The Commission of the City of Bozeman met in regular session in the Commission Room, City
Hall Building, Wednesday, 1. May 1968, at 1:00 o'clock p.m. Present were Mayor Morrow, Commissioner
Sedivy, Commissioner Langohr, City Manager Cutting, Ass't City Manager Fryslie, Acting City Attorney
Angel and the Clerk.
Mayor Morrow opened the meeting with a prayer and the following proceedings were had:
Minutes of the regular meeting held 24 April 1968, were read and it was moved by Commissioner
Sedivy, seconded by Commissioner Langohr, that the minutes be approved as read and the motion was
carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner
Langohr and Mayor Morrow; those voting No, none.
Proclamation: May 1968 as "Mental Health Month" - Gallatin County Mental Health Assoc. - Pigeon
Flight:
Mayor Morrow issued a proclamation designating the month of Mayas ''Mental Health Month"
and urged all citizens to help the mentally ill by working together with the local Mental Health
Association. It was moved by Commissioner Langohr, seconded by Commissioner Sedivy, that Mayor
Morrow's proclamation as requested by the local Health Association Publicity Director be approved
and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner
Langohr, Commissioner Sedivy and Mayor Morrow: those voting No, nonE!.
A request for holding the Gallatin County Mental Health Association Bell Ringer Fund raising
campaign at 2:00 o'clock p.m. on Saturday, 4 May 1968, in the down town business district was
presented. Following a discussion, it was moved by Commissioner Sedivy, seconded by Commissioner
Langohr, that the request to hold the Fund Drive be approved, but that the request for the use of
the police or Fire Vehicle for the purpose of signaling the release of the carrier pigeons be denied
considering that it is an improper use of this emergency equipment and the motion was carried by
the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Langohr
and Mayor Morrow; those voting No, none.
Request for use of Bogart Park and Band Shell: MSU Group 11 May 1968:
A letter received from Mr. John O. Langenbach, Assistant Professor, Department of History,
Government & Phi1osphy, Montana State University, for permission to use Bogart Grove and the City
band shell and to hang a banner across Main Street in conjunction with the 4-11 May Vietnam
Symposium was presented. It was moved by Commissioner Langohr, seconded by Commissioner Sedivy,

that use of the Bogart Grove be granted based upon the following conditions and the motion was
carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Commiss-
ioner Sedivy and Mayor Morrow; those voting No, none.
1) That you comply ",ith the City Ordinance prohibiting intoxicating
liquors in any Bozeman City Park;
2) That the volume of any music you propose to have be held to a
moderate level;
3) That your use of the park for this activity does not extend be-
yond midnight, and
4) That your group clean up any litter stemming from your activity.
Request for Loading Zone on Willson Avenue and Curb Opening on Main Street for Off Street parking
Oxford Block - L. 1. Benepe:
A letter received from Lucien L. Benepe, owner of the Oxford Building asking permission to have
a curb opening on the South side of West Main Street between the Oxford Block and the Imperial 400
Motel for the purpose of an entry to off street parking and the installation of a proper sign for

the existing loading and unloading zone at the rear of the Oxford Block on South Willson was
presented. Following a discussion and in concurrence with the recommendation of the City Manager,
it was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that the request for the
curb opening on West Main Street into the Oxford Block property at a width of 16' as recommended
by the City Engineer and also the installation of a proper sign for the existing loading zone
at the rear of the Oxford Block on Willson Avenue be approved and the motion was carried by the
following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Langohr
and Mayor Morrow; those voting No, none.
Request for Use of City Commission Room for "Museum of the Rockies" Meeting:
Each Tuesday Night thru May 1968:
A verbal request of the Board of the Museum of the Rockies for permission to hold their
meeting each Tuesday during the month of May in the Commission Room of the City Hall Building
was presented. It was moved by Commissioner Langohr, seconded by Commissioner Sedivy, that the
above requested permission be granted and the motion was carried by the following Aye and No
vote: those voting Aye being Commissioner Langohr, Commissioner Sedivy and Mayor Morrow; those
voting No, none.
Request for Holding Candy Sale: 2-23 May 1968: Bozeman Babe Ruth Baseball: M.D. Rapkoch:
A letter requesting permission for the Bozeman Babe Ruth Baseball group to conduct a candy
sale within the City of Bozeman 2-23 May 1968 was presented. It was moved by Commissioner Sedivy
seconded by Commissioner Langohr, that permission to conduct the candy sale be granted and the
motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy,
Commissioner Langohr and Mayor Morrow; those voting No, none.
Authority to Attend Meeting of Montana Municipal League Officer, Executive and Legislative Comm-
ittees: GlendLve - 10 May 1968:
The Montana Municipal League has scheduled a meeting of the Officer, Executive and Legis-
1ative Committees to be held in Glendive on Friday, 10 May 1968. It was moved by Commissioner
Langohr, seconded by Commissioner Sedivy, that the City Manager and members of the City Commission
be authorized to attend the meeting and that Ass't City Manager, Harold A. Frys1ie, be designated
of the City Manager
as Acting City Manager during the absence/and, it being in the public interest their expenses be
paid from the proper fund and the motion was carried by the following Aye and No vote: those
voting Aye being Commissioner Langohr, Commissioner Sedivy and Mayor Morrow; those voting No, none.
Report on Meeting - Rocky Mountain Chapter, AWPA: Idaho Falls - 25-27 April:
The City Engineer reported on the first annual conference of the Rocky Mountain Chapter of
the AWPA held in Idaho Falls 25-27 April. It was moved by Corrnnissioner Sedivy, seconded by Comm-
issioner Langohr, that City Engineer Fargo be commended on the excellent report and that it be
accepted and approved and the motion was carried by the following Aye and No vote: those voting
Aye being Commissioner Sedivy, Commissioner Langohr and Mayor Morrow; those voting No, none.
Report on Northwestern District Recreation & Park Conference - Spokane 21-23 April 1968:
City Recreation Director A. Glen White reported on his attendance and that of Park Superin-
tendent Thurman E. Cloninger, at the Northwestern District Recreation and Park Conference held in
Spokane, 21-23 April 1968. His report consisted of a complete resume of the programs and the value
derived therefrom. I t was moved by Commissioner Langohr, seconded by Corrnnissioner Seui vy, that
the Recreation Director be corrnnended on the thoroughness of his report and that it be accepted and
approved and the motion was carried by the following Aye and No vote: those voting Aye being
Commissioner Langohr, Commissioner Sedivy and Mayor Morrow; those voting No, none.

En1ar emen!: of Easement to 13' Westerl side of Lot 1 Block 7 Universit No.2 - McKinle Anderson:
A letter received from Lee G. Allen requesting the approval of the following changes in the
location of dedicated utilities easement in the University Addition to the City of Bozeman was presented.
1) Change the la' easement on the east side of Lot 1, Block 1
of University No.3 to a 7' easement.
2) Change the 10' easement on the west side of Lot 1, Block 7
of University No. 2 to a 13' easement.
Following a discussion, it was moved by Commissioner Sedivy, seconded by Commissioner Langohr,
that the City Attorney be instructed to prepare the appropriate resolution vacating a strip 3' in
width from the utility easement in Lot 1, Block I of University Subdivision No.3 and provide the
City with an additional 3' width along the east side of the platted utility easement in Lot 1,
Block 7 of University Subdivision No.2 and the motion was carried by the following Aye and No vote:
those voting Aye being Commissioner Sedivy, Commissioner Langohr and Mayor Morrow; those voting NO,none.
Utility Agreement with State Highway Department for relocation of a portion of Large East Side
Sewer Main to Accommodate Interstate Construction etc.:
A Utility Agreement prepared by the State Highway Department for the relocations of the City's
large sanitary sewer on the East side of Bozeman to accomodate the construction of the proposed
Interstate Highway East of the City was presented. This Agreement would provide for the relocation
of this Sanitary Sewer pipe line without cost to the City but an installation of sewer pipe under
the proposed Haggerty Lane Frontage road for future use would be at the City's expense, both in-
stallation, however, to be included in the proposed highway contract.
In concurrence with the recommendation of the City Manager, it was moved by Commissioner
Langohr, seconded by Commissioner Sedivy, that the Agreements be approved and the Mayor and the
Clerk of the City Commission be authorized to sign for the City and the motion was carried by the
following Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner Sed ivy and
Mayor Morrow; those voting No, none.
Request to hold Bicycle Relay Race 1:00 p.m. Wednesday 8 May 1968 - Montana State University "Greek
Week:"
A letter received from Mr. Kris Oaas requesting permission to hold a Bicycle race in conjunction
with the Annual Greek Week activities on the Montana State University Campus on "M" Day was presented.
It was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that permission for holding
the bicycle race at l:OO p.m. on 8 May 1968, along the route as described be granted and that the
police Department be advised of any change in plans so that proper protection can be provided the
bicycle riders and the motion was carried by the following Aye and No vote: tho~voting Aye being
Commissioner Sedivy, Commissioner Langohr and Mayor Morrow; those voting No, none.
Reque~~fOE-Parking Strip Landscaping - New Safeway Store: 10th & Main Stree t:
A letter from Charles A. Kest1e, Architect, dated 29 April addressed to the City Engineer
Roman C. Fargo relative to the new Safeway Store under construction in Bozeman was presented. The
letter dealt with the subject of proposed treatment of the parking strips on the street adjoining
the new store and the Safeway plan for landscaping and requested the City's Approval of this plan
rather than a planting of grass and shrubbery as normally requested by the City.
The City Commission directed that a letter be addressed to the Architect expressing disappoint-
ment in the Company's plan which was felt to be lacking in the proper aesthetic treatments of the
new site and to request the company's consideration of some alternative plan such as filli.ng the
strips with concrete and providing for the planting of trees in tree wells at appropriate inter-
w Is around the site.
