969. Commissioner Sedivy extended the appreciation of the Commission on his extensive report. It was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that the Mayor be commended for representing the City of Bozeman and for his complete report and the motion was carried by the following Aye and No vote: those voting Aye being Comm- issioner Sedivy, andCommUsioner L8ngohr; those voting No, none. ~ensus ~em~~r: Robert F.
