HomeMy WebLinkAbout1968-04-03 1 1 I Bozeman, Montana 3 April 1968 The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall Building, Wednesday 3 April 1968, at I:OO o'clock p.m. Present were Mayor Morrow, Commissioner Sedivy, Commissioner Langohr, City Manager Cutting, Ass't City Manager Frys1ie, City Attorney Berg and the Clerk. Commissioner Langohr opened the meeting with a prayer and the following proceedings were had; Minutes of the regular meeting held 27 March 1968 were read and it was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that the minutes be approved as read and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner Sedivy and Mayor MOrrow; those voting No, none. Mrs. W. N. Huffine: Water Rights pertaining to Lyman Creek: Mrs. W. N. Huffine appeared before the Commission to discuss an abstract of Agreement dated April 15, 1909, which permits the use of water from Lyman Creek for one period a year not to ex- ceed fourteen days when there is a surplus of 238 3/20th inches measured at a point approximately ISO' above the existing dam where pipes carry the City's water to its reservoir. Following a discussion, the Commission advised Mrs.Huffine that it was the desire of the City to assist them in their need for water but only under those circumstances that will not in any way jeopardize the City's right of supply. Request Widening of Bozeman's West Main Street - 15th Avenue westward to City Limits: Mr. H. H. Fullerton, Chairman of the Bozeman Chamber of Commerce Roads and Highway Committee, and Mr. Guy Sperry, Manager of the Bozeman Chamber of Commerce appeared to present a letter from the Bozeman Chamber of Commerce requesting the widening of Bozeman's West Main Street, from 15th Avenue westward to the City Limits. In concurrence with the recommendation of the City Manager, it was moved by Commissioner Langohr, seconded by Commissioner Sedivy, that a formal request be directed to the State Highway Department, requesting that this project be programmed as an Urban Primary State Highway Project for construction at the earliest time that fund can be available for that purpose and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner Sedivy and Mayor Morrow; those voting No, none. petition for a surfaced Basketball Court in Langohr Park: A petition signed by some 38 residents and owners of property of the University Addition requesting that the City of Bozeman construct a surfaced basketball court in Langohr Park was presented. Following a thorough discussion, it was moved by Commissioner Langohr, seconded by Commiss- ioner Sedivy, that the petition be referred to the City's Recreation Board for further study and recommendation and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner Sedivy and Mayor MOrrow; those voting No, none. Hearing on Resolution No. 1362: Intent to Create SID No. 486: Sewer and Water Mains on Kagy Blvd., Greek Way - S. 7th: Resolution No. 1364 Creating SID 486: This was the time and place set in Commission Resolution No. 1362 to hear protests to the creation of Special Improvement District No. 486, Affidavit of publication of Notice and the Clerks mailing certificate stating that all property owners had been notified as required by law were presented. The City Manager informed the Commission that as of 5:00 o'clock p.m., 2 April 1968, there were no protests on file and no one appeared to verbally protest the creation of the 173 174 district. The City Manager recommended that the City Attorney be instructed to prepare a resolution creating the district: Commission Resolution No. 1364 entitled: COMMISSION RESOLUTION NO. 1364 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN CREATING A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DISTRICT NO. 486 OF THE CITY OF BOZEMAN FOR THE PURPOSE OF CONSTRU- CTING AND INSTALLING AN EIGHT (8) INCH SANITARY SEWER LATERAL AND A SIX (6) INCH CAST IRON WATERMAIN ON KAGY BOULEVARD BETWEEN THE CEN- TERLINE OF GREEK WAY AND A POINT Na!NE HUNDRED EIGHTY TWO AND FORTY- SEVEN HUNDREDTHS ($982.47) FEET WESTERLY THEREOF, THE CONSTRUCTION AND INSTALLATION OF SAID SANITARY SEWER AND WATERMAIN TO INCLUDE TRENCH EXCAVATION AND BACKFILL, INSTALLATION OF VITRIFIED TILE SEWER AND CAST IRON PIPE, NECESSARY WYES AND TEES, SERVICE STUBS, PIPE BEDDING MAT- ERIAL, NECESSARY MANHOLES AND FIRE HYDRANTS AND OTHER APPURTENANT WORK THERETO. prepared by the City Attorney was presented. In concurrence with the recommendation of the City Manager, it was moved by Commissioner Sedivy,- seconded by Commissioner Larigohr that the resolution be passed and adopted to create Special Improvement District No. 486 and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Comm issioner Langohr and Mayor Morrow; those voting No, none. Hearing Resolution No. 1363: Intent to Create SID No. 487 Paving etc. on South Seventh & Kagy Blvd.: Storm Drain on Grant Street - Resolution No. 1365 Creating SID 487: This was the time and place set in Commission Resolution No. 1363 to hear protests to the creation of Special Improvement District No. 487. Affidavit of publication of Notice and the Clerk's mailing certificate stating that all property owners had been notified as required by law were presented. Commission Resolution No. l365, entitled: COMMISSION RESOLUTION NO. l365 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN CREATING A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DIS- TRICT NO. 487 OF THE CITY OF BOZEMAN FOR THE PURPOSE OF CONSTRUCTING AND INSTALLING AN ASPHALTIC-CONCRETE TYPE PAVEMENT PROJECT TOGETHER WITH INTREGAL CONCRETE CURBS AND GUTTERS AND NECESSARY APPURTENANCES THERETO, ALSO CONSTRUCTION AND RECONSTRUCTION OF NECESSARY DRAINAGE FACILITIES INCLUDING STORM DRAINAGE PIPE, MANHOLES, INLETS AND OTHER NECESSARY APPURTENANCES THERETO, ON SEVENTH AVENUE SOUTH, GRANT STREET TO KAGY BOULEVARD AND ON THE NORTHERLY ONE-HALF OF KAGY BOULE- VARD BETWEEN A POINT 200 FEET WESTERLY OF THE WEST LINE OF SOUTH SEVENTH AVENUE AND A POINT 919 FEET EASTERLY OF SAID WESTERLY Ll:NE. prepared by the City Attorney was presented. In concurrence with the recommendation of the City Manager, it was moved by Commissioner Langohr, seconded by Commissioner Sedivy, that the Resolut- ion be passed and adopted to create Special Improvement District No. 487 and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner Sedivy and Mayor MorroW;; those voting No, none. Ordinance No. 869 - Bozeman Fire Zones: Ordinance No. 869 to be known as "Fire Zone" Ordinance and repealing Ordinance No. 863 of the City of Bozeman was presented, entitled: ORDINANCE NO. 869 AN ORDINANCE CREATING AND ESTABLISHING FIRE ZONES AND PROVIDING FOR REQULATION OF ERECETION OF BUILDINGS AND OTHER STRUCTURES 1 1 I THEREIN AS ESTABLISHED BY THE BOZEMAN" BUILDING CODE" AND RE- PEALING ORDINANCE NUMBER 863 OF THE CITY OF BOZEMAN AND ALL ORDINANCES AND PARTS OF ORDINANCES OF SAID CITY IN CONFLICT HEREWITH BE IT ORDAINED BY THE COMMISSION OF THE CITY OF BOZEMAN. The Building Inspector, Fire Chief and the City Attorney recommended that the Ordinance be passed and adopted. The City Manager concurred in the recommendation and it was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that the Ordinance be passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Langohr and Mayor Morrow; those voting No, none License Bond: New Budd Plumbing & Heating - Plumber: In compliance with Chapter Sixteen of the Bozeman Municipal Code, the continuation certi- ficate of the Plumber's License Bond of New Budd Plumbing and Heating of Bozeman was presented. The City Manager reported the Building Inspector had recommended the continuation of the bond and the City Attorney had approved the certificate as to form. It was moved by Commissioner Langohr, seconded by Commissioner Sedivy, that the bond be approved and accepted and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Commiss- ioner Sedivy and Mayor Morrow; those voting No, none. Reports for March: The following reports were presented: Fire Chief Police Judge I The City Manager commented on the reports and recommended their approval. It was moved by Commissioner Sedivy, seconded by Commissioner Langohr"that the reports be approved and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Langohr and Mayor Morrow; those votint No, none. Claims for March: Claim No's. 12086 thru 12378 inclusive were presented on the various funds as follows: General $29,567.42 Cemetery $ 1,721.25 Street 7,822.21 Band 20.00 Water 12,439.33 Garbage 5,633.37 SDS 6,423.34 Parking Meter 980.58 Library 2,614.20 Police Reserve 1,709.70 Planning Board 70.00 Cemetery Suspense 240.00 Park 4,385.11 PERS 1,230.65 $74,857.16 The City Manager commented on the claims and found them to be true and lawful claims against the City of Bozeman and recommended they be approved and the Director of Finance be directed to issue warrants in payment. After examination of the claims and checking against the Claim regi-- ster, it was moved by Commissioner Langohr, seconded by Commissioner Sedivy, that the claims be approved and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner Sedivy and Mayor Morrow; those voting No, none. Request for Loading Zone - Senior Citizens Center (Darlinton): A verbal request from Mr. H. G. Darlinton member of the Board of Directors of the Bozeman Senior Citizens Center for loading zone consideration for the Bozeman Senior Citizens Center was presen ted . Following a discussion and in concurrence with the recommendation of the Police Chief and the Fire Chief, it was moved by Commissioner Sedivy, seconded by Commissioner Langohr, that the request 175 176 for the establishment of a loading zone marked for the exclusive use of the Senior Citizens in the twelve minute metered stall be denied and that they be informed that they may use the re- stricted stall in front of the Rialto Theatre for unloading and Loading passengers as is done by the patrons of the theatre but that the parking in the theatre zone cannot be permitted the motion was carried by the following Aye and No vote: those voting Aye being Commissioner and the car of the patrons must not be parked nor the driver leave the vehicle so that upon the loading and/or unloading of passengers the vehicle is then moved and parked elsewhere and Sedivy, Commissioner Langohr and Mayor Morrow; those voting No, none. Adjournment: There being no further business to come before the Commission at this time, it was moved by Commissioner Langohr, seconded by Commissioner Sedivy, that the meeting be adjourned and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner Sedivy and Mayor Morrow; those voting No, none.
