The Commission of the City of :3ozeman met in regular session in the Commission Room, City Hall
Building, Hednesday, {~September 1968, at 1:00 o'clock p.m. P'~esent were Hayor Morrovl, Commissioner
Sedivy, Commissioner Langohr, City Manager Cutting, City Attorney Berg and the Clerk.
Mayor Morrow openeJ the meeting with a prayer and the following proceedings were had:
Minutes of the regular sension held 28 August 1968 \vere read and it vJas moved by Commissioner
Langohr, seconded by Commissioner Sedivy, that the minutes be approved as corrected and the motion
was carried by the follmving Aye and No vote: those voting Aye being Commissioner Langohr, Commiss-
ioner Sedivy and Hayor MorrO\v; those voting No, none.

This (,Ias the time and place set for public hearing on levying assessment for construction of
Special Improvement District No. MH in the estimated amount of $80,000.00. Affidavit of publication
of Notice \'laS presented. No one protested in person and there being no written protests filed, Re-
solution No. 1381 \\Ias presented for final passage. It \vas moved by Commissioner Sedivy, seconded
by Commissioner Langohr, that the resolution be finally passed and adopted and the moti.en vJas
carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner
Langohr and Mayor Morrow; those vo ting No., none.

This was the time and place set for public hearing on levying assessment for construction of

In compliance \\lith Chapter 15 of the Bozeman Municipal Code, the Electrician bond of George Norman,
Belgrade, Montana, ,,,as presented for approvaLof the bond and the City Attorney had approved the bond
as to form. It was moved by Commissioner Sedivy, seconded by Commissioner Langonr, that the above
bond be approved and the motion was carried by the following Aye and No vote: those votin8 Aye being
Commissioner Sedivy, Commissioner Langohr and Mayor Morrow; those voting No, none.

A. letter ~cceived from Rudy Herzog, President of Rudy's, Inc., requesting permission to construct
a Milwaukee Railroad spur track on Peach Street to permit them to unload beer from a rail car direct-
ly into the warehouse was presented.
Following a discussion, it was moved by Commissioner Langohr, seconded by Commissioner Sedivy,
that the immediate installation of the railroad spur to serve Rudy's Distributing Company Peach
Street warehouse be granted provided that crossing warrning signs are erected for the protection of
traffic on ~jo!."th Ida Avenue in accordance with the recommendation of the City Engineer and the Ulotion
was carried by the following Aye and No vote: those voting Aye bei.ng Commissioner Langohr, Commiss-
ioner Sedivy and Hayor Morrow; those voting No, none.

A letter received from the Montana Power Company informing the Commission that the Mnntana
Pm-Jer Company has planned the installation of a new 6" Gas main on \-lest Grant Street from the Alley
between South Fourth Avenue and South Fifth Avenue to South Sixth Avenue was presented.
In concurrence with the recommendation of the rity Engineer, concurred in by the City Manager,
it was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that the installation of the
6" Cas Mnin on West Grant Street be approved and that the Montana Power Company maintain close con-
tact with the City Engineer and that they pay particular attention to the restoration of the ~round
traversed by the line and the motion was carried by the following Aye and No vote: those voting
Aye being Commissioner Sedivy, Commissioner Langohr and Mayor Morrmv; those voting No, none.

A letter received from Martin F. Whalen, Director of Division of Physical Plant of Montana
State University requesting that when paving South Seventh Avenue a drop curb he installed on the
West dide of Seventh Avenue for the feeder road to Gatton Field lots was presented.
Following a discussion, it vIas moved by Commissioner Langohr, seconded by Commissioner Sedivy,
that the Commission "reluctantly" give approval to the request for dr.opping the t'urb on the west
side of Seventh Avenue along the Gatton Field Parking Lot, only as a further gesture of the City's
desire to cooperate "lith the University in these problems and that they ~lay, therefore. proceed
vlith the installlltion of the curbs as requested and the motion ';'Jas carried by the [allowing Aye
