HomeMy WebLinkAbout1969-04-30 348 Bozeman, Hontana 30 Apri 1 1969 The Commission of the City of Bozeman met in regular session the Commission Room, City Hall Building, Wednesday, 30 April 1969, at 1:00 o'clock p.m. Present were Mayor Morrow, Commissioner Sedivy, Commissioner Langohr, Acting City Manager Keyes, Acting City Attorney O'Connell and the Clerk. It was moved by Commissioner Langohr, seconded by Commissioner Sedivy, that the resolution be passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr. Exec\lti<?~f_ContrlOlct l~o_c:~~ments - ~}D !i.o_~ 492.2, The contract documents for the construction of a Sanitary Sewer in the alley between West Lamme and West Beall Street lying parallel to North Tenth and North Eleventh Avenue, SID No. 492 as awarded to Long Construction Company, Billings, Montana, on 23 April 1969 were presented. The Acting City manager recommended that the documents, approved as to form by the Acting City Attorney be approved. It was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that the contract documents be approved and that the Mayor and the Clerk of the Commission be authorized and directed to sign the contract for the City of Bozeman, that the Long Construction Company be authorized to proceed with the construction and that the pledge for bid security be returned to Long Construction Company and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Langohr and Mayor Morrow; those voting No, none. 1 I I 1 1 I Pr~.:p~sed Chl~_.r1i.~~t.2.. Keyes, Secretary of the Bozeman City-County Planning Board, recommending the proposed changes to the present Bozeman Zoning Code which were approved by the City County Planning Board at their meeting on 17 March was presented. Following a discussion, it was moved by Connnissioner Langohr, seconded by Commissioner Sedivy, that the Commission acknowledge receipt of the proposed changes to the Bozeman Zoning Code from the City County Planning Board and refer it to the Board of Adjustments to schedule a public hearing on these changes and report their findings and recommendations back to the City Commission. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner Sedivy and Mayor Morrow; those voting No, none. Fire Command Sch()El.::.~J?_?..rt l:2'...LLre Chief Jacl<_ Huber: Fire Chief Huber reported on his attendance at the Fireman's Command School conducted at Yakima, Washington, 14-17 April 1969. Chief Huber was very complimentary as to the manner in which the school was conducted and remarked there were some excellent speakers and the knowledge derived therefrom will be benefici.al when they hold their second Fire Service Institute in Montana. It was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that the report he approved and that Fire Chief Huber be commended on the excellent manner in which the report was presented and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Langohr and Mayor Morrow; those voting No, none. ~eport_:._Al11eri~:an_Xllb!Jcc hTorks Association Conference - Bob._IS-~~: The Ass't. City Manager reported on his attendance and that of the City Engineer at the second annual conference of the Rocky Mountain Chapter of the American Public Works Association held in Billings 17-18 April. It was moved by Commissioner Langohr, seconded by Connnissioner Sedivy, that the report be approved and that the Ass't. City Manager be commended on the excellent report and the motion was carried by the following Aye and No vote: those voting Aye being Con~issioner Langohr, Commissioner Sedivy and Mayor Morrow; those voting No, none. Le;..~..A&.r..e~t~ - One.~~ar Le_~~.- Jack Rosenthall, Ci~of Bozeman: Ol~_Coun~ry Cl\.:.l~.Bl~F': A Lease Agreement between Jack B. Rosenthall of Bozeman, Montana, and the City of Bozeman for the purpose of leasing the Old Elks Country Club and adjacent parking area situated in the Northern Pacific Addition to the City of Bozeman was presented. The Lease Agreement is for a period of one year commencing on the first day of May 1969 and ending on the Thirtieth day of April 1970. The rental of which is $100.00 per month, said payment of rental to be made monthly on the first and not latter than the tenth of each and every month. In concurrence with the recommendation of the Acting City Manager, it was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that the Lease Agree- ment be approved with an addendum attached reserving the use of the facility by the City of Bozeman for City sponsored functions upon a fifteen day notice being given prioer to the time of the function and that the Mayor and the Clerk of the Commissioner be authorized and directed to sign for the City and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Langohr and Mayor Morrow; those voting No, none. Na t;.L.'2.naU~a-B.'::f?~_o_~_<;:i !=Jes _..:....._~e_t ter re: Future Hunicipal B2_~~__.:rax_l:xem~i~-E~ A Congressional Report recieved from the National League of Cities regarding the future of Municipal Bond tax exemption whereby the Ways and Means Committee intend to take strong, direct action against tax exempt municipal bonds was presented. Following a thorough discussion, it was 349 350 Moved by Commissioner Langohr, seconded by Mayor Morrow, that a resolution of protest be prepared advising the Senators and Congressmen of the serious impact of this action. Commissioner Sedivy amended the motion to read "that the Congress be asked not to segregate Municipal Bonds from the list of a complete reform of tax exempt properties" but the amendment failed for the lack of a second. The motion was carried by the following Aye and No vote: those voting Aye being Commiss- ioner Langohr and Mayor Morrow; those voting No, being Commissioner Sedivy. Lambda Chi Fraternity, MSU Physical plant and Edsal~:.-C<?~n~uctionRegard~~I1JLP_ark:..~~o~I1_~~~~~~jxth: Ron McGihon, Terry Myhre and David Shannon of the Lambda Chi Fraternity appeared beofre the Commission to discuss the possibility of parking their cars on a part of South Sixth Avenue which is now barricaded for the construction of the Engineering Building or for permission to park their cars at another location during this period. Gordon Kelly of the Montana State University Physical plant and Mr. Wayne Edsall of Edsall Construction were also present to discuss the barricade on South Sixth Avenue and the parking of the Lambda Chi vehicles. Following a discussion of the possibilities of parking, the Lambda Chi group were advised by Mr. Kelly, that arrangements would be made for parking their cars at another location during the time of construction. ~cJEurn_rnent : There being no further business to come before the Commission at this time, it was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that the meeting be adjourned and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commiss- ioner Langohr and Mayor Morrow; those voting No, none.
