HomeMy WebLinkAbout1969-03-12 326 Bozeman, Montana 12 March 1969 The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall Building, Wednesday 12 March 1969 at 1:00 o'clock p.m. Present were Mayor Morrow, Commissioner Sedivy, Commissioner Langohr, City Manager Fryslie, Ass't. City Manager Keyes, City Attorney Berg and the Clerk. Mayor Morrow opened the meeting with a prayer and the following proceedings were had: Minutes of the regular session held 5 March 1969 were read and it was moved by Commissioner Langohr, seconded by Commissioner Sedivy, that the minutes be approved as read and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner Sedivy and Mayor Morrow; those voting No, none. Ordinance No. 876 - Defining 'Family' - Zoning Code: Ordinance No. 876 defining 'Family' as it pertains to the Zoning Code and revised by the City Attorney was again presented: ORDINANCE NO. 876 AN ORDINANCE OF THE CITY OF BOZEMAN AMENDING SECTION 17.08.140 OF THE BOZEMAN MUNICIPAL CODE, DEFINING "FAMILY", REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT THEREWITH AND DECLARING THE EFFECTIVE DATE OF ENACTMENT. Following a discussion of the revised ordinance, the Commission concurred with the recommend- ation of the City Manager and it was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that Ordinance No. 876 be passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Langohr and Mayor Morrow; those voting no, none. Ordinance No. 877 - Restricting Street Parking to Area between Curbs: Ordinance No. 877 as revised by the City Attorney prohibiting the parking of vehicles in the City streets, except that portion of the streets between curb lines of the street was again presented: ORDINANCE NO. 877 AN ORDINANCE PROHIBITING THE PARKING OF VEHICLES IN THE CITY STREETS EXCEPT TIlAT PORTION OF THE STREETS BETWEEN CURB LINES OF THE STREET, REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT HERE- WITH AND DECLARING THE EFFECTIVE DATE OF ENACTMENT. It was moved by Commissioner Langohr, seconded by Commissioner Sedivy, that Ordinance No. 877 be passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner Sedivy and Mayor Morrow; those voting No, none. I 1 A discussion was held in regard to the proposed project to widen the pavement on South Willson Application - Highway Commission - HB-42 Funds - $20,000.00, Widening S. Willson Ave.- Cleveland to Garfield: Avenue to 46 feet from 35 feet, from Cleveland Street to Garfield Street at an estimated cost of $20,000.00 of HB-42 funds. The Commission concurred in the recommendation of the City Manager and it was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that the City Manager be authorized to submit an application to the State Highway Department to provide for the widening of the pavement on South Willson Avenue from Cleveland to Garfield Street in the estimated amount of $20,000.00 of HB-42 funds and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Langohr and Mayor MOrrow; those voting No, none. Warranty Deed- City to U. S. Government - 192.85 Acres in Section 29, T 3S, R 6E.: A warranty deed conveying from the City of Bozeman to the United States Department of Agri- I I 1 I culture Forest Service a tract of land described as follows: Lot I, Lot 2, S~NE~ of Section 29, TWP 3S, Range 6E, Principal Meridian Montana containing 192.85 acres in Gallatin County was presented. Following a discussion, it was moved by Commissioner Langohr, seconded by Commissioner Sedivy, that the Warranty Deed be approved as recommended by the City Manager and the City Attorney and that the Mayor and the Clerk of the Commission be authorized and directed to execute the Warranty Deed for the City and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner Sedivy and Mayor Morrow; those voting No, none. Proclamation - DeMolay Week 16-22 March 1969: Mayor R. Harry Morrow announced his proclamation of the week of 16-22 March 1969 as "50th Anniversary Commemoration of DeMolay" week in the City of Bozeman and called upon all our citizens to join in saluting the young men of the Order of DeMO lay and in expressing our grateful apprec- iation of the fine examples set by these young leaders in contributing to the welfare and character of other young men in this community, thus aiding in the development and leadership of tomorrow. I,t was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that the Commission concur in the proclamation and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Langohr and Mayor Morrow; those voting No, none. Campfire Girls Candy Sale - 2 Weeks Beginning 25 April 1969: A letter received from Mrs. Margaret D. Walton, Bozeman Council of camp Fire Girls, requesting permission to conduct the annual candy sale for a two week period commencing 25 April 1969 was presented. It was moved by Commissioner Langohr, seconded by Commissioner Sedivy, that authori- zation to hold the fund drive of the Camp Fire Girls be granted and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner Sedivy and Mayor Morrow; those voting Aye being Commissioner Langohr, Commissioner Sedivy and Mayor Morrow; those voting No, none. Reports for February (Continued): The following reports were presented for February: cashier Chief of Police Water Collector The City Manager commented on the reports and recommended their approval. It was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that the reports be approved and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being Comm- issioner Sedivy, Commissioner Langohr and Mayor Morrow; those voting No, none. Claims for February (Continued): Claim No's. 3260 thru 3321 inclusive were presented on the various claims as follows: General $9,904.29 Library $1,209.54 Garbage $1,584.39 Street 2,743.28 Park 2,147.92 Parking Meter 351. 28 Water 6,859.46 Cemetery 1,020.33 PERS 1,385.60 SDS 1,208.81 Band 20.91 $28,435.81 The Ci ty Manager commented on the claims and found them to be true and lawful claims against the City of Bozeman and recommended they be approved and the Director of Finance be direc ted to issue warrants in payment. After examination of the claims and checking against the Claim register, it was moved by Commissioner Langohr seconded by Commissioner Sedivy, that the claims be approved and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner Sedivy and Mayor Morrow; those voting No, none. Adjournment: There being no further business to come before the Commission at this time, it was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that the meeting be adjourned and the motion was carried by the following Aye and No vote; those voting Aye be Langohr, Comm- issioner Sedivy and Mayor Morrow; those voting No, none.
