The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall
Building, Wednesday, 20 January 1967, at 1:00 o'clock p.m. Present were Mayor Sedivy, Commissioner
Morrow, Commissioner Langohr, City Manager Cutting, Ass' to City Manager Fryslie, Acting City
Attorney O"Connell and the Clerk. I
Mayor Sedivy opened the meeting with a prayer and the following proceedings were had:
Minutes of the regular session held 13 December, 1967, were read and it was moved by Commissioner
Morrow, seconded by Commissioner Langohr, that the minutes be approved as read and the motion was
carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner
Langohr and Mayor Sedivy; those voting No, none.
Examination of Depository Bonds:
In compliance with the provisions of Section 16-2618, R.C.M., 1947, the City Commission pro-
ceeded to examine the Receipts for Depository Bonds and Securities held by the Director of Finance
as Security for City Funds deposited in Bozeman banks. It was moved by Commissioner Langohr, se-
conded by Commissioner Morrow, that the securities be approved and a list thereof be set forth in
full in the minutes of this meeting and the motion was carried by the following Aye and No vote:
those voting Aye being Commissioner Langohr, Commissioner Morrow and Mayor Sedivy; those voting No, none.

Reserve Bank of Minneapolis, and the Marquette National Bank of Minneapolis, for the Depository
Bonds held by the Director of Finanace as security for the deposit of City of Bozeman funds by
the several banks of Bozeman and find them to be as above stated, are hereby accepted and approved.

The City Manager and the Chief of Police stated they were not aware of any incidents in the
operation of the above establishments that would warrant disapproval of the applications. In
concurrence with the recommendation of the City Manager, it was moved by Commissioner Morrow,
seconded by Commissioner Langohr, that the above applications be approved and the Director of
Finance be directed to issue licenses in accordance therewith and the motion was carried by the
I following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner Langohr and
Mayor Sedivy; those voting No, none.

Cashier Disposal Plant Operator
The City Manager commented on the reports and recommended their approval, It was moved by
Commissioner Langohr, seconded by Commissioner Morrow, that the reports be approved and ordered
filed and the motion was carried by the following Aye and No vote: those voting Aye being Comm-
issioner Langohr, Commissioner Morrow and Mayor Sedivy; those voting No, none.
Claim for Engineering Services: Thomas, Dean & Hoskins: Sanitary Sewer Study - $20,000.00
HUD Proiect No. P-Mont.-3296:
The City Manager presented a claim from Thomas, Dean and Hoskins, Inc., for services in conn-
ection with HUD Project No. P-Mont-3296 Sanitary Sewer Study which was approved by the City of Bozeman
and the Department of Housing and Urban Development of Seattle in the amount of $20,000.00 and
payment of these advance planning funds from HUD in this amount has been received. After examination
of the claim, it was moved by Commissioner Morrow, seconded by Commissioner Langohr, that the Claim
I in the amount of $20,000.00 for Sanitary Sewer Study be approved and the Director of Finance be
directed to issue a warrant in payment thereof and the motion was carried by the following Aye and
no Vote: those voting Aye being Commissioner Morrow, Commissioner Langohr and Mayor Sedivy; those
voting No, none.
Annexation - Portion of "Homesites" a Suburb of Bozeman - Durston Road North & East of North 17th
Trac ts 5, 6, 7, 8, 9 & 10 (7 Owners) Mountain Vista Subdivision and that adjoining park of Kirk's 1st:
A discussion was held on annexation of a portion of "Homesites" a suburb of Bozeman containing
nine tracts with seven owners, on that area bounded on the west by North Seventeenth Avenue and lying

between the City Limits and the Durston Road. Several of the property owners had signed waivers
of protest in order to obtain water and sewer services. In concurrence with the recommendationof
the City Manager, it was moved by Commissioner Langohr, seconded by Commissioner Morrow, tha t the
City Attorney be instructed to proceed with the resolution to initiate action on the annexation and
the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, I
Commissioner Morrow and Mayor Sedivy; those voting No, none.
A discussion was also held on the Mountain Vista Subdivision and that adjoining part of Kirk's
First Subdivision not now in the City, and it was moved by Commissioner Morrow , seconded by Comm-
issioner LangohG that the City Attorney be instructed to proceed with the resolution to initiate
action on the annexation of the area including Mountain Vista Subdivision and that adjoining part
of Kirk's first subdivision not now in the City and the motion was carried by the following Aye and
not vote: those voting Aye being Commissioner Morrow, Commissioner Langohr and Mayor Sedivy; those
voting No, none.
Request to narrow Storm Drain Easement: South Tracy Avenue - Gary L. Christie:
A letter received from Gary L. Christie requesting that an easement for Storm drainage line
10 feet in width along the north boundary line of grantors' lands, south of and adjoining the tract
hereinbefore described from the east boundary line of South Tracy Avenue, in the City of Bozeman,
Montana, to the east boundary line of Grantots property be changed from 10 feet to 8 feet was presented.
Following a discussion, it was moved by Commissioner Langohr, seconded by Commissioner Morrow,
that an encroachment of Mr. Christie's proposed residence as shown by plan submitted with his building
permit application extending two feet into the existing utility easement adjacent to the north I
boundary of the subject lot be approved and the motion was carried by the following Aye and No vote:
those voting Aye being Commissioner Langohr, Commissioner Morrow and Mayor Sedivyt those voting no, None.
Adjournmen t:
There being no further business to come before the meeting at this time, it was moved by
Commissioner Morrow, seconded by Commissioner Langohr, that the meeting be adjourned and the motion
was carried by the following Aye and No vote: those voting Aye being Commissioner MorroW, Commiss-
ioner Langohr and Mayor Sedivy; those voting No, none.
