The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall
Building, Wednesday, 2 April 1969, at 1:00 o'clock p.m. Present were Mayor Morrow, Commissioner
Sedivy, Commissioner Langohr, City Manager Fryslie, Ass't. City Manager Keyes, City Attorney Berg
and the Clerk.
Mayor Morrow opened the meeting and suggested that we stand for a moment in silence in memory
of General Dwight D. Eisenhower and the following proceedings were had:
Minutes of the regular session held 26 March 1969 were read and it was moved by Commissioner
Sedivy, seconded by Commissioner Langohr, that the minutes be approved as read and the motion was
carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner
Langohr and Mayor MOrrow; those voting No, none.
Qpe~~Bid~Van Type Truck - Water Department:
This was the time and place set for opening bids on a van-type compact truck for primary use
as a water meter service vehicle. The affidavit of publication of the ''Call for Bids" was presented.
It was moved by Commissioner Langohr, seconded by Commissioner Sedivy, that the bids be opened and
read and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner
Langohr, Commissioner Sedivy and Mayor Morrow; those voting, No, none.
The following bids were then opened and read:

Upon the request of the City Manager, the Commission directed that the bids be referred to the
City Engineer and the Water Superintendent for checking and recommendation to be made to the
Commission.
Hxs. Herold Murdock - 1119 South \Hllson Avenue - Petition South Willson Ave. Cleveland and Garfield:
Mrs. Herold Murdock of 1119 South Willson Avenue appeared before the Commission to present a
petition protesting the widening of South Willson Avenue from Cleveland to Garfield Streets. The
petttion was taken under consideration.
Install Conduit under Sidewalk - Brence Union 76 Station:
A request from Oscar E. Keyes, Jr., owner of Brence Union 76 Station for permission to locate
a gasoline conduit under the sidewalk on South Church Avenue, adjacent to his property fronting on
Main Street was presented. In concurrence with the recommendation of the City Engineer, also con-
curred in by the City Manager, it was moved by Commissioner Sedivy, seconded by Commissioner Lan-
gohr, that the request to locate the gasoline conduit under the sidewalk on South Church Avenue be
granted, all work including sidewalk replacement to be at the owners expense, and the motion was
carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner
Langohr and Mayor Morrow; those voting No, none.
Ordinance No. 879 - Snow & Ice from Private Premises:
Ordinance No. 879 amending Section 9.12.040 and 9.12.050 of the Bozeman Municipal Code to
make it unlawful to place accumulated ice and snow from adjoining private premises in the City
Streets and alleys was again presented as follows:

MUNICIPAL CODE RELATING TO THE ENCUMBRANCE OR OBSTRUCTION OF STREETS
AND THE REMOVAL OF OBSTRUCTIONS AND LITTER, INCLUDING ACCUMULATED
ICE AND SNOW, FROM THE CITY STREETS OF THE CITY OF BOZEMAN AND RE-
PEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT HEREWITH.

It was moved by Commissioner Langohr, seconded by Commissioner Sedivy, that Ordinance No. 879
be passed and adopted and the motion was carried by the following Aye and No vote: those voting
Aye being Commissioner Langohr, Commissioner Sedivy and Mayor Morrow; those voting No, none.
Authority to Attend Annual Meeting - Rocky Mountain Chapter American Public Works Association
Billings, Montana, 17-18 April 1969 - Ci~ngineer Fargo:
The second annual conference of the Rocky Mountain Chapter, American Public Works Association
is scheduled to be held in Billings, Montana 17-18 April 1969. In concurrence with the City
Managers recommendation, it was moved by Commissioner SediVY, seconded by Commissioner Langohr,
that the City Engineer be authorized to attend the conference and, it being in the public interest
his expenses be paid from the appropriate fund and the motion was carried by the following Aye
and No vote: those voting Aye being Commissioner Sedivy, Commissioner Langohr and Mayor Morrow;
those voting No, none.
Fund Drive - Bozeman Symphony Association - 21 April to 1 May 1969:
A request from the Bozeman Symphony Association for permission to conduct a fund drive in
Bozeman from 21 April to 1 May 1969 was presented. In concurrence with the recommendation of the
City Manager, it was moved by Commissioner Langohr, seconded by Commissioner Sedivy, that per-
mission be granted the Bozeman Symphony Association to conduct the fund drive as requested and
the motion was carried by the following Aye and No vote: those voting Aye being Commissioner
Langohr, Commissioner Sedivy and Mayor MorroW; those voting No, none.
Wally Brownell - Peavey Company - Building Permit for Fertilizer plant:
Mr. Wally Brownell of the Peavey Company ,roducer Service requesting authorization to build
a Fertilizer Storage Plant at 611 East Cottonwood was present. Following a discussion of Mr.
Brownell's request, the Commission concurred with the Building Inspectors recommendation in accord-
ance with the Zoning Code also concurred in by the City Manager and the Fire Chief and it was
moved by Commissioner Sedivy, seconded by Commissioner Langohr, that Mr. Brownell's request to
build a Fertilizer Storage Plant be approved subject to fire and building code requirements being
met relative to nitrates being stored and the motion was carried by the following Aye and No vote:
those voting Aye being Commissioner Sedivy, Commissioner Langohr and Mayor Morrow; those voting No, none.
Building Permit - 315-321 South 9th Avenue - Mr. James Drummond:
Mr. James Drummond of 318 S. 9th Avenue and Mr. Oscar Thomas of 916 W. Koch Street appeared
before the Commission to inquire as to whether or not a building permit could be issued to place
a third house on land meeting zoning requirements for only two houses, in accordance with the
Zoning Code, lot area and setback provisions, until the one old house has been specifically removed,
as proposed by the applicant for a building permit on property at 315-321 South 9th Avenue.
Following a thorough discussion and in concurrence with the recommendation of the City Attorney,
also concurred in by the City Manager, it was moved by Commissioner Langohr, seconded by Comm-
issioner Sedivy, that the building permit be issued following the removal of the old building and
previous to construction of the new building and the motion was carried by the following Aye and
No vote: those voting Aye being Commissioner Langohr, Commissioner Sedivy and Mayor MorroW; those
voting No, none.
Consideration of Bids - Van Type Truck -Water Department:
The Commission was referred to the opening of bids for the Van Type compact~uck for use as
a water meter service vehicle. The bids having been analyzed, the City Manager concurred with

the City Engineer and the Water Superintendent,recommending that the purchase be awarded to Rolfe
and Wood, Inc., it being the lowest and best bid and equaling the specifications as contained in
the "Call for Bids." In concurrence with the recommendation of the City Manager, it was moved by
Commissioner Sedivy, seconded by Commissioner Langohr, that the purchase of the van type compact
truck be awarded to Rolfe & Wood, Inc., and the motion was carried by the following Aye and No
vote: those voting Aye being Commissioner Sedivy, Commissioner Langohr and Mayor Morrow; those
voting No, none.
~ut\.1oritL.J:o Attend Zone Police School - Helena, 3-4 April Police Chief Cutting & Captain Johnson:
A letter received from Chief Cutting requesting authorization for Chief C. R. Cutting and
Captain Robert Johnson to attend the Zone Police school to be held in Helena, Montana, 3-4 April
was presented. It was moved by Commissioner Langohr, seconded by Commissioner Sedivy, that Chief
C. R. Cutting and Captain Robert Johnson be authorized to attend the school and, it being in the pub-
lic interest their expenses be paid from the General fund and the motion was carried by the
following Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner Sedivy and
Mayor Morrow; those voting No, none.
Reports for March;
The following reports were presented for March:

Fire Chief
The City Manager commented on the reports and recommended their approval. It was moved by
Commissioner Sedivy, seconded by Commissioner Langohr, that the reports be approved and ordered
filed and the motion was carried by the following Aye and No vote: those voting Aye being Comm-
issioner Sedivy, Commissioner Langohr and Mayor Morrow; those voting No, none.

There being no further business to come before the Commission at this time, it was moved by
Commissioner Langohr, seconded by Commissioner Sedivy, that the meeting be adjourned and the
motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr,
Commissioner Sedivy and Mayor Morrow; those voting No, none.
