HomeMy WebLinkAbout1969-07-02 I I I Bozeman, Montana 2 July 1969 The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall Building, Wednesday, 2 July 1969, at 1:00 o'clock p.m. Present were Mayor Morrow, Commissioner Sedivy, City Manager Fryslie, Asslt. City Manager Keyes, City Auorney Berg and the Clerk. Mayor Morrow opened the meeting with a prayer and the following proceedings were had: Minutes of the regular session held 25 June 1969 were read andit was moved by Mayor Morrow, sec- onded by Commissioner Sedivy, that the minutes be approved as corrected and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Morrow and Commissioner Sedivy; those voting No, none. Commissioner Langohr - Absence July 2-9, 1969: In concurrence with the recommendation of the City Manager, it was moved by Commissioner Sedivy, seconded by Mayor Morrow, that the absence of Commissioner Langohr from Commission Meetings of this date and 9 July 1969 be authorized in compliance with Section 2.08.060 of the Bozeman Municipal Code. The Motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy and Mayor Morrow; those voting No, none. Hearing Resolution No. 1406 - Intent to Create SID No. 494 - Paving & Storm Drain South Montana. Resolution No. 1407 - Creating SID No. 494: This was the time and place set in Commission Resolution No. 1406 to hear protests to the creation of Special Improvement District No. 492. Affidavit of publication of Notice and the Clerks mailing certificate stating that all property owners had been notified as required by law was presented. The City Manager informed the Commission that as of 5:00 o'clock p.m., 30 June 1969, there were no protests on file and no one appeared to verbally protest the creation of the district. The City Manager recommended that the City Attorney be instructed to prepare a resolution creating the District: COMMISSION RESOLUTION NO. 1407 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN CREATING A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DIS- TRICT NO. 494 OF THE CITY OF BOZEMAN FOR THE PURPOSE OF CONSTRUCTING AND INSTALLING AN ASPHALTIC.CONCRETE PAVEMENT, INTREGAL CONCRETE CURBS AND GUTTERS AND NECESSARY APPURTENANCES THERETO, ALSO CONSTRUCTION AND INSTALLATION OF NECESSARY DRAINAGE INLETS AND OTHER APPURTENANCES THERETO TO THE STORM DRAINAGE SYSTEM ON THAT PORTION OF soum BOZEMAN AVENUE AND EAST CLEVELAND STREET LYING BE'lWEEN GARFIELD STREET AND A POINT EIGHTY (80) FEET WESTERLY OF ROUSE AVENUE AND ON soum MONTANA AVENUE BETWEEN EAST CLEVELAND STREET AND A POINT LYING 439.25 FEET SOUTHERLY THEREOF. prepared by the City Attorney was presented. In concurrence with the recommendation of the City Manager, it was moved by Mayor MOrrow, seconded by Commissioner Sedivy, that the resolution be passed and adopted to Create Special Improvement District No. 494 and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Morrow and Commissioner Sedivy; those voting No~ none. Commission Resolution No. 1408 - Intent to Create SID No. 495 - Paving Portion S. Black Ave., Harrison AND College Streets: COMMISSION RESOLUTION NO. 1408 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA DECLARING IT TO BE THE INTENTION OF mE CITY OF BOZEMAN TO CREATE A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DIS- TRICT NO. 495 FOR THE PURPOSE OF CONSTRUCTING AND INSTALLING AN ASPHALTIC-CONCRETE TYPE PAVEMENT TOGEmRER WITH INTREGAL CONCRETE CURBS AND GUTTERS AND NECESSARY APPURTENANCES THERETO; ALSO CON- STRUCTION AND INSTALLATION OF A STORM DRAINAGE SYSTEM INCLUDING PIPE LINES, MANHOLES, DRAINAGE IlNLETS AND NECESSARY APPURTENANCES TO THE STORM DRAINAGE SVSTEM ON THAT PORTION OF SOUnt BLACK AVENUE BETWEEN COLLEGE AVENUE AND THE SOUTH LINE OF THE CUL-DE-SAC SERVING BLOCK TWO OF THE SPRING DELL ADDITION, THE TWO CUL-DE-SACS IN BLOCK 1 AND THE CUL-DE-SAC IN BLOCK 2, HARRISON STREET BETWEEN SOUTH TRACY AVENUE AND SOUTH BLACK AVENUE, COLLEGE STREET BETWEEN SOUTH TRACY AVENUE AND THE EASTERLY LINE OF THE SPRING DELL ADDITION. 371. 372 prepared by the City Attorney as directed by the Commission was presented. In concurrence with the recommendation of the City Manager, it was moved by Commissioner Sedivy, seconded by Mayor Morrow, that the resolution be passed and adopted and that 23 July 1969, be the date set for public hearing and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy and Mayor Morrow; those voting No, none. Commission Resolution (unnumbered) Road Oil Purchase from Montana Highway Commission - One Year 1 July 1969 to 30 June 1970: A resolution authorizing the purchase of not to exceed 25,000 gallons of Road oil during the fiscal year 1 July 1969 to 30 June 1970 - for use by the street department in repairing pavement and for sealing certain sections of existing pavement within the City from the Montana State Highway De- partment was presented as follows: RES 0 L UTI 0 N ------.....---- WHEREAS the City of Bozeman will have need during the fiscal year July 1, 1969 - June 30, 1070, for road oils for use in repairing streets and for sealing certain sections of existing pavement with- in the City, and WHEREAS the City of Bozeman does not have proper facilities for handling and storing the needed quantities of oils, and WHEREAS the Montana State Highway Department does have storage facilities and normally does have quantities of the required types of oils stored in Bozeman from which it can supply the quantities needed by the City of Bozeman, NOW, THEREFORE, BE IT RESOLVED: That an emergency does exist relative to the procurement of road oils by the City of Bozeman and the City Manager is hereby autho- rized to purchase from the Montana State Highway Department, from its stocks in storage in Bozeman, approximately twenty-five thou- sand (25,000) gallons of road oil, this to be purchased from time to time during the fiscal year July 1, 1969 - June 30, 1970, as needed by the City of Bozeman for repair and sealing of existing pavements, and these quantities of road oils to be purchased at cost plus normal handling charges. Bozeman Lions Club - Plans for Installation of Outfield Fence - Babe Ruth Park:-Kirk Park: Mr. Kenneth Beltz and Mr. Emil Anderson of the Bozeman Lions Club appeared before the Commission to present the proposed plans for the installation of an outfield fence at the Babe Ruth Ball Park located at Kirk Park by the Bozeman Lions Club. Following a thorough discussion, it was moved by Commissioner Sedivy, seconded by Mayor MOrrow, that the Bozeman Lions Club be highly commended for the consideration of the proposed project and that the plans for the installation of the outfield fence be approved as submitted contingent upon the approval of the Park Superintendent and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy and Mayor MorroW; those voting No, none. Authority to Purchase Water Hose - Park and Water Department - Approximately $850.00: The City Manager reported the Park Department has need for 150' V~" water hose and the Water I I I I I I department has need for 200' - l~" water Hose and 200' ~2~" water hose in the approximate amount of $850.00 and requested authorization to purchase the necessary hose. It was moved by Mayor Morrow, seconded by Commissioner Sedivy, that the purchase be authorized as requested and the motion was car- ried by the following Aye and No vote: those voting Aye being Mayor Morrow and Commissioner Sedivy; those voting No, none. Continuation Certificate - House Movers Bond - Cotton House Moving: In accordance with the provisions of Ordinance No. 785, the Building MOvers Bond as surety for a moving permit on Cotton House Moving Company, Helena, MOntana, was presented. It was reported the Building Inspector had recommended that the bond be approved and it having been approved as to form by the City Attorney, it was moved by Commissioner Sedivy, seconded by Mayor Morrow, that the bond be approved and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy and Mayor Morrow; those voting No, none. Reports for June (Continued): The following reports were presented for June: Building Inspector Fluoridation Police Judge The City Manager commented on the above reports and recommended their approval. It was moved by Mayor Morrow, seconded by Commissioner Sedivy, that the reports be approved and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Morrow and Commissioner Sedivy; those voting No, none. Authority to Order Speaker System - $1,195.00 Public Address System: The need for the public address system to be placed in the Commission Room was again presented for discussion. Following a thorough discussion, the Commission concurred with the recommendation of the City Manager and it was moved by Commissioner Sedivy, seconded by Mayor Morrow, that the City Manager be granted authorization to place an order with the New Mannix Electric for the installation of the public address system in the approximate amount of $1,195.00 on the basis of that firms low quotation for furnishing and installing the complete system and the motion was carried by the follo~- ing Aye and No vote: those voting Aye being Commissioner Sedivy and Mayor Morrow; those voting No, none Claims for June: Claim Nos. 4207 thru 4478 inclusive were presented on the various funds as follows: General Street Water SDS Library Planning Board Park Cemetery ~~, ".; ?
