The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall
Building, Wednesday,S June 1968, at 1:00 o'clock p.m. Present were Mayor Morrow, Commissioner
Sedivy, Commissioner Langohr, City Manager Cutting, Ass't City Manager Fryslie, City Attorney
Berg and the Clerk.
Commissioner Langohr opened the meeting with a prayer and the following proceedings were had:
Minutes of the regular meeting held 29 May 1968 were read and it was moved by Commissione
Sedivy, seconded by Mayor Morrow, that the minutes be approved as read and the motion was carried
by the following Aye and No vote: those voting Aye being Commissioner Sedivy and Mayor Morrow;
those voting No, none.
Open Bids on SID No. 486: Water & Sewer Lines on Kagy Blvd. West of South Seve!1th Avenue:
This was the time and place set for receiving bids for construction of Water and Sewer lines
on Kagy Blvd. West of South Seventh Avenue in Special Improvement District No. 486. Affidavit of
publication of "Notice to Bidders" was presented. Three sealed bids were on file and it was moved
by Commissioner Langohr, seconded by Commissioner Sedivy, that the bids be opened and the motion
was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Comm-
issioner Sedivy and Mayor Morrow; those voting No, none.
The following bids were opened and read:

Long Construction Company

The bids were then referred to the City Engineer and the engineers representing consultant
Thomas, Dean & Hoskins, Inc., to check the bids in detail, prepare tabulations and make recommend-
ations in regard to the lowest and best bid's for the construction of the improvements within the
d is tric t.
Hearing Resolution No. 1367 - Intent to Create SID No. 488 - Paving East Babcock Street and
South Wallace Avenue:
This is the time and place which has been designated for hearing Commission Resolution No. 1367,
Special Improvement District No. 488. Affidavit of publication of Notice and the Clerks mailing
certificate stating that all property owners had been notified as required by law were presented.
The City Engineer presented a written protest filed with the Clerk of the City Commission by the
Chicago, Milwaukee, St. Paul and Pacific Railroad representing 24.65% of the pr~posed district.
Mr. J. E. Blonegin, Deer Lodge, was present to affirm the written protest of the Chicago, Milwaukee,
St. Paul and Pacific Railroad and to answer any questions that may come before the Commission.
Following a discussion and in concurrence with the recommendation of the City Attorney, it
was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that the action on the creation
of SID No. 486 be delayed for one week to permit further study of the filed protest and the motion
was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Comm-
issioner Langohr and Mayor Morrow; those voting No, none.
Authority to purchase 29 3/4" Water Meters - Approximately $990.00:
The Water Department has need for an additional supply of 3/4 inch water meters and requested
authority to purchase twenty-nine water meters at approximate cost of $990.00. It was moved by
Commissioner Langohr, seconded by Commissioner Sedivy, that the purchase be authorized and the

motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr,
Commissioner Sedivy and Mayor Morrow; those voting No, none.
Authority to Attend MLEA Major Case School: 2-15 June: Officers Ronald D. Green & Harold J. Veltkamp:
The Police Major Case School conducted by the Montana Law Enforcement Academy is scheduled to
be held at the Montana State University, 3-15 June 1968. The Chief of Police has requested authori-
zation to submit the application of Harold Veltkamp and Ronald Green to attend the Major Case
School. Officer Green is attending on a scholarship he won at the Academy Basic School last year
and therefore without cost to the department. The City Manager recommended concurrent authori-
zation of the attendance of the aforementioned officers and it was moved by Commissioner Sedivy,
seconded by Commissioner Langohr, that attendance of Officers Green and Veltkamp at the MLEA
Major Case School be authorized, and, it being in the public interest, the expenses of Harold
Ve1tkamp be charged against the General fund and the motion was carried by the following Aye and
No; those voting Aye being Commissioner Sedivy, Commissioner Langohr and Mayor Morrow; those
voting No, none.
Request to Vacate one-half Block of East Alderson Street - West from S. Black Avenue:
The Request from Cliff L. Cullen and Louis McCrea to abandon the half block street between
their residential properties on East Alderson was again presented for consideration and inspection
on the ground of East Alderson Street.
Request to Close 200' Portion of East Aspen Street - East of North Church Avenue:
The Montana Power Company has acquired the northerly 100' of lots one through 6 of Block 108,
Northern Pacific Addition and have petitioned the City Commission to close a portion of Aspen
Street between North Church Avenue and North Wallace Avenue adjoinin~ their property.
Consideration of 1968 Sidewalk Program:
The City Engineer had completed his survey of walks and Curbs within the City and recommend-
ations for repair and/or installation for the year 1968.
Recess:
The meeting was recessed and the Commission proceeded to make its on the ground inspection
of East Alderson Street, of Aspen Street between North Church Avenue and North Wallace Avenue and
its annual inspection of "Walks and Curbs" within the City.
Meeting reconvened at 3:30 o'clock p.m.:
Request to Vacate one-half block of East Alderson Street west from South Black Avenue:
Following on the ground inspection of East Alderson Street west from South Black Avenue, the
Commission further discussed the abandoning of East Alderson Street and it was moved by Commissioner
Langohr, seconded by Commissioner Sedivy, that the request to vacate the one-half block of East
Alderson Street be referred to the Planning Board for their recommendation and the motion was
carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Commiss-
ioner Sedivy and Mayor Morrow; those voting No, none.
Request to Close 200' Portion of East Aspen Street - East of North Church Avenue:
The petition of the Montana Power Company to close a portion of Aspen Street between North
Church and North Wallace Avenues adjoining their property was tabled to get more information from
the Montana Power Company in regard to their building plans.
Consideration of 1968 Sidewalk Program:
Fo llowing the annua 1 inspec tion of the ''Walks and Curbs" within the City, it was moved by

Commissioner Sedivy, seconded by Commissioner Langohr, that the City Engineers recommendation for
repair and/or installation of walks and curbs within the City for the year 1968 be approved with
the addition of three blocks of walk on the north side of West Mendenhall Street between North
Seventh and North Eleventh Avenue and the motion was carried by the following Aye and No vote: those
voting Aye being Commissioner Sedivy, Commissioner Langohr and Mayor Morrow; those voting No, none

Authority to Attend Seminar for Fire Chiefs: Helena 10-14 June Ass't. Fire Chief Hoey:
The Department of Public Instruction is conducting a workshop for fire chief's in Helena
10-14 June 1968 and in concurrence with the recommendation of the Fire Chief also concurred in by
the City Manager, it was moved by Commissioner Langohr, seconded by Commissioner Sedivy, that
Ass't. Fire Chief Herbert Hoey be authorized to attend the workshop and, it being in the public
interest his expenses be paid from the General fund and the motion carried by the following Aye
and No vote: those voting Aye being Commissioner Langohr, Commissioner Sedivy and Mayor Morrow;
those voting No, none.
Consideration of ConstructiQn Bids Special Improvement District No. 486:
The City Engineer and the engineers representing consultant Thomas, Dean and Hoskins, Inc.,
having completed their study of the bim submitted for construction of Water and Sewer lines on
Kagy Blvd. west of South Seventh Avenue within District No. 486, and having prepared a tabulation
of the bids found an arithmetical error in the New Budd Plumbing and Heating Company bid in the
amount of $2,875.80 making a corrected total of $20,351.11 instead of the $l7,475.3l as read and
recommended that Long Construction Company of Billings, Montana, be awarded the contract for con-
struction of SID No. 486 on the basis of its bid in the amount of $17,869.00 being the lowest and

best bid submitted. The City Manager concurred in the recommendation of the engineer and it was
moved by Commissioner Sedivy, seconded by Commissioner Langohr, that the contract be awarded to
Long Construction Company on the basis of its bid as noted above, contingent upon the successful
sale of the bonds of Special Improvement District No. 486 which is scheduled for 12 June 1968,
and that the bid security of the unsuccessful bidders be returned and the motion was carried by
the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Langohr,
and Mayor Morrow; those voting No, none.
Parking Strip Landscapping - New Safeway Store - 10th Avenue and Main Street:
Mr. Joe Wantu10k Manager of the Bozeman Safeway Store and Mr. Jack Thomas representing
Safeway Stores, Inc., from Butte, Montana appeared before the Commission to further discuss the
proposed treatment of the parking strips on the streets adjoining the new store and the Safeway
plan for landscaping.
Following a discussion, the City Commission announced that an exception to the Zoning Ordinance
had been granted by the Board of Adjustment and its action permitting placing of gravel in the
parking strips on the streets adjoining the new store would be valid. Safeway representatives
tentatively agreed that consideration would be given to a further effort to improve the situation

at a later date as requested by the City Commission.

The City ~anager commented on the reports and recommended their approval. It was moved by
Commissioner Langohr, seconded by Commissioner Sedivy, that the reports be approved and ordered
filed and the motion was carried by the following Aye and No vote: those voting Aye being Commiss-
ioner Langohr, Commissioner Sedivy and Mayor Morrow; those voting No, none.

The City Manager commented on the claims and found them to be trIte and lawful claims against
the City of Bozeman and recommended they be approved and the Director of Finance De directed to
issue warrants in payment. After examination of the claims and checking against the Claim Reg-
ister, it was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that the claims
be approved and the motion was carried by the following Aye and No vote: those voting Aye being
Commissioner Sedivy, Commissioner Langohr and Mayor Morrow; those voting No, none.
Death of Senator Robert F. Kennedy -- Unnumbered Resolution:
Mayor Morrow officially noted the death of Senator Robert F. Kennedy. The City Commission
then passed and adopted the following Resolution:
UNNUMBERED RESOLUTION
A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN,
GALLATIN COUNTY, MONTANA, IN REGARD TO AN ASSASSINS
ATTEMPT ON THE LIFE OF SENATOR ROBERT FRANCIS KENNEDY.
WHEREAS, Robert Francis Kennedy, Senator of New York State, was struck
down on Wednesday, 5 June 1968, in the City of Los Angeles by a would be
Assassin, and
WHEREAS, we, like all American citizens and civilized people every-
where, are shocked and horrified by this attack on Senator Robert Francis
Kennedy, one of the outstanding leaders in our country and forerunning
presidential candidate, and
WHEREAS, we too are deeply concerned over this continuation of law-
lessness in our nation and attacks upon our leadership that poses a dire
threat to this nation.
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF BOZEMAN:
That it is the desire of this City administration to take official
note of this tragedy and express its extreme feeling of outrage and that
we must deplore this unrestrained violence at loose in our nation and
pledge ourselves to lending every effort to the restoration of law and
order.
AND BE IT FURTHER RESOLVED, that our hearts go out to this stricken
family and we join in prayer for the speedy recovery of Senator Robert
Francis Kennedy, and that it is our hope that his attacker will be brought
to speedy justice.
