Present were Mayor MOrrow, Commissioner Sedivy, Commissioner Langohr, City Manager Fryslie, City Attorney Berg and the Clerk. Commissioner Langohr opened the meeting with a prayer and the following proceedings were had: Minutes of the regular session held 3 September 1969, were read and it was moved by Comm- issioner Sedivy, seconded by Commissioner Langohr, that the minutes be approved as read and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Langohr and Mayor Morrow; those voting No, none. .9..uestiotl on Sign Insta~.l.~~~~__J;.l:~..~..Topper _ Club: r Mr. James R. F~~uson, Manager of the Topper Club, and Robin McNab appeared before the Commission to present a letter from capitol Neon Manufacturing Company, Inc., Helena, Montana, concerning a sign recently installed at the Topper club. The City Manager read a letter from W. E. Hutton & Co., Denver, Colorado, stating that they could not exercise their option to purchase the $I,400,OOO Sewer Revenue Bonds at their option rate of 5.95%. The City Manager also read letters from Dain, Kalman & Quail suggesting a more marketable issue maturity of lO years instead of the 20 year maturity and bond attorneys, Dorsey Marquart, Windhorst, West & Halladay giving assurance of their concurring legal opinion of shorter maturity. The City Manager recommended, in view of these developments, continuation of the adjourned bond sale until 17 September 1969 at l:OO o'clock p.m. It was moved by Commissioner Langohr, seconded by Commissioner Sedivy, that the bond sale be adjourned until Wednesday, Sept- ember 17,1969, at 1:00 P.M. and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner Sedivy and Mayor Morrow; those voting No, none. !29..!:!..!:"'~~f~..!::'~__:1I. w a..Esl__~~f._ CO!~!:.r~s:..t:..~.__f..?~J?__~v~q_~t:..~ w ~!'~~T:.. re a tme.!'..U) 1 <!.Il_.~_~an ~t;3fl2 e\"(~_ : The City Manager stated that during the past few weeks negotiations have been held with the low bidders on the Waste Water Treatment pland and the Sanitary Sewer Pipelines, Detweiler Bros., Inc and Felton Construction Company, and that they have arrived at a cost that will be within the money available. Deductions in the Treatment Plant were presented which amount to $175,985.00 leaving an adjusted contract price of $1,039,015.00. Deductions in the Pipeline Contract were also presented totaling $53,977.75 for an adjusted contract price of $697,127.45. Letters from the low bidders extending their bids which were due to expire 13 September were also presented. The City Manager extended his appreciation to Wayne Dean of Thomas, Dean & Hoskins and tothe l' Contractos, George H. Detweiler of Detweiler Bros, Inc., and John Felton of Felton Construction Company for their cooperation and extra effort to bring this project to its current status. The City Manager, in concurrence with a recommendation from the Consulting Engineers, recommended that the Commission approve these deductions and award contracts to these firms contingent on (l) Successful sale of bonds for the project, (2) WaterPollution Control Administration approval of these deductions and advancement of the grant for this project. It was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that the contingent award of the contract for constru- ction of the Waste Water Treatment plant be awarded to Detweiler Bros., Inc., of Twin Falls, Idaho, on the basis of their low bid submitted 13 August 1969, and the motion was carried by the following I I I I Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner Sedivy and Mayor Morrow: those voting No, none. In concurrence with the recommendation of the City Manager, it was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that the award be made to Don Norem Chevrolet-Buick in the amount of $3,324.59 and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Langohr and Mayor Morrow; those voting No, none. Robertson, Shrine Parade Marshall, requesting permission to stage a Shrine Parade in conjunction with the Shriners Football day 20 September 1969 was read. The City Manager recommended that the Commission approve this request. It was moved by Commissioner Langohr, seconded by Commissioner Sedivy, that the parade request be granted and the motion Has carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner Sedivy, and Mayor Morrow; those voting No, none. Citing a study and recommendation made by the Chief of Police, the City Manager stated that stop signs will be placed on North Ninth and North Tenth Avenues at their intersection with West Villard Street. It was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that the Comm- ission concur in the City Manager's action and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy and Commissioner Langohr and Mayor Morrow; those I voting No, none. Section 30, Township I South, Range 6 East, M.P.M., said land owned by Mr. & Mrs. J. A. McIlhatten, was presented along with a warrant in the amount of $5,000.00 to bind the option. The City Manager stated that the emergency status of our departments dictate that personnel must be available at all times and that all personnel employed since this policy had been reaffirmed had all resided inside the City Limits. TheCity Manager stated that the Building Inspector had recommended the approval of the above mentioned bond and the City Attorney had approved the bond as to form. A v~_ue . : A letter from Martin Whalen, Director of the Physical Plant at Montana State University, requesting that the City proceed to create a paving project on West Garfield Street, from the 1968 Married Students Housing to 19th Avenue was read. The letter further stated that Montana State University would pay cash for all costs, including engineering fees and incidental costs incurred by the City. It was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that the project be initiated and the Clerk of Commission prepare a "Call for Bids" to be opened either 1 October 1969 or 8 October 1.969 and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Langohr and Mayor Morrow; those voting No, none. After examination of the Claims and checking against the claim reg- ister, it was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that the claims be approved and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Langohr and Mayor Morrow; those voting No, none.
