The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall
Building, Wednesday, 13 November 1968, at 1:00 o'clock p.m. Present were Mayor Morrow, Commiss-
ioner Sedivy, Commissioner Langohr, City Manager Cutting, Ass't. City Manager Fryslie, City Attorney
Berg and the Clerk.
Commissioner Sedivy opened the meeting with a prayer and the following proceedings were had:
Minutes of the regular session held 6 November 1968, were read and it was moved by Commiss-
ioner Langohr, seconded by Commissioner Sedivy, that the minutes be approved as read and the motion
was carried by the fol10wipg Aye and No vote: those voting Aye being Commissioner Langohr, Comm-
issioner Sedivy and Mayor Morrow; those voting No, none.
Annual School for Water and Waste Water Plant Operators and Managers at Montana State University
18-22 November 1968 - City Engineer, Disposal Plant Operato~Yater Superintendent:
The Annual School for Water and Waste Water plant Operators and Managers will be held at
Montana State University 18-22 November 1968 and in concurrence with the recommendation of the
City Manager, it was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that the City
Engineer, Disposal Plant Operator, Water Superintendent and two other members of the Water De-
partment be authorized to attend the school on November 18 thru the 22nd and, it being in the
public interest, their expenses be paid from the appropriate fund and the motion was carried by
the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Langohr
and Mayor Morrow; those voting No, none.
Claim for Credit on Sidewalk Installation: Chas. R. Swart:
A claim received from Mr. Charles R. Swart, 324 South Grand Avenue, in regard to the quantity
of work performed by him on his sidewalk at 324 South Grand Avenue before the contractor began
installation was presented as follows:
Amount of old concrete walk completely removed
Amount of subgrade taken down to allow backfilling
Amount of gravel backfilled
-275 square feet
200 square feet
75 square feet

Following a discussion of the above subject, the Commission concurred in the recommendation
of the City Manager and it was moved by Commissioner Langohr, seconded by Commissioner Sedivy,
that Mr. Swarts' above claim when presented in proper form be approved for payment contingent
upon Mr. Swart making payment in full before the 30th of November, of the cost of the sidewalk
assessed to him and the motion was carried by the following Aye and No vote: those voting Aye
being Commissioner Langohr, Commissioner Sedivy and Mayor Morrow; those voting No, none.
Muscular Dystrophy Fund Drive:
A request from the Ross Jensen Chapter of the DeMo lays and Rainbow Girls to conduct their
annual house to house march or drive against Muscular Dystrophy was presented. It was moved by
Commissioner Sedivy, seconded by Commissioner Langohr, that permission to hold the Fund drive be
granted and the motion was carried by the following Aye and No vote: those voting Aye being
Commissioner Sedivy, Commissioner Langohr and Mayor Morrow; those voting No, none.
Propose~QJfer of Compensation for Right-of-Way Easements for New Sewage Disposal Plant Project:
Harold A. Fryslie, Right-of-Way Agent for the City presented a proposed offer of compensation
for Right-of-Way Easements to property owners from whom easements must be obtained for the
sanitary sewer lines to be constructed as a part of the new Sewage Disposal plant Project as follows:

Base Price for each easement:
$50.00
1.50 per lineal foot for the first 100 feet.
1.00 per lineal foot for all distances
over 100 feet per easement.
Damages:
The Commission concurred with the recommendation of the City Manager and it was moved by
Commissioner Langohr, seconded by Commissioner Sedivy, that the above schedule be approved and
that any deviations will be individually considered if unusual circumstances justify and the
motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr,
Commissioner Sedivy and Mayor Morrow; those voting No, none.

The letter submitted by City Manager Oscar E. Cutting requesting that he be relieved from
the position of City Manager and be permitted to retire from employment with the City of Bozeman
effective as of 31 December 1968 was again presented to the Commission following a week of
consideration.
It was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that the Commission
accept Manager Cutting's request for retirement with regret and that the ensuing vacancy in
the office of the City Manager be declared to exist as of 1 January 1969 and in line with what
would be the responsibility of the Commission, the Manager be instructed to proceed with ad-
vertising for applications to fill the vacancy that will occur on 1 January 1969, with consider-
ations to be given only to those applications received on or before 10 December 1968. The motion
was carried by the following Aye and No vote: Those voting Aye being Commissioner Sedivy, Comm-
issioner Langohr and Mayor Morrow; those voting No, none.

It was moved by Commissioner Langohr, seconded by Commissioner Sedivy, that the City Commiss-
ion and the City Manager be authorized to attend the meeting of Montana League of Cities and Towns
Legislative Committee to be held in Helena, 14 November 1968, and the expenses be paid from the
General fund and the motion was carried by the following Aye and No vote: those voting Aye being
Commissioner Langohr, commissioner Sedivy and Mayor Morrow; those voting No, none.
Repor..t of Meeting of Middle Creek Hater Users Associa~ion :~ Novem~eE.L-Ass ' ~_City Manager:
Ass't City Manager Frys1ie reported on his attendance of the Annual meeting of the Middle
Creek Water Users' Association held Monday, 11 November 1968. It was moved by Commissioner Sedivy,
seconded by Commissioner Langohr, that the Ass't. Manager be highly commended for his fine report
of the meeting and the motion was carried by the following Aye and No vote: those voting Aye
being Commissioner Sedivy, Commissioner Langohr and Mayor Morrow; those voting No, none.

The City Manager commented on the reports and recommended their approval. It was moved by
Commissioner Langohr, seconded by Commissioner Sedivy, that the reports be approved and ordered
filed and the motion was carried by the following Aye and No vote: those voting Aye being Comm-
issioner Langohr, Commissioner Sedivy and Mayor Morrow; those voting No, none.
