HomeMy WebLinkAbout1968-03-13 1 I 1 Used Resolution Book Sheet in error Bozeman, Montana 13 March 1968 The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall Building, Wednesday, 13 March 1968, at 1:00 o'clock p.m. Present were Mayor Morrow, Commiss- ioner Sedivy, Commissioner Langohr, City Manager Cutting, Ass't City Manager Frys1ie, City Attorney Berg and the Clerk. Mayor MOrrow opened the meeting with a prayer and the following proceedings were had: Minutes of the regular meeting held 6 March 1968 were read and it was moved by Commissioner Sedivy, seoonded by Mayor Morrow, that the minutes be approved as read and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy and Mayor Morrow; those voting No, none. Appointment of Police Judge: Richard J. Andriola: Mayor Morrow announced that the City Commission, complying with the provisions of Chapter ll-327l, R.C.M., 1947, had appointed Richard J. Andriola of Bozeman as Police Judge to fill the vacancy created in that office by the resignation of Richard H. Renn. It was moved by Commissioner Langohr, seconded by Commissioner Sedivy, that Mr. Andriola's appointment as Police Judge for the City of Bozeman be confirmed and his appointment be retroactively effective as of 11 March 1968 and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner Sedivy and Mayor Morrow; those voting No, none. Open Bids - 1968 Truct for Cemetery: This was the time and place set for opening bids on a one ton, 4 wheel drive truck for use by the Cemetp.ry Department. The affidavit of publication of the "Call for Bids" was presented. It was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that the bids be opened and read and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Langohr and Mayor MOrrow; those voting No, none. Bozeman Motors, Inc., Robert F. Dye, Inc., Don Norem Cbev. & Buick Owenhouse Hardware Company Rolfe & Wood, Inc., $3,075.50 3,240.00 2,848.50 3,481.49 3,589.96 Upon request of the City Manager, the Commission directed that the bids be referred to the City Engineer and the Superintendent of the Cemetery for checking and recommendations to be made to the Commission at its next meeting. Deed to City of Bozeman for 60' Street Right of Way for Kagy Blvd. 3rd to lIthe Avenue: 11th Avenue from Kagy Blvd. to Lincoln Road from Gallatin County: A Quit Claim Deed to the City of Bozeman from Gallatin County for a tract of land sixty feet wide for street right-of-way for Kagy Boulevard between Third Avenue and Eleventh Avenue and Eleventh Avenue from Kagy Boulevard to Lincoln Road, as described in detail on the deed and as such be dedicated to the public use was presented. In concurrence with the recommendation of the City Manager, it was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that the subject deed be accepted for the public use and the motion was carried by the following Aye and No vot~ those voting Aye being Commissioner Sedivy, Commissioner Langohr and Mayor MOrrow; those voting No, none. Deeds to City of Bozeman from State of Montana for: (a) Water Mains, Sanitary Sewers and Street: Kagy Blvd. (Greekway to S. 7th Ave.; S. 7th Ave. from Kagy Blvd to Grant St.) (b) Storm Drainage and Utilities: Grant Street (Vacated) 6th to 7th Ave. : (a) A Right of Way Deed conveying to the City of Bozeman from the State of Montana for the 400.\ 163 ~ Used Resolution Book 16 4 Sheet in error. construction and maintenance of watermains, sanitary sewers and street purposes upon and across state lands was presented as follows: Tract 1. A tract of land forty-five feet in width lying south of and adjacent to the following described centerline of Kagy Boulevard bound on the easterly edge by the westerly right-of-way line of the Chicago, Milwaukee, St. Paul and Pacific Railroad Right-of-Way extending west- ward 465.83' as described in detail on the deed. Tract 2. A tract of land ninety feet in width, forty-five feet on each side of the following described centerline of Kagy Boulevard, beginning at a point on the easterly line of tbe Chicago, Milwaukee, St. Paul and Pacific Railroad Spur line right-of-way; thence westward 888.97' as described in detail in the deed. Tract 3. A tract of land sixty feet in width lying thirty feet each side of the following described centerline of vacated South Seventh Avenue as originally platted in the C~pitol Hill Addition to Bozeman, Montana, and said South Seventh Avenue extended South to Kagy Boulevard as described in detail on the deed. (b) A Right-of-Way Deed conveying to the City of Bozeman from the State of Montana for a storm sewer and other utilities installation and maintenance of same, beginning at the intersection of the centerline of vacated Grant Street and the easterly line of vacated South Seventh Avenue to the westerly line of South Sixth Avenue. Following a discussion, it was moved by Commissioner Langohr, seconded by Commissioner Sedivy, that subject deeds for Right-of-Ways be accepted for the public use and for the purpose of con- struction and maintenance of watermains, sanitary sewers and street purposes and for Storm sewer and other utilities installation and maintenance and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner Sedivy and Mayor Morrow; those voting No, none. petition & Resolution No. 1362: Intent to Create SID No. 486 for Construction of Water and Sanitary Sewer Mains on Kagy Boulevard: Greek Way to South Seventh Avenue: Commission Resolution No. 1362 COMMISSION RESOLUTION NO. l362 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, DECLARING IT TO BE THE INTENTION OF THE CITY OF BOZEMAN, MONTANA, TO CREATE A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DISTRICT NO. 486 FOR THE PURPOSE OF CONSTRUCTION AND INSTALLATION OF AN EIGHT (8) INCH SANITARY SEWER LATERAL AND A SIX (6) INCH CAST IRON WATERMAIN ON KAGY BOULEVARD, BETWEEN THE CENTERLINE OF GREEK WAY AND A POINT NINE HUNDRED EIGHTY TWO AND FORTY-SEVEN HUNDREDTHS (982.47) FEET WESTERLY THEREOF. In concurrence with 1 the recommendation of the City Manager, it was moved by Commissioner Langohr, seconded by Commiss- ioner Sedivy, that the resolution be passed and adopted and April 3, 1968, be set as the date for public hearing and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner Sedivy and Mayor MOrrow; those voting No, none. Authority to Attend 1968 Fire Command School: Yakima, Washington 8-ll April 1968 - Fire Chief: A Fire Department Officer Command School is scheduled to be conducted at Yakima, Washington, 8-11 April 1968, and in concurrence with the recommendation of the City Manager, and the Fire Chief, it was moved by Commissioner SediVY, seconded by Commissioner Langohr, that Fire Chief Jack Huber be authorized to attend the school and in the event he cannot attend the Ass't. Fire Chief be authorized to attend as an alternate and, it being in the public interest his expenses be paid from the General fund. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Langohr and Mayor Morrow; those voting No, none. Request to Taxi Plant on 19th Ave., College St. & llth Ave. to Fieldhouse, 25-26 March 1968 MSU Flying Bobcats: A letter received from the MSU Flying Bobcats requesting permission to taxi an airplane from South 19tb to the Field House and return on the 25th and 26th of March was presented. 1 The Manager advised the Commission that on the basis of the request as presented he would recommend the approval of bringing the aircraft to the Field House at daybreak on the 25th of March, but would want to insist that the aircraft be taxied out on tbe route requested at day- break on the 27th of March to avod involvement with traffic on the evening of the 26th as requested. It was moved by Commissioner Langobr, seconded by Commissioner Sedivy, that the above request be approved under such conditions as presented by the City Manager and the Chief of Police in the interest of Traffic Safety and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner Sedivy and Mayor Morrow; those voting No, none. Reports for February: The following reports were presented as follows: Cemetery Water Collector Director of Public Service Police Chief Cashier The City Manager commented on the reports and recommended their approval. It was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that the reports be approved and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being Commiss- I ioner Langohr, Commissioner Sedivy and Mayor MOrrow; those voting No, none. Surety Bond: Police Judge - Richard J. Andriola: Oath of Office~ A surety bond in the amount of $2,500.00 .s required by Ordinance No. 875, written by Reliance Insurance Company for Mr. R. J. Andriola, Police Judge for the City of Bozeman and approved as to form by the City Attorney was presented together with Mr. Andriola's oath of office. It was moved by Commissioner Langohr, Seconded by Commissioner Sedivy, that the bond be approved as 165 166 presented and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner Sedivy and Mayor Morrow; those voting No, none.
