The Commission of the City-c:pJ: Bozeman met in regular session in the Commission Room, City Hall
.';
Building, Wednesday, 8 November, f:,967, at 1:00 o'clock p.m. Present were Mayor Sedivy, Commissione
Morrow, Commissioner Langohr, Citf Manager Cutting, Ass't City Manager Fryslie, City Attorney Berg
I and the Clerk.
Mayor Sedivy opened the meeting with a prayer and the following proceedings were had:
Minutes of the regular session held 1 November, 1967, were read and it was moved by Commissioner
Morrow, seconded by Commissioner Langohr, that the minutes be approved as read and the motion was
carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner
Langohr and Mayor Sedivy; those voting No, none.
Canvass of Vote - General Election held 7 November, 1967:

Under the provisions of Section 11-3217, R.C.M. , 1947, and this being the firs t legal day after
the Clerk of the Commission had received the re turns of the Municipal General Election held Tuesday,
7 November, 1967, the Clerk of the City Commission aided by the Ci ty Commission proceeded the canvass of
the said re turns. The results of the canvass were as follows:

It was moved by Commissioner Langohr, seconded by Commissioner Morrow, that the Clerk of the
Commission issue certificates of election to each person elected by a plurality of votes and that
Edmund P. Sedivy and Don M. Langohr, Jr. be declared elected to the office of the City Commission
for a four year tel~ beginning 1 January, 1968. The motion was carried by the following Aye and No
vote: those voting Aye being Commissioner Langohr, Commissioner Morrow and Mayor Sedivy; those
voting No, none. I

Mr. G. A. Hopkins, Mr. J. L. Christensen both of Great Falls and Mr. D. E. Alder of Helena,
Representatives for the Chevron Oil Company appeared before the Commission to request permission
to install a Chevron Sign approximately fifty feet in height for the new Chevron Station now under
construction on North Seventh Avenue.
Mr. Christensen, Division Sales Manager for the company further discussed the changing of the
sign from the original height of foty-feet to the fifty feet now proposed.
After thoroughly discussing the request, the City Manager informed the Commission that he re-
commended that the request be denied on the basis of Chapter 14.16-420 of the Bozeman Municipal Code.
It was moved by Commissioner Morrow, seconded by Commissioner Langohr, that the matter be tabled for
one week to permi t reviewing the s i tua tion and to have an on the site vision of the location before
making a final decision and the motion was carried by the following Aye and No vote: those voting
Aye being Con~issioner Morrow, Commissioner Langohr and Mayor Sedivy; those voting No, none.
Deed an(!J3El'_ol..L.lti~.:_._Right:.of-Way Road Bozeman Creek Reservoir Site - Resolution No. 1351 :

Quit Claim Deed and Commission Resolution No. 1351 conveying a road Right-of-Way around the I
South Water Reservoir to the public forever were presented. Mike Nash, Attorney, appeared before
the Commission to discuss the proposed conveyence with the City Commission and it was noted that
this arrangement was related to the Murray Nash Water Pipe Line, Easement of 26 June, 1967.
Upon advisement of the City Attorney and recommendations of the City Manager, it was moved by
Commissioner Langohr, seconded by Commissioner Morrow, that Resolution No. 1351 be passed and adopted
and the Mayor and the Clerk be authorized to sign for the City and the Mayor and the Clerk be further
directed to execute the Quit Claim Deed on behalf of the City on 8 December, 1967 (thirty days from
8 Novemberl and the motion was carried by the following Aye and No vote: those voting Aye being
Commissioner Langohr, Commissioner Morrow and Mayor Sedivy; those voting No,

The City Manager reported that it would be desirable to purchase a new cash register for the
Water Department in the approximate amount of $600.00. In concurrence with the recommendation of
the City ~nager, it was moved by Commissioner Morrow, seconded by Commissioner Langohr, that the
purchase of the cash register be authorized and the motion was carried by the following Aye and No
vote: those voting Aye being Commissioner Morrow, Commissioner Langohr and Mayor Sedivy; those voting
No, none. I

A request for the Business Professional club with the aid of the Girl's and Boy's Key Clubs
for pennission to have a ''Museum Walk' to earn money for the Museum of the Rockies on 9 December,
1967, was presented. It was moved by Commissioner Langohr, seconded by Commissioner Morrow, that
permission be granted to hold the Fund Drive as outlined on 9 December, 1967, and the motion was
carried by the following Aye and No vote: those voting Aye being Commi.ssioner Langohr, Commissioner
Morrmv and Hayor Sed ivy; those voting No, none.

Mr. Tom Thomas and Mr. Wayne Dean of Thomas, Dean & Hoskins, Inc., Great Falls, consultant
en2ineers under contract to the City of Bozeman appeared before the Commission to present their

preliminary report completed under Sanitary Sewer Study, Project No. P-Mon t. 3296 needed to serve
I specific areas of ne\v growth and development in the immediate vicinity of Bozeman.
The City Manager recommended that this preliminary planning report be approved and tha t Form
HUD-t+lf30, Request for Review and Approval of Planning Documents be accomplished and the Mayor he
authorized and directed to sign fot the City. I t was moved by Commissione r Morrow, se;:'onded by
COITmlissioner Langohr, that the above report be approved by resolution as set forth herein, and
Form HUD-lf430 be sllbmi t ted and that the Mayor be authorized to sign for the City and the motion
\vas carried by the following Aye and No vote: those oting Aye being Commissioner Morrmv, Comm-
iss ioner Lsngohr and Mayor Sedivy; those voting No, none.
RESOLUTION
Hhereas, The City of Bozeman accepted an offer from the United
States Government for an advance for preparation of planning docu-
ments pertaining to a public work described as Sanitary Sewer im-
proveman ts including pipes, manholes, 11 f t s ta tions , treatment
facilities and miscellaneous items necessary for the satisfactory
completion of the project; and
Hhereas, Thomas, Dean & Hoskins, Inc. was engaged to prepare
the planning documents for the aforesaid public work, and said
architect and/or engineer has completed documents and submitted them
for approval; and
Hhereas, the completed planning documents have been carefully
I studied and are considered to comprise adequate planning of the
public work essential to the community and within the financial
ability of the City of Bozeman to construct;
Now, therefore, be it resolved by the City Commission the govern-
ing body of said applicant, that the planning documents submitted hy
Thomas, Dean & Hoskins, InC. as the basis for detailed planning of
the Sewerage System improvements dated October, 1967, and the state-
ments in Form HUD-lf430, Request for Review and Approval of planning
documents, in connection with Department of Housing and Urban Develo~-
ment Project No. P-Mon t. 3296 be and the same are hereby approved;
and that certified copies of this resolution be filed with the Depart-
ment of Housing and Urban Development.

Langohr, Connnissioner Morrow and Mayor Sedivy; those voting No, none.

I Mayor Sedivy issued a proclamation emphasizing Saturday, 11 November, 1967, as "Veterans' Day".
. He urged all citizens to further the cause of patriotism and promote the interests of this natior.
and respect for its flag along with honoring the veterans of the United States and of prayer for those
men who died in its service. The City Manager strongly recommended the approval of the Mayors
proclamation and it was moved by Commissioner Langohr, seconded by Commissioner Morrow, tha t Mayor
Sedivy's proclamation be endorsed and the motion was carried by the follmving Aye and No vote: those
voting Aye Being Commissioner Langohr, Commissioner ~orrow and Mayor Sedivy; those voting No, none.

Mayor Sedivy announced his proclamation of the month of November, 1967. to be "Community
Development Month" and urged all United States Jaycees tomexamine the worth of his organization
and pledge himself to do all within his power to assure his community grows and prospers through
Community Development. It was moved by Commissioner Morrow. seconded by COIDnlissioner Langohr,
that the Mayors proclamation be endorsed as presented and the motion was carried by the following I
Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner Langohr and Mayor Sedivy;
those voting No, none.

A request from the Ross Jensen Chapter of the De-Molays and Rainbow Girls to conduct their
annual house to house march or drive against Muscular Dystrophy was presented. it was moved by
Commissioner Langohr, seconded by COITmlissioner Morrow, that permission be granted to hold the Fund
drive and the motion was carried by the following Aye and No vote: those voting Aye being Comm-
issioner l.angohr, Commissioner Morrow and Mayor Sedivy; those voting No. none.

The City Manager commented on the claims and found them to be true and lawful claims against I
the City of Bozeman and recommended they be approved and the Director of Finance be directed to
issue warrants in payment. After examination of the claims and checking against the Claim Register,
it was moved by Commissioner Morrow, seconded by Commissioner Langohr, that the claims be approved
and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner
Morrow, Commissioner Langohr and Mayor Sedivy; those voting No. none.
