The Commission of the City of Bozeman met in regular session in the Commission Room, City
Hall Building, Wednesday, 2 October 1968, at 1:00 o'clock p.m. Present were Mayor Morrow, Comm-
issioner Sedivy, Commissioner Langohr, City Manager Cutting, Ass't. City Manager Fryslie, City
Attorney ~erg and the Clerk.
Commissioner Sedivy opened the meeting with a prayer and the following proceedings were had:
Minutes of the regular session held 25 September 1968 were read and it was moved by Comm-
issioner Langohr, seconded by Commissioner Sedivy, that the minutes be approved as read and the
motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr,
Commissioner Sedivy and Mayor Morrow; those voting No, none.
Hearing Resolution No. 1388 - Special Levy for 1968 Walks & Curbs - Final Passage:
This was the time and place set for hearing on levying assessment for the cost of repair,
replacement or construction of sidewalks for the year 1968 ~n the amount of $6,988.05. Affidavit
of publication of Notice was presented. No one was present to protest and no written protests
having been filed, Resolution No. 1388 as presented and provisionally passed at the meeting of
25 September 1968 was presented for final passage. It was moved by Commissioner Sedivy, seconded
by Commissioner Langohr, that the resolution be finally passed and adopted and the motion was
carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner
Sedivy and Mayor Morrow; those voting No, none.
Authority to Purchase 300 Cubic Yards one-half inch Crushed Gravel - Approximately $850. St. Dept.:
The Street Department has need for 300 cubic yards of 1/2" crushed gravel at at an approximate
cost of $850.00. It was moved by Commissioner Langohr, seconded by Commissioner Sedivy, that the
authority to purchase the gravel for the street department be authorized and the motion was carried
by the following Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner Sedivy,
and Mayor Morrow; those voting No, none.
Authori.ty to Call for Bids: Tractor-Backhoe-Loader: Approximately $13,000.00 Less Trade-in,
Water Department - Bid Opening 23 October:
The Water Department has need for a tractor-backhoe-loader at an approximate cost of $13,000.00.
with a trade-in of the present unit. It was moved by Commissioner Sedivy, seconded by Commissioner
Langohr, that the purchase of the tractor-backhoe-loader be approved and the Clerk of the City
Commission be directed to issue a "Call for Bids" for the purchase of the tractor-backhoe-10ader,
to be received and opened 23 October 1968 and the motion was carried by the following Aye and No vote:
those voting Aye being Commissioner Sedivy, Commissioner Langohr and Mayor Morrow; those voting No, none.
Authority to Call for Bids: One Ton Truck Approx. $4,000.00 less Trade-In Water Department:
Bid Opening 23 October 1968:
The Water' Department has an apparant need for a one (1) ton truck with dual rear wheels in
replacement of a 1950 GMC Two (2) ton dump truck. The estimated cost of the new unit is $4,000.00
less the trade-in of the unit mentioned above. In concurrence with the recommendation of the City
Manager, it was moved by Commissioner Langohr, seconded by Commissioner Sedivy, that the authority
be granted and the Clerk of the Commission be authorized to issue a "Call for Bids" for the purchase
of the truck, to be received and opened 23 October 1968 and the motion was carried by the following
Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner. Sedivy and Mayor Morrow;
those voting No, none.

Proclamation of "Fire Prevention Week" Beginning 6 October 1968 - Breakfast:
Mayor R. Harry Morrow announced his proclamation designating the week of 7-12 October as
"Fire Prevention Week". The Fire Chief reported a breakfast, to which the public is invited, will
be served at the Bozeman Fire Hall on Monday, 7 October 1968, from 7:00 o'clock to 10:00 o'clock
a.m. to kick off the Annual Fire Prevention Week activities and that the City Fire Department has
scheduled its usual program for the entire week. In concurrence with the recommendation of the
City Manager, it was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that the
Mayors proclamation and the program of the Fire Department be approved and the motion was carried
by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Langohr,
and Mayor MOrrow; those voting No, none.
Report on Meeting Montana Citizens for Court Improvements - Billings, 30 September - Mayor Morrow:
Mayor Morrow reported on his attendance at the meeting of Montana Citizens for Court Improve-
ments held in Billings 30 September 1968. It was moved by Commissioner Langohr, seconded by Comm-
issioner Sedivy, that Mayor MOrrow's attendance at the meeting be authorized and, it being in the
public interest his expenses be paid from the General fund and that Mayor Morrow be highly comm-
ended for his fine report of the meeting and the motion was carried by the following Aye and No vote;
those voting Aye being Commissioner Langohr, Commissioner Sedivy and Mayor Morrow; those voting No, none.
Report on Conference of Building Officials: Houston, Texas 23-27 September 1968. Bldg. Inspector
Donald Barrick:
City Building Inspector Donald Barrick reported on his attendance at the 46th Annual Internat-
ional Conference of Building Officials held in Houston, Texas, 23-27 September 1968. His report
consisted of a complete resume of the program and the value received therefrom. It was moved by
Commissioner Sedivy, seconded by Commissioner Langohr, that Mr. Barrick be highly commended for the
completeness of his report in regard to the value of the information obtained at the meeting and
that it be accepted and approved and the motionwas carried by the following Aye and No vote: those
voting Aye being Commissioner Sedivy, Commissioner Langohr and Mayor Morrow, those voting No, none.
Report on National Guard Meeting re-Riot Control - 25 September 1968 - Police Chief:
Police Chief Cutting appeared before the Commission to report on the Montana National Guard
Riot Control Conference held at the Armory = 25 September 1968 under the supervision of Major
General Richard Kendall, The Adjutant General. It was moved by Commissioner Langohr, seconded by
Commissioner Sedivy, that Police Chief Cutting be commended on his report and the acceptance there-
of and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner
Langohr, Commissioner Sedivy and Mayor Morrow; those voting No, none.
Authority to Attend DOD Military Police School, Fort Gorgon, Ga., 1-7 December, Police Chief Cutting:
A department of Defense Riot Control School conducted by the Military Police School is sche-
du1ed to be held at Fort Gordon, Georgia, 1-7 December 1968, and the City Manager recommended that
Police Chief Cutting be authorized to attend the school and that Fire Chief Huber be authorized to
attend as an alternate in the event there is a last minute cancellation. It was moved by Commiss-
ioner Sedivy, seconded by Commissioner Langohr, that, it being in the public interest, the Police
Chief be authorized to attend the school and the Fire Chief be authorized to attend as an alternate
in the event there is a cancellation and the expenses be paid out of the General fund and the motion
was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commiss-
ioner Langohr and Mayor MOrrow; those voting No, none.

Request to Hold Homecoming Parade - Friday 4 October 3:00 p.m. - Rosary High School:
A letter received from Bill Saner, Student Body President of the Rosary High School requesting
permission to conduct a Homecoming Parade on Friday, 4 October 1968 at 3:00 o'clock p.m. was pres-
ented. It was moved by Commissioner Langohr, seconded byCommissioner Sedivy, that permission to
stage the parade as requested be granted and the motion was carried by the following Aye and No
vote: those voting Aye being Commissioner Langohr, Commissioner Sedivy and Mayor Morrow; those
voting No, none.
Authority to Attend Montana League of Cities Directors & Legislative Committee Meeting Helena,:
Commissioners and Manager:
It was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that the City Comm-
ission and the City Manager be authorized to attend the Montana League of Cities and Towns Directors
and Legislative Committee Meeting to be held in Helena, 3 October 1968J and the expenses be paid
from the General fund and the motion was carried by the following Aye and No vote: those voting
Aye being Commissioner Sedivy, Commissioner Langohr and Mayor Morrow; those voting No, none.
Authority to Attend International City Managers Association Convention- Detroit- 20-24 October

The 54th Annual International City Managers Association Convention/scheduled to be held in
Detroit 20-24 October 1968 and the City Manager recommended that Ass't. City Manager Harold A.
Fryslie be authorized to attend the meeting. It was moved by Commissioner Langohr, seconded by
Commissioner Sedivy, that the Ass't. City Manager be granted permission to attend the Convention
and, it being in the public interest his expenses be paid from the General Fund and the motion
was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Comm-
issioner Sedivy and Mayor Morrow; those voting No, none.
Resolution No. 1389 - Special Levy for SID No. 486: Water & Sewer Mains - Kagy Blvd for
provisional Passage - Hearing 9 October:
Commission Resolution No. 1389 levying final assessment for the construction of SID No. 486
in the total amount of $21,447.10 was presentedJ entitled:

Hearing 9 October 1968:

in the total amount of $33,000.00 was presented, entitled:

Parking at ll20 South Willson Avenue and 302 North Eleventh Avenue - Buz Cowdrey:
Following a discussion of the numerous complaints received at the City offices in regard to
off-street parking at 1120 South Willson Avenue and 302 North Eleventh Avenue, it was moved by
Commissioner Sedivy, seconded by Commissioner Langohr, that the City Attorney investigate the situ-
ation and take all necessary steps to enforce the Zoning Ordinance in regard to this situation and
the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy,
Commissioner Langohr and Mayor Morrow; those voting No, none.

The City Manager commented on the claims and found them to be true and lawful claims against
the City of Bozeman and recommended they be approved and the Director of Finance be directed to
issue warrants in payment. After examination of the claims and checking against the claim register,
it was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that the claims be approved
and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner
Sedivy, Commissioner Langohr and Mayor Morrow; those voting No, none.
Adjournment:
There being no further business to come before the Commission at this time, it was moved by
Commissioner Langohr, seconded by Commissioner Sedivy, that the meeting be adjourned and the motion
was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Comm-
