HomeMy WebLinkAbout1969-01-15 1 1 I Bozeman, Montana 15 January 1969 The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall Building, Wednesday, 15 January 1969, at 1:00 o'clock p.m. Present were Mayor Morrow, Commission- er Sedivy, Commissioner Langohr, City Manager Frys1ie, Ass't. City Manager Keyes, City Attorney Berg and the Clerk. Mayor Morrow opened the meeting with a prayer and the following proceedings were had: Minutes of the regular session held 8 January 1969 were read and it \\Ias moved by Commissioner Langohr, seconded by Commissioner Sedivy, that the minutes be approved as read and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner Sedivy and Mayor Morrow; those voting No, none. Lighting .5'.E.._l1ain Street, Wallace ~o Buttonwood: Resolution No. 1397 - Creating SILD No. l.90: This was the time and place set in Commission Resolution No. 1395 to hear protests to the creation of Special Improvement Lighting District No. 490. Affidavit of publication of Notice and the Clerks mailing certificate stating that all property owners had been notified as required by law were presented. The City Manager informed the Commission that there were no protests on file and no one appeared to verbally protest the creation of the district. The City Manager recommended that the City Attorney be instructed to prepare a resolution creating the district. Commission Resolution No. 1397, entitled: COMMISSION RESOLUTION NO. 1397 A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA, DE- CLARING IT TO BE TIlE INTENTION OF TIlE SAID COMMISSION TO CREATE A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT LIGHTING DISTRICT NO. 490 FOR THE PURPOSE OF OPERATING AND MAIN- TAINING A STREET LIGHTING SYSTEM TO LIGHT MAIN STREET (U.S.HIGHWAY 10) AND A PORTION OF THE INTERSECTING STREETS ABUTTING BETWEEN TIlE WEST LINE OF WALLACE AVENUE AND THE CENTERLINE OF BUTTONWOOD AVENUE. prepared by the City Attorney was presented. In concurrence with the recommendation of the City Manager, it was moved by Commissioner Langohr, seconded by Commissioner Sedivy, that the resolution be passed and adopted to create Speical Improvement District No. 491 and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner Sedivy and Mayor Morrow; those voting No, none. It was moved by Commissioner Sedivy, se- conded by Commissioner Langohr, that the Poppy Sal e by the American Legion Auxiliary to be conducted on 23-2/+ Hay 1969 he approved and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner langohr, and Mayor Morrow; those voting No, none. The City Manager recommended that a new authority and signature sheet, for signing City of Bozeman checks for transfer or withdr8\vsl of City funds, be filed with the local banks containing the signatures of Cashier and Water Collector Raymond R. Bassett, Assistant Cashier Helen M. Wansink, when countersigned by either the Director of Finance J. W. Smith or City Manager Harold A Fryslie be approved. It was moved by Commissioner Langohr, seconded by Commissioner Sedivy, that the authority to sign the City of Bozeman checks be approved as recommended and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner Sedivy and Mayor Morrow; those voting No, none. Electrical Bond - J. Paul Peterson dba Service Electric: In compliance with Chapter 15 of the Bozeman Municipal Code, the Electrician Bond of J. Paul Peterson dha Service Electric, Bozeman, Montana, was presented. The City Manager reported that the Building Inspector had recommended approval of the bond and the City Attorney had approved the Bond as to form. It was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that the above bond be approved and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Langohr and Mayor Morrow; those voting No, none. Petitioryfor Sanitary Sewer SID: - Dr. Leo K. Durham and Dr. Thomas W. Fellmv$: A petition signed by Leo K. Durham, D.D.S. and Thomas W. Fellows, D.D.S., requesting the creation of a Special Improvement District to construct a sewer line to serve their property be- tween West Lamnle and West Beall Street and North Tenth and North Eleventh Avenue was presented. Following a discussion, it was moved by Commissioner Langohr, seconded by Commissioner Sedivy, that the City Attorney be directed to prepare a resolution of intention to create this district and the motion was carried Approval of plans and Specifications SIn No. 489 - 1,vater & SewC'.r, South Montana Avenue: Authority to Call for Corystruction Bids to be opened 5 Fcb...ru8..EY 1969: Authority to Advertise Bond Sale for 13 February 1969: plans and Specifications covering the proposed improvement in Special Improvement District No. 489 prepared by Thomas, Dean & Hoskins, Ioc., consulting engineers were placed before the Commission. In concurrence with the City Engineer, the City Manager recommended that the plans and Specifications as presented be approved and that a call for construction bids and a sale of the District Bonds in the maximum amount be authorized. It was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that the Plans and Specificationsbe approved and the Clerk of the Comm- ission be directed to publish a "Call for Bids" for the construction of improvements for the dis- 1 1 I 1 1 I triet with an opening date of 5 February 1969, and to advertise for bids for the"Sale of Bonds" of the District in the approximate amount of $73,000.00 to be received 13 February 1969 and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Langohr and Mayor Morrow; those voting No, none. Disposal Plant Operator The City Manager commented on the reports and recommended their approval.
