HomeMy WebLinkAbout1969-12-17 444 Bozeman, Montana l7 December, 1969 The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal Building, 17 December, 1969, at 1:00 o'clock p.m. Present were Mayor Morrow, Commissioner Sedivy, Commissioner Langohr, City Manager Fryslie, Ass't. City Manager Keyes, City Attorney Berg and the Clerk. Commissioner Sedivy opened the meeting with a prayer and the following proceedings were had: Minutes of the regular sessi.on held 10 December, 1969, were read and it was moved by Commiss- ioner Langohr, seconded by Commissioner Sedivy, that the minutes be approved as read and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Comm- issioner Sedivy and Mayor Morrow; those voting No, none. Commission Resolution No. 1425 - Approve and authorize Deed to Mrs. Anna Fridley 80 Acres in Secti~n 8, T 3 S, R 6 E.: A deed drawn by the City Attorney and intended to conform with and complete the old Land Trade Agreement between Mrs. Anna Fridley and the City of Bozeman, which was entered into the 29th day of May, 1959, and Commission Resolution No. 1425 authorizing the Mayor and the Clerk of the City Comm- ission to execute a bargain and sale deed was presented. Upon advisement of the City Attorney and recommendation of the City Manager, it was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that Resolution No. 1425 be passed and adopted authorizing the Mayor and Clerk of the Commission to execute a bargain and sale deed conveying the south one-half of the northwest one-quarter of Section 8, T 3 S, R 6 E, containing 80 acres, more or less to Mrs. Fridley from the City of Bozeman and the motion was carried by the following Aye and no vote: those voting Aye being Commissioner Sedivy, Commissioner Langohr and Mayor Morrow; those voting No, none. Q.~_inance No. .888, Additions to Zoning Code: Ordinance No. 888 prepared by the City Attorney, assigning code section numbers and repealing all other ordinances in conflict therewith was presented, entitled: ORDINANCE NO. 888 AN ORDINANCE DEFINING "DRIVEWAY", "STRUCTURALLY ALTERED" AND "GRADE", ASSIGNING CODE SECTION NUMBERS AND REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT HEREWITH. It was moved by Commissioner Langohr, seconded by Commissioner Sedivy, that Ordinance No. 888 be passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner Sedivy and Mayor Morrow; those voting No, none. Ori~nan~~ No. 889, Amendments to Zoning Cod~.: Ordinance No. 889 amending and repealing all ordinances and parts of ordinances in conflict with the Zoning Code was presented, entitled: ORDINANCE NO. 889 AN ORDINANCE AMENDING SECTION 17. 08.340 DEFINING "FRONT YARD"; AMENDING SECTION 17.08.280 DEFINING "OFF-STREET PARKING"; REPEALING SECTION l7.08. 220; AMENDING SECTION l7. 08.290 DEFINING "ROOM AND LODGING"; AMENDING SECTION 17.08.410 "OTHER DEFINITIONS"; AMENDING SECTION 17.08.460 (2) (b) "GENERAL PROVISIONS" AND AMENDING SECTION 17.08.460 (10) "GENERAL PROVISIONS, AND AMENDING SECTION l7.08.450 (A) (4) "TRANSITION AND FRINGE ZONE AREAS; REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT THEREWITH. Following a thorough discussion, the Commission concurred with the recommendation of the City Manager, and it was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that the proposed Ordinance No. 889 be passed and adopted and the motion was carried by the following Aye and No vote: Those voting Aye being Commissioner Sedivy, Commissioner Langohr and Mayor Morrow; those voting No, none. I I I I I I E~l!..rr.!,b)ng License Bond - George We llhouser: In compliance with Chapter 16 of the Bozeman Municipal Code, the Plumber bond of George Well- houser, Manhattan, Montana, was presented. The City Manager stated that the Building Inspector had recommended approval of the above mentioned bond and the City Attorney had approved the bond as to form. It was moved by Commissioner Langohr, seconded by Commissioner Sedivy, that the bond be app- roved and the motion was carried by the following Aye and No vote: those voting Aye being Commiss- ioner Langohr and Commissioner Sedivy and Mayor Morrow; those voting No, none. Reports for NovelT!.~er "Conti~luec!...:.." The following reports were presented for November: Water Collector Chief of Police The City Manager commented on the reports and recommended their approval. It was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that the reports be approved and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being Commiss- toner Sedivy, Commissioner Langohr and Mayor MOrroW; those voting No, none. ~~>ntinuation of MK:Certificate Suspension for City Bus: Certificate No. 3029: A letter received from the Board of Railroad Commissioners whereby the Board adopted a policy of granting suspensions of MRC Certificates only on a yearly basis was presented. Following a discussion, it was moved by Commissioner Langohr, seconded by Commissioner Sedivy, that the Board of Railroad Commissioners be requested to continue the present suspension of the City of Bozeman MRC Certificate No. 3029 for a period of one year from 1 January. 1970, to avoid the cancellation of the certificate and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner Sedivy and Mayor Morrow; those voting No, none. Notice_ of Intention to Exercise Option (Standard Construction yard): City Sh~!:..~Blks 29 & 30 of Imes Addition: The Lease and Option Agreement between Edna Tracy White, A. T. White, Salome B. Malsor, Irene Cannon and the City of Bozeman for the rental and purchase of all of Block 29, except Lots II and 12, and all of Block 30 of Imes Addition was presented. Following a discussion of the increased taxes and in accordance with the terms of the Agreement, it was moved by Commissioner Sedivy, seconded by Commissioner Lattgohr, that the City of Bozeman exercise its option to purchase the property at an early date in accordance with the terms of the Agreement and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Langohr and Mayor Morrow; those voting No, none.
