The Commission of the City of Bozeman met in regular session in the Commission Room, City
Hall Building, Wednesday, 2 April 1969, at 1:00 o'clock p.m. Present were Mayor Morrow, Comm-
issioner Sedivy, Commissioner Larigohr, City Manager Fryslie, Ass't. City Manager Keyes, City
Attorney Berg and the Clerk.
Commissioner Sedivy opened the meeting with a prayer and the following proceedings were had:
Minutes of the regular session held 2 April 1969 were read and it was moved by Commissioner
Langohr, seconded by Commissioner Sedivy, that the minutes be approved as corrected and the motion
was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Comm-
issioner Sedivy and Mayor Morrow; those voting No, none.
Buil~ing Permit 315-321 South 9th Avenue:
Mr. James Drummond, Mr. Roy Sternhagen, Mr. G. F. Widmer, Mr. P. E. Uh1rich and Mr, Ken
A. Cook appeared before the Commission to further discuss the building permit on property at
315-321 South 9th Avenue and request that they be assured that the house at 321 South 9th Avenue
be listed as a one unit dwelling. Following a discussion, it was determined that the lot Area of
the site in question is adequate for a two family dwelling under the zoning code.
Authori~~ to Purchase Cast Iron Pipe - 360 Feet - $728.00:
It was reported that it would be desirable to replenish the City's stock of cast iron pipe
and to meet water line installation requi~ements of the East Main Reconstruction project. The
City Manager requested authority to purchase 360 feet cast iron pipe at an approximate cost of
$728.00. It was moved by Commissioner Langohr, seconded by Commissioner Sedivy, that the pur-
chase be authorized as requested and the motion was carried by the following Aye and No vote:
those voting Aye being Commissioner Langohr, Commissioner Sedivy and Mayor Morrow; those voting
No, none.
Montana State University Officers - Special City police for Moving Traffic Offenses:
A letter received from Mr. D. J. Skerritt, Chief Traffic and Security Department Officer
of the Montana State University, requesting that the following members of their campus police
force be designated as Special policemen of the City of Bozeman for the purpose of issuing City
of Bozeman traffic citations on moving vehicle violations within the limits of the campus of
Montana State University for another year ending 30 April 1970, without cost to the City was
presented.

It was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that in concurrence
with the recommendation of the police Chief, the City Attorney and the City Manager, the appoint-
ment as requested be approved and the motion was carried by the following Aye and No vote: those
voting Aye being Commissioner Sedivy, Commissioner Langohr and Mayor MOrroW; those voting No, none.
Sanitary Sewer Pipe Line Easements - Interceptor & Outfall Lines: Ollise & Maude C. Horner;
Rolfe & Wood, Inc.; Gallatin County (2); Elton L. & C. May Bogart wI Lyle H. & Betty Mae Davis;
Robert A. & Katherine Bou~ting; Elton L. & C. May Bogart:
Sanitary Sewer Pipe Line Easements from each of the following property owners for the in-
stallation and maintenance of a sanitary sewer pipe line across the property owned by 01lise &

Maude C. Horner; Rolfe & Wood, Inc.; Elton L. & C May Bogart; Gallatin County (2); Elton L. &
C. May Bogart wI Lyle H. & Betty May Davis ; and Robert A. & Katherine Bounting; as a part of
the new Sewage Disposal Plant project were presented by Ass't. City Manager Keyes. The City Manager
recommended that the City enter into the Agreements as to form by the City Attorney and it was
moved by Commissioner Langohr, seconded by Commissioner Sedivy, that the Easement Agreements be
entered into by the City and the Mayor and the Clerk of the Commission be authorized and directed to
to sign for the City and that the claim for $50.00 attached to each easement as payment therefor
be approved and ordered paid and the motion was carried by the following Aye and No vote: those
voting Aye being Commissioner Langohr, Commissioner Sedivy and Mayor Morrow; those voting No, none.
Authority to Attend Police Ch~ef Association Meeting - Chief Cutting, 16 April, Lewistown:
The Montana Chief's of Police Association have scheduled a meeting to be held Wednesday,
16 April 1969, at Lewistown and the Chief of Police requested authority to attend the meeting.
It was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that the Chief of Police
be authorized to attend the meeting and, it being in the public interest, his expenses be paid
from the General fund and the motion was carried by the following Aye and No vote: those voting
Aye being Commissioner Sedivy, Commissioner Langohr and Mayor Morrow; those voting No, none.
Country Club B~tilding Lease - Jack Rosenthal - Board Recommendations:
A letter received from Mr. Jack B. Rosenthal in regard to the possibility of leasing from
the City of Bozeman the Country Club building on East Curtiss Street and Golf Way was presented.
Following a discussion and in concurrence with the recommendation of the Board of Public Recreation
and the Cemetery Board of the City of Bozeman, it was moved by Commissioner Langohr, seconded
by Commissioner Sedivy, that Mr. Jack B. Rosenthal be granted a one year lease, with rent at the
rate of $100.00 per month on the Country Club building at which time the contract will be reviewed
before entering into a second year and that the details of the lease agreement be developed with
consideration given to reserving use of the facility for City sponsored functions at reasonable
times and the motion was carried by the following Aye and No vote: those voting Aye being Comm-
issioner Langohr, Commissioner Sedivy and Mayor Morrow; those voting No, none.
Conti~~ation Certificates - plumber & Gas Fitter - Frank J. Trunk & Son: Western Plbg. & Heating:
In compliance with Chapter 16 of the Bozeman Municipal Code, the plumbing and gas fitter
bonds of Frank J. Trunk & Son, Inc., Bozeman, and Western Plumbing and Heating, Livingston, were
presented. The City Manager stated the Building Inspector had recommended the approval of the
above bonds and the City Attorney had approved the bonds as to fOrm. It was moved by Commissioner
Sedivy, seconded by Commissioner Langohr, that the continuation of the aforementioned bonds be
approved and the motion was carried by the following Aye and No vote: those voting Aye being
Commissioner Sedivy, Commissioner Langohr and Mayor Morrow; those voting No, none.
Reques ~~~se Bogart Park - Cub Scout Days, 7-8 July 1969:
A letter received from Mr. Clarence Hammett, Scout Executive if Yellowstone Valley Council
of the Cub Scouts of America, requesting permission to hold the annual "Cub Scout Days" on 7-8
July 1969, at the Bogart Park was presented. In concurrence with the recommendation of the City
Manager, it was moved by Commissioner Langohr, seconded by Commissioner Sedivy, that the Cub
Scouts be granted this permission ant1 the motion was carried by the following Aye and No vote: those
voting Aye being Commissioner Langohr, Commissioner Sedivy and Mayor Morrow; those voting No, none

Request for Easement - Montana Power Company:
A letter received from Mr. C. L. Belden, Division Superintendent of the Montana Power Company
requesting permission to construct a temporary power line across City owned property located in
NW~SW~, NE~SW~, and SE~SW\, all located in Section 8, T.2S., R.6E., and ultimately grant a permanent
easement at a suitable location across the same property after the completion of Highway Project
1-90-6 (1) 303 was presented. In concurrence with the recommendation of the City Manager, it was
moved by Commissioner Sedivy, seconded by Commissioner Langohr, that the City grant permission to
install a temporary power line across the City owned property and that the right of way easement
for the permanent location be considered following the completion of the highway construction and
the motion was carried by the following Aye and No vote: those voting Aye being Commissioner
Sedivy, Commissioner Langohr and Mayor Morrow; those voting No, none.
Request for permission to install Underground Cable - Mt. States Tel. & Tel.:
A letter received from Mr. Clifford D. Rossberg, Helena District Engineer, Mountain States
Telephone - Helena, requesting permission to install underground conduit on North Tracy Avenue from
Beall Street to Peach Street and bury a cable on Peach Street East to Rouse Avenue, then north on
Rouse Avenue to Birch Street, all work to be done in accordance with City of Bozeman Trench Speci-
fications and approved by the City Engineer was presented.
Following a thorough discussion and in concurrence with the recommendation of the City Engineer,
also concurred in by the City Manager, it was moved by Commissioner Langohr, seconded by Commissioner
Sedivy, that the request of Mountain States Telephone for permission to install the telephone cable
and conduit underground on North Tracy Avenue, Peach Street and North Rouse Avenue as indicated
was approved and the motion was carried by the following Aye and No vote: those voting Aye being
Commissioner Langohr, Commissioner Sedivy and Mayor Morrow; those voting No, none.

The City Manager commented on the claims and found them to be true and lawful claims against
the City of Bozeman and recommended they be approved and the Director of Finance be directed to
issue warrants in payment. After examination of the claims and checking against the claim register,
it was moved by Commissioner Sedivy, seconded byCommissioner Langohr, that the claims be approved

and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner
Langohr, Commissioner Sedivy and Mayor Morrow; those voting No, none.
E~~ination of Depository Bonds:
In compliance with the provisions of Section 16-2618, R.C.M., 1947, the City Commission
proceeded to examine the receipts of Depository Bonds and Securities held by the Director of
Finance as Security for City funds deposited in Bozeman banks. It was moved by Commissioner Sedivy,
seconded by Commissioner Langohr, that the securities be approved and a list thereof be set forth
in full in the minutes of the meeting and the motion was carried by the following Aye and No vote:
those voting Aye being Commissioner Sedivy, Commissioner Langohr and Mayor Morrow; those voting No,
none.
