SUBJECT: Resolution 4763 authorizing Change Order No. 1 to the South University
Area Sewer Main Interceptor Project.
MEETING DATE: January 9, 2017

RECOMMENDATION: Approve Resolution 4763 authorizing Change Order No. 1 to the
South University Area Sewer Main Interceptor Project.
BACKGROUND: Attached is a copy of resolution 4763 and change order number 1 for the
above referenced project. This change includes installation of bollards around the two fire
hydrants on Bart Farm Road to protect them from being hit in the event of a slide off; connecting
Miller Pavilion to water and sewer and installation of an additional stub for future use, and
impacts to the means and methods of the boring subcontractor associated with an unknown
AT&T fiber optic cable. The City will be reimbursed for the Miller Pavilion and stub by MSU.
There will be additional charges with the AT&T conflict due to delays and cold weather impacts,
but those will be included in a future change order once they are fully quantified.
The final recommended change in cost and time for these items is reasonable and commensurate
with the work involved.
UNRESOLVED ISSUES: None
ALTERNATIVES: As suggested by the City Commission.
FISCAL EFFECTS: Overall this change order increases the contract amount by $159,020.00
from $1,434,620.00 to $1,593,640.00. As stated above, the City will be reimbursed for the MSU
work which amounts to $134,550.00.

COMMISSION RESOLUTION NO. 4763
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA,
APPROVING ALTERATION/MODIFICATION OF CONTRACT WITH DLM CONTRACTING,
INC., BOZEMAN, MONTANA.
WHEREAS, the City Commission did, on the 1st day of August 2016, authorize award of the bid for
the South University Area Sewer Main Interceptor project, to DLM Contracting, Inc., Bozeman, Montana; and
WHEREAS, Section 7-5-4308, Montana Code Annotated, provides that any such alterations or
modifications of the specifications and/or plans of the contract be made by resolution; and
WHEREAS, it has become necessary in the prosecution of the work to make alterations or
modifications to the specifications and/or plans of the contract.
NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman,
Montana, that the proposed modifications and/or alterations to the contract between the City of Bozeman, a
municipal corporation, and DLM Contracting, Inc., as contained in Change Order No. 1, attached hereto, be
and the same are hereby approved; and the City Manager is hereby authorized and directed to execute the
contract change order for and on behalf of the City; and the City Clerk is authorized and directed to attest such
signature.
PASSED AND APPROVED by the City Commission of the City of Bozeman, Montana, at a
regular session thereof held on the 9th day of January, 2017.
