The Commission of The City of Bozeman met in regular session in the Commission Room, City Hall
Building, Wednesday, 21 May 1969, at 1:00 o'clock p.m. Present were Mayor Morrow, Commissioner Sedivy
Commissioner L8ngohr, City Manager Frys lie, Ass' t. Ci ty Manager Keyes, City At torney Berg and the Clerk.
Commissioner Sedivy opened the meeting with a prayer and the following proceedings were had:
Minutes of the regular session held lq. May 1969 were read and it was moved by Commissioner
Langohr, seconded by Commissioner Sedivy, that the minutes be approved as read and the motion was
carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner
Sedivy and Mayor Morrow; those voting No, none.

This was the time and place set for receiving bids for reconstruction of the diversion and
intake structures of Bozeman Creek and on Lyman Creek in connection with the Water Works Betterment
Project. Affidavit of publication of "Notice to Bidders" was presented. The sealed bids were on
file and it was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that the bids be
opened and read and the motion was carried by the following Aye and No vote: those voting Aye
being Commissioner Sedivy, Commissioner Langohr and Mayor Morrow; those voting No, none.

In concurrence with the recommendation of the City Manager, it was moved by Commissioner
Langohr, seconded by Conm'issioner Sedivy, that the bids be referred to the City Engineer and the
engineers representing consultant Thomas, Dean and Hoskins, Inc., to check the bids in detail,
prepare tabulations and make recommendations in regard to the lowest and best bid for the ~onstru-
ction of the improvements and the motion was carried by the following Aye and No vote: those
voting Aye being Commissioner Langohr, Commissioner Sedivy and Mayor Morrow; those voting No, none.

This was the time and place set in Commission Resolution No. 1402 to hear protests to the
creation of Special Improvement: District No. ~93: Affidavit of publication of Notice and the Clerks
Mailing Certificate stating that all property owners had been notified as required by law were
presented. The City Manager informed the Commission that as of 5:00 o'clock p.m., 19 May 1969, there
were no protests on file and no one appeared to verbally protest the creation of the district. The
City Manager recommended that the City Attorney be instructed to prepare a resolution creating the
district.

cussion of the schedule, the Commission concurred with the recommendation of the City Manager and
it was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that Police Court Bond
Schedule be approved for use by the Police Judge and the motion was carried by the following Aye
and No vote: those voting Aye being Commissioner Sedivy, Commissioner Langohr and Mayor Morrow;

Helena, 22-23 May 1969:
The fourteenth Annual Attorney General's Law Enforcement Conference is to be held in Helena,
Montana, 22-23 May 1969. The Chief of Police requested that captain Dorman be authorized to attend
the conference. It was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that Captain
Dorman be authorized to attend the conference and, it bein3 in the puhlic interest his expenses be
charged to the General fund and the motion was carried by the following Aye and No vote: those voting
Aye being Commissioner Sedivy, Commissioner Langohr and Mayor Morrow; those voting No, none.

The Annual meeting of the..Recreation and Park Association is scheduled to be held in Anaconda
23-2/. May 1969 and the City Recreation Director recommended that the Park Recreation Board Chairman,
the Recreation Director and the Park Superintendent be authorized to attend. In concurrence with
the recommendation concurred in by the City Manager, it was moved hy Commissioner Langohr, seconded
by Commissioner Sedivy, that the requested authorization to attent the conference be granted and,

it being in the public interest, their expenses be paid from the park fund and the motion was

The City Manager announced his reappointment of Joe Wantulok as a member of the Bozeman Police
by Commissioner Sedivy, that the Commission roncur in the reappointment of Joe Wantulok and the

Commission for a three year term ending 30 April 1972. It was moved by Commissioner Langohr, seconded

A thorough discussion followed and the Commission conrurred with the recommendation of the
Ci ty Manager and it was moved by Commissioner Sed ivy, seconded by Commissioner Langohr, tha t the
proposed ordinance be passed and adopted and the motion was carried by the following Aye and No vote: I

A request from George W. Keil of the Big Sky Gulf, 1310 North Seventh, for permission to
install a 250 gallon propane unit for servicing trailer house bottles at his service station at
1310 North Seventh Avenue was presented.
FolloHing a thorough discussion and in concurrence with the recommendation of the Fire Chief
also concurred in by the City Hanager, it Has moved by Commissioner Langohr, seconded by Commiss-
ioner Sedivy, that the permit be granted subject to the right of the City to cause it to be removed
by the owner \\Ihel1 and if the Fj'e Chief determines that it creates a hazard and the motion was
carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner
Sedivy and Mayor Morrow; those voting No, none.

Dr. Richard Cole appeared before the Commission to di.scuss the Fourth of July Fireworks
program t\'hich the Bozeman Exchange Club have sponsored annually uti 1 izing the old Coun try Club
facilities for this affair. It was pointed out that the Contractor of Interstate 90 East of
construction from the City property. Dr. Cole was assured that the City will assist the Exchange

Bozeman has entered into an agreement.. with the City of Bozeman for removing earth fill for road
club in Harking with the Contractor to accomodate this project.

by the 4-H Club Girls to conduct the sale as requested and the motion was carried by the following
