HomeMy WebLinkAbout1969-07-23 I I I 38:1 Bozeman, Montana 23 July 1969 The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall Building, Wednesday, 23 July 1969, at 1:00 o'clock p.m. Present were Mayor Morrow, Commissioner Sedivy, Commissioner Langohr, City Manager Frys1ie, Ass't. City Manager Keyes, City Attorney Berg and the Clerk. Mayor Morrow opened the meeting with a prayer and the following proceedings were had: Minutes of the regular session held 16 July 1969, were read and it was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that the minutes be approved as corrected and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Langohr and Mayor Morrow; those voting No, none. He~ring Resolution No. 1408 - SID No. 495, Paving S. Black Ave., East College - Harrison: This was the time and place set in Commission Resolution No. 1408 to hear protests to the creation of Special Improvement District No. 495. Affidavit of publication of Notice and the Clerk's mailing certificate stating that all property owners had been notified as required by law were presented. The City ~anager presented written protests filed with the Clerk of the City Commission and signed by owners of property representing 51.3158% of the proposed district as determined by the Engineer. Several property owners were present to affirm the written protests to the creation of Special Im- provement District No. 495. The City Commission having determined the protests to be sufficient, it was moved by Commissioner Langohr, seconded by Commissioner Sedivy, that under the provisions of Section 11-2206 R.C.M., 1947, no further proceedings shall be had under Commission Resolution No. 1408 and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner Sedivy and Mayor Morrow; those voting No, none. Continuation of Gas Fitter Bond- Montana Power Company: The continuation certificate for the renewal of the gas fitters license bond of the Montana power Company was presented. It was reported that the Building Inspector had approved the continuation of the bond and after approval of the certificate as to form by the City Attorney, it was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that the certificate be approved and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Langohr and Mayor Morrow; those voting No, none Ordi~ance No. 883 - Appropriation for provisional Adoption - Hearing 6 August 1969: The City Manager reviewed the proposed budget for the fiscal year ending 30 June 1970 and Ordinance No. 883 was presented, entitled: ORDINANCE NO.~ AN ORDINANCE APPROPRIATING MONIES FOR EXPENDITURES DEEMED NECESSARY AND IN ACCORDANCE WITH BUDGETARY REQUIREMENTS FOR MAINTENANCE ETC., OF THE MUNICIPAL GOVERNMENT OF THE CITY OF BOZEMAN, MONTANA FOR THE FISCAL YEAR ENDING 30 JUNE 1970. BE IT ORDAINED BY THE COMMISSION OF THE CITY OF BOZEMAN: It was moved by Commissioner Langohr, seconded by Commissioner Sedivy, that the Ordinance No 883 be provisionally passed and adopted and 6 August 1969 be set as the date for public hearing and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner Sedivy and Mayor Morrow; those voting No, none. Ordinance No. 88l. - Establish Sewer Rates and Charges, amending Section 12 of Ordinance No. 746: A proposed ordinance amending Section 12 of Ordinance No. 746 of the City of Bozeman, adopted 7 April 1948, which prescribed rates and charges for sewer service in the City of Bozeman was presented, entitled: 382 Ordinance No. 884 AN ORDINANCE OF THE CITY OF BOZEMAN, MONTANA, AMENDING ORDINANCE NO. 746 OF THE CITY, AND FIXING RATES AND CHARGES FOR SEWER SERVICE. Following a thorough discussion and in concurrence with the recommendation of the City Manager, it was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that Ordinance No. 884 be duly passed andadopted, and the Mayor and the Clerk of the Commission, being present, each affixed his signature to the Ordinance, and the Clerk of the Commission was directed to have it recorded in complete detail in the Ordinance book kept as a permanent and official record by the City of Bozeman and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Langohr and Mayor Morrow; those voting No, none. Authorize ~._Direct 57., Salary Deduction from Police Officers for Police Reserve: The City Commission was informed of the provisions of Section ll~1825 R.C.M., 1947, and House Bill No. 557 passed by the 1967 Legislative Assemby together with a letter from Mr. E. V. Omholt, State Auditor, dated 2 July 1969, and findings of facts and judgement in the court of the First Judicial District Judge Victor H. Fall presiding dated 18 June 1969. On the basis of this information and a thorough review of these documents by the City Attorney and upon recommendation of the City Manager, concurred in by the City Attorney, it was moved by Comm- issioner Langohr, seconded by Commissioner Sedivy, that effective 1 July 1969, 5% of the monthly wage shall be withheld from each active member of the Bozeman Police Department for deposit in the Police reserve (Retirement fund) and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr and Commissioner Sedivy and Mayor Morrow; those voting No, none. It was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that the report be approved and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Langohr and Mayor Morrow; those voting No, none. Quit Claim Deeds and Easements - Ollise & Maude Horn~r, Robert & Katherine Bounting: Quit Claim Deeds to Ollise and Maude C. Horner, and Robert A. and Katherine Bounting from the City of Bozeman for easements across their property as explained in detail on the Quit Claim Deeds and new Sanitary Sewer Pipe Line Easements from each of the above property owners for the installation and maintenance of a sanitary sewer pipe line as a part of the new Waste Water Treatment Plant project were presented by Ass't City Manager Keyes. The City Manager recommended that the City enter into the Agreements approved as to form by the City Attorney and it was moved by Commissioner Langohr, seconded by Commissioner Sedivy, that the Quit Claim Deeds and Easement Agreements be entered into by the City and the Mayor and the Clerk of the Commission be authorized and directed to sign for the City and that the claims for $50.00 attached to each easement as payment therefore be approved and ordered paid and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner Sedivy and Mayor Morrow; those voting No, none. proclamation: Roundup Week, 3-9 ~ygust 1969: Hestern Month: Mayor Morrow announced his proclamation of August 1969 as "Western Month" and 3-9 August as "Roundup Week" in the City of Bozeman and urged all Citizens of this City and area to observe in an appropriate manner, such as wearing colorful and typical western attire on this special occasion, I I I I I I this tribute to the heritage of the "old West", to support the "Western Month" and the "Bozeman Roundup" and to partake of the enjoyments of this festive occasion. It was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that this proclamation of the Mayor be endorsed and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Langohr and Mayor Morrow; those voting No, none. petition for Paving Improvements - Julia Martin Drive to 19th Ave.: A petition from Montana State University requesting the creation of a Special Improvement District for the paving of West Garfield Street from thepavement end at Julia Martin Drive to 19th Avenue (40'section) was presented. Following a discussion, it was moved by Commissioner Langohr, seconded by Commissioner Sedivy, that the City Attorney be instructed to prepare a resolution initiating a Special Improvement District for the paving of West Garfield Street from the pavement end at Julia Martin Drive to 19th Avenue and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner Sedivy and Mayor Morrow; those voting no, none. Chal!l...~_er of Commerce - Sidewalk Bazaar, Friday, 25 July 1969: It was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that authority for the merchants of Main Street to hold their annual sidewalk Bazaar on Friday, 25 July 1969, be granted and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy and Commissioner Langohr and Mayor Morrow; those voting No, none. Adjournment: There being no further business to come before the Commission at this time, it was moved by Commissioner Langohr, seconded by Commissioner Sedivy, that the meeting be adjourned and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Commission- er Sedivy and Mayor Morrow; those voting No, none.
