HomeMy WebLinkAbout1967-12-13 125 Bozeman, Montana 13 December, 1967 The Commission of the City of Bozem~n met in regular session in the Commission Room, City Hall Building, Wednesday, 13 December 1967, at 1:00 o'clock p.m. Present were Commissioner Morrow, Comm- issioner Langohr, City Manager Cutting, Ass't City Manager Fryslie, City Attorney Berg and the Clerk. I Commissioner Morrow opened the meeting with a prayer and the following proceedings were had: Minutes of the regular session held 6 December 1967, were read and it was moved by Commissioner Morrow, seconded by Commissioner Langohr, that the minutes be approved as read and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner Langohr and Mayor Sedivy; those voting No, none/ Abseftee of Mayor Sedivy: In concurrence with the recommendation of the City Manager, that the absence of Mayor Sedivy be excused, it was moved by Commissioner Langohr, seconded by Commissioner Morrow, that the absence of Mayor Sedivy be authorized in compliance with Section 11.3245, R.C.M., 1947, and that Commissioner Langohr be designated to act as President Pro Tempore of the Commission and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner Morrow; those voting No, none. Request to Hold Apple Sale from Truck on Main Street: Bozeman Kiwanis Club: A letter received from Richard G. Fish,member of the Board of Directors of the Bozeman Kiwanis Club, requesting permission to conduct its annual Apple Sale on the Main Street of Bozeman on Satur- day, 16 December 1967, between the hours of 9:00 o'clock a.m. and 5:00 o'clock p.m. from a truck I parked at the curb in front of Hartman-Mockel's Men store was presented. In concurrence with the recommendation of the City Manager, it was moved by Commissioner Langohr, seconded by Commissioner Morrow, that the request be granted subject to the approval of the owners of the store in front of which they propose to park the truck and the motion was carried by the following Aye and No vote: Those voting Aye being Commissioner Langohr and Commissioner Morrow; -those voting No, none. Amendment to Contracts for Consulting Engineering Services - Thomas, Dean & Hoskins: (a) Paving & Storm Drains: (b) Water & Sewer Lines etc.,: An amendement to the Agreement made the 29th day of December, 1965, between the City of Bozeman, County of Gallatin and Thomas,'Dean & Hoskins, Inc., Engineers of Great Falls, Montana, as amended to be binding upon the City and upon the Engineers for a period of two (2) years from the 29th day of December for Engineering Services, Sanitary Sewer, Water and Storm Drainage improvements was presented. In concurrence with the City Engineer, The City Manager recommended that the City Enter into an a~endment to the contract so that engineering services can be rendered to the City for the Sanitary Sewer, Water and Storm Drainage Improvements within improvement districts that have been or may be established. It was moved by Commissioner Morrow, seconded by Commissioner Langohr, that the contract amendment as described above be approved and the Mayor and the Clerk of the Commission be authorized I and directed to sign for the City and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow and Commissioner Langohr; those voting No, none It was moved by Commissioner Langohr, seconded by Commissioner Morrow, that the City enter into the amendment to the contract so that engineering services can be rendered to the City for the con- struction of paving within improvement districts that have been or may be established and the Mayor and the Clerk of the Commission be authorized and directed to sign for the City and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr and Commissioner Morrow; those voting No, none. 126 Resolution No. 1352: Intent to Create SID No. 464: Reconstruction of East Main Street: Wallace Ave. Eastward 0.587 miles to junction with proposed interstate Highway Vicinity of Fo~er Vaughn Property: COMMISSION RESOLUTION NO. 1352 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN DECLARING IT TO BE THE INTENTION OF THE CITY OF BOZEMAN, MONTANA, TO CREATE A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DIS" TRICT NO. 464 for the PURPOSE OF THE CONSTRUCTION AND RECONSTRUCTION OF AN ASPHALTIC"CONCRETE PAiEMENT ON MAIN STREET BEGINNING AT THE WEST- I ERLY STREET LINE OF WALLACE AVENUE AND EXTENDING EASTERLY THEREFROM A DISTANCE OF .587 MILES. prepared by the City Attorney as directed by the Commission was presented. In concurrence with the recommendation of the City Manager, it was moved by Commissioner Morrow, seconded by Commissioner Langohr, that the Resolution be passed and adopted and that the 10th of January, 1968, be the date set for public hearing and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow and Commissioner Langohr; those voting No, none. Request use of Club & Area: "Snowmobile Rally": Gallatin Valley Snowmobile Assoc. 20-21 Jan. 1968: A request from the Gallatin Valley Snowmobile Association for Permission to hold a Snowmobile Rally at the Old Country club area and for permission to use the City Club House 20-21 January, 1968, was presented. It was moved by Commissioner Langohr, seconded by Commissioner Morrow, that the Gallatin Valley Snowmobile Association be authorized to use the Old Country Club facilities to hold the Snowmobile Rally 20-21 January and that they be charged $40.00 per day, payable in advance for the use of the Club House and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr and Commissioner Morrow; those voting No, none. Board of Railroad Commissioners - MRC Certificate No. 3029: A letter received from the Board of Railroad Commissioners whereby the Board adopted a policy of granting suspensions of MRC Certificates only on a yearly basis was presented. I Following a thorough discussion, it was moved by Commissioner Morrow, seconded by Commissioner Langohr, that the Board of Railroad Commissioners be requested to continue the present suspension of the Certificate No. 3029 for a period of one year from 1 January 1968, to avoid the cancellation . of the certificate and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner Langohr and Mayor Sedivy; those voting No, none. Reports for November (continued): The following reports were presented: Fluoridation Director of Public Service Building Inspector The City Manager commented on the reports and recommended their approval. It was moved by Commissioner Langohr, seconded by Commissioner Morrow, that the reports be approved and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being Comm- issioner Langohr, Commissioner Morrow and those voting No, none. Claims for November (Continued): Claim No's 11141 thru 11163 inclusive were presented on the various funds as follows: General $3,491.25 Park $ 106.37 S tree t 622.50 Cemetery 81.00 Water 572.05 Garbage 18.79 SDS 139.59 Parking Meter 112.80 I Library 132.65 Bldg. Bond 15.78 $5,292.78 The City Manager commented on the claims and found them to be true and lawful claims against the City of Bozeman and recommended they be approved and the Director of Finance be directed to issue warrants in payment. After examination of the claims and checking against the Claim register :127 it was moved by Commissioner Morrow, seconded by Commissioner Langohr, that the claims be approved and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow and Commissioner Langohr; those voting No, none. Adiournmsnt: I There being no further business to come before the Commission at this time, it was moved by Commissioner Langohr, seconded by Commissioner Morrow, that the meeting be adjourned and the motion was carried by the following Aye and No vote: those Commissioner Morrow; those voting No, being None. .
