HomeMy WebLinkAbout1968-10-09 270 Bozeman, Montana 9 Oc tober 1968 The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall Building, Wednesday, 9 October 1968, at 1:00 o'clock p.m. Present were Mayor Morrow, Commissioner Sedivy, Commissioner Langohr, City Manager Cutting, Ass"t. City Manager, Fryslie, City Attorney Berg and the Clerk. Commissioner Langohr opened the meeting with a prayer and the following proceedings were had: Minutes of the regular session held 2 October 1968 were read and it was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that the minutes be approved as read and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Langobr and Mayor Morrow; those voting No, none. Authority to Purchase Sewer Rod: 230 each 5/16" X 39" Approximately $980.00. The City Manager stated that the Sanitary Sewer Department has a need for an additional supply sewer rod and requested authority to purchase 230 pieces of 5/16" x 39" rod at an approximate cost of $980.00. It was moved by Commissioner Langohr, seconded by Commissioner Sedivy, that the purchase be authorized and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner Sedivy and Mayor Morrow; those voting No, none. Hearing Resolution No. 1387: Intention to Create SILD No. 479 - Street Lighting West Main Street: This was the time and place set in Commission Resolution No. 1387 to hear protests to the crea- tion of Special Improvement Lighting District No. 479. Affidavit of publication of Notice and the Clerks mailing certificate stating that all property owners had been notified as required by law were presented. The City Manager informed the Commission, that there were no protests on file and no one appeared to verbally protest the creation of the district. In concurrence with the re- commendation of the City Manager, it was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that the City Attorney be instructed to prepare a resolution to create Special Improvemett Lighting District No. 479 on West Main Street from Eighth Avenue to the West City Limits and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Langohr and Mayor Morrow; those voting No, none. Hearing Resolution No. 1386: Intention to Create SID No. 489 - Water & Sewer: This was the time and place set in Commission Resolution No. l386 to hear protests to the creation of Special Impcovement District No. 489. Affidavit of publication of Notice and the Clerks mailing certificate stating that all property owners had been notified as required by law were presented. The City Manager informed the Commission there were no written protests on file and no one ap~eared to verbally protest the creation of the district. Following a discussion, it was moved by Commissioner Langohr, seconded by Commissioner Sedivy, that the City Attorney be instructed to prepare a resolution creating the district for consideration 16 October, but that the petitioners be requested to submit additional information as to their plan for the liquidation of the existing assessment delinquency against their property from previous special improvement districts for the consideration of the Commission and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner Sedivy, and Mayor Morrow; those voting No, none. Authority to Attend First Fire Service Institute at M.S.U. 14-17 Oct., Ass't Fire Chief Hoey & Fireman Dewey Johnson: The First Fire Service Institute is scheduled to be held on the Montana State University campus 14-17 October 1968, and in concurrence with the recommendation of the Fire Chief and the City Manager, I I I I I I it was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that Ass't Fire Chief Hoey and Fireman Dewey Johnson be authorized to attend the Institute and, it being in the public interest their expenses be paid from the General Fund and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Langohr and Mayor Morrow; those voting No, none. Reques t to Use Bogart Grove & Band Shell: "Annual Derby Day". A letter received from Charles Hill of the Sigma Chi Fraternity requesting permission to hold their annual Derby Day's function with all the sororities at Bogart's Grove on Saturday afternoon, 19 October 1968, was presented. It was moved by Commissioner Langohr, seconded by Commissioner Sedivy, that the request for holding the annual Derby Day program at Bogart Park on 19 October 1968 be approved contingent upon the fo llowing : 1) Petitioner may have electrical connection at the Band Shell if desired, but may not have access to the storage room. 2) That petitioner provide own garbage cans and pick up whatever litter that has occurred following program. 3) That the hours of program be from 1:00 to 3:30 p.m. on the 19th day of October 1968. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner Sedivy and Mayor Morrow; those voting No, none. Authority to Hold Homecoming Parade: Saturday 12 October 1968 - 10:00 A.M. Montana State Univ.: A letter received from Nancy E. Weaver, Parade and Halftime Chairman, 1968 Homecoming Comm- ittee, Montana State University, requesting permission to stage their annual parade on Saturday, 12 October 1968, at 10:00 o'clock A.M. was presented. The parade will begin at the Buttrey's Parking Lot on West Main Street and proceed down Main Street to the intersection of East Main Street and South Church Avenue. It was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that permession to stage the parade as requested be granted and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Langohr and Mayor Morrow; those voting No, none. Ordinance No. 875 - Sign Ordinance: Ordinance No. 875 to be known as the Sign Ordinance of the City of Bozeman was presented, enti tled: ORDINANCE NO. 875 AN ORDINANCE TO PROVIDE FOR THE AMENDMENT OF THE CITY OF BOZEMAN, MONTANA, SIGN CODE AND AMENDING TITLE NO. 14, CHAPTER 14.16 OF THE OFFICIAL CODE OF THE CITY OF BOZEMAN, MONTANA ORDINANCE NO. 824. Following a thorough discussion on the final reading of the Ordinance, it was moved by Comm- issioner Sedivy, seconded by Commissioner Langohr, that Ordinance No. 875 be passed and adopted wLth the exception that Section 1, Chapter 14.16.030 (Enforcement), Sub-paragraph (b) pertaining to the Right-of-Entry be deleted in its entirety, and the motion was carried by thefullowing Aye and No vote; those voting Aye being Commissioner Sedivy, Commissioner Langohr and Mayor MorroW; those voting No, none. Authority to Purchase Sewer Pipe: Miscellaneous Sizes - Approximately $825.00: The City has need for Sewer Pipe in miscellaneous sizes in the approximate amount of $825.00. It was moved by Commissioner Langohr, seconded by Commissioner Sedivy, that the purchase of the Sewer Pipe be authorized and the motion was carried by the Following Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner Sedivy and Mayor Morrow; those voting No, none. 271 272 Hearing Resolution No. 1389 - Special Tax Levy SID No. 486 - Final Passage: This was the time and place set for public hearing on levying assessment for construction of Special Improvement District No. 486 in the final amount of $21,447.10. Affidavit of publication of Notice was presented. No one protested in person and there being no written protests filed, Resolution No. 1389 was presented for final passage. It was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that the resolution be finally passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioneer Langohr and Mayor Morrow; those voting No, none. Hearing Res. No. 1390 - Special Tax Levy (Estimate) SID No. 470 - Final Passage: This was the time and place set for public hearing on levying estimated assessment for con- struction of Special Improvement District No. 470 in the amount of $33,000.00. Affidavit of public- ation of Notice was presented. No one was present to protest and there being no written protests on file, Resolution No. 1390 was presented for final passage. It was moved by Commissioner Langohr, seconded by Commissioner Sedivy, that the resolution be finally passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner Sedivy and Mayor Morrow; those voting No, none. Claims for September: Claim No's 1696 thru 1853 inclusive were presented on the various funds as follows: General Street Water SDS Library Park $13,094.89 3,640.50 7,781.02 1,278.39 1,575.76 2,788.47 Cemetery Band Garbage parking Meter Cemetery Suspense S.I.D. Total $ 4,573.30 245.00 1,544.84 357.46 240.00 12.24 $37,131.87 The City Manager commented on the claims and found them to be true and lawful claims against the City of Bozeman and recommended they be approved and the Director of Finance be directed to issue warrants in payment. After examination of the claims and checking against the claim register, it was moved by Commissioner Langohr, seconded by Commissioner Sedivy, that the claims be approved and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner Sedivy and Mayor Morrow; those voting No, none. Reports: The following reports were presented as follows: Cashier Chief of Police Water Collector The City Manager commented on the reports and recommended their approval. It was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that the reports be approved and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being Comm- issioner Sedivy, Commissioner Langohr and Mayor Morrow; those voting No, none. Adjournment: There being no further business to come before the Commission at this time, it was moved by Commissioner Langohr, seconded by Commissioner Sedivy, that the meeting he adjourned and the motion was carried by the following Aye and No vote: those voting issioner Sedivy and Mayor Morrow; those voting No, none.
