The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall
Building, \.Jednesday, 11 June 191)9, at 1:00 o'clock p.m. Present were Mayor Morrow, Conrrnissioner
Sedivy, Commissioner Langohr, City Manager Fryslie, Ass't. City Manager Keyes, City Attorney Berg
and the Clerk.
Commissioner Sedivy opened the meeting with a prayer and the following proceedings were had:
Minutes of the regular session held L, June 1969 were read and it was moved by Commissioner
Langohr, seconded by Commissioner Sedivy, that the minutes be approved as read and the motion was
carried by the follm.;ring Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner

The plans and Specifications for the construction of the new Waste Hater Treatment Plant,
Volume 1 and 2 and plans and specifications for the sanitary Sewers, Volume 1 and 2 were again
presented to the Commission. Hr. T'layne Dean of Thomas, Dean [~Hoskins, Great Falls, consultant
engineers for the City of Bozeman was also present to answer questions and make additional comments.
The City Nana~cr concurred \vith the r:onsultant engineers in recommending that the City Commission
approve the plans and specifications with the right to make changes if necessary. It was moved by
Commissioner Sedivy, seconded by Commissioner Langohr, that the plans and specifications for the
construction of the new Waste Water Treatment plant be approved as presented with the right to make
any necessary changes in the future and the motion was carricd by the follO\.Jing Aye and No vote:

The City Manager presented a claim from ThO':nas, Dean & Hoski.ns for services in connection
('J5th the eng-j~1eering services in accordance with the contract dated 29 December 1965 and amended
20 September 19~8 on the Waste Water Treatmcnt plant and the Interceptor and Outfall Sewers in the
amount of $l~0,317.00. After exami.nation of the claim, it was moved by Commissioner Langohr, seconded
by Commissioner Sedivy, that the claim in the amount of $lfO,3l7.00 be approved and the Director of
Finance be directt~d to issue a warrant in payment tl1ereof and the motion was carried by the following

A.Glen 1'1hite, Recreation Director has been selected as a participant to attend the Education-
al Professions Development Act Summer Institute in Elementary School Physical Education at Ttlashing-
ton State University, Pullman, Washington, from 23 June to 1 August 1959. A letter from Mr. White
requesting a leave of absence from his employment as Recreation Director with the City of Bozeman
from 23 June to 1 Augus t 1969 ,vas presen ted. The City Hanager commended Mr. l.Jhi te and recommended
he be granted a leave of absence for this period without pay. He further stated that Miss Judy
Gleason, Assistant Recreation Director wO\lld act as Recreation Director during his absence. It
was moved by Commissioner Langohr, seconded by Commissioner Sedivy, that 1'lr. \~hite's request be
granted for the purpose stated above and the motion was carried by the following Aye and No vote:

Electrician Bond - John L. Shaffer Construction:

The electrical bond of John L Shaffer, dba Shaffer Construction, Bozeman, Montana, was
presented. The bond having been approved by the City Building Inspector and as to fom by the
City Attorney, it was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that the
continuation of the aforementioned bond be approved and the motion was carried llY the following
Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Langohr and Mayor
Morrow; those voting No, none.

A petition was submitted to create a Special Improvement District for the construction and
installation of concrete curbs and gutters, asphaltic concrete pavement and necessary appurtenances
to the storm drainage system on South Bozeman Avenue and East Cleveland Street lying bet\veen Garfield
Street and eighty-feet westerly of Rouse Avenue and on South Montana Avenue between East Cleveland
Street and a point lying 439.25 feet southerly thereof. Following a discussion, the City Manager
advised the Conmlission, that the City Attorney had been instructed to prepare a resolution ini-
tiating Special Improvement District No. 494, entitled:

Sanitary Sewer Pipe Line Easements from each of the following property owners for the install-
ation and maintenance of a sanitary sewer pipe line across the property owned by James J. & E. Jane
Walker; Mrs. Helen Manley, etal; and Gallatin County; as a part of the new Waste Water Treatment
plant project were presented by Ass't. City Manager Keyes. The City Manager recommended that the
City enter into the agreements as to form by the City Attorney and it was moved by Commissioner
Langohr. seconded by Commissioner Sedivy. that the Easement Agreements be entered into by the City
and the Mayor and the Clerk of the Commission be authorized and directed to sign for the City and
that the clailu for $50.00 attached to each easement as pa~nent therefor be approved and ordered paid
and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner
Langohr, Commissioner Sedivy and Mayor Horrow; those voting No, none.

The reqllest from the Riverside Country Club for permission to discharge sewage f'Com the
proposed Riverside Manor Subdivision into the proposed new Bozeman Waste Water Treatment Plant was
again presented for discussion after having been taken under advisement. 1'1 concurrence with the

recommendation of the City Il\ttorney also concurred in by the City Manager, it was moved by Comm-
issioner Sedivy, seconded by Commissioner Langohr, that the request be denied primarily on the
basis of the le[';al position and the reaffirmation of the City Commission's long standing policy
not to extend use of City Utility systems to property outside the City limits and that Montana
Statutes preclude the City from offering sewer service of any kind to property outside of the City
and the motion ~'las carried by the following Aye and No vote: those voting Aye being Commissioner
Sedivy, Commissioner Langohr and Mayor Morrow; those voting No, none.

The City Manager commented on the claims and found them to be true and lawful claims against
the City of Do?:cman and rcronnr.ended they be approved and the Director of Finance be directed to

The National Rifle Association has scheduled a police FirearmS School to be held in Billings
18-20 June 19(,9. The Chief of police has requested authorization for Sgt. Hal McDo~vel1 to attend
the School, and, it being in the public interest his expenses be paid from the General fund. It
