The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall
Building, Wednesday, 27 September, 1967, at 1:00 o'clock p.m. Present were Mayor Sedivy, Commissioner
Morrow, Commissioner 1angohr, City Manager Cutting, Ass't City Manager Fryslie, City Attorney Berg
and the Clerk. I
Commissioner Langohr opened the meeting with a prayer and the following proceedings were had:
Minutes of the regular session held 20 September, 1967, were read and it was moved by Commiss-
ioner Morrow, seconded by Commissioner Langohr, that the minutes be approved as read and the motion
was carried by the following Aye and No vote: those voting Aye being Commissioner Morrcw, Commissioner
Langohr and Mayor Sedivy; those voting No, none.

This was the time and place set for receiving bids for the construction of park developments in
Special Improvement District No. 470. Affidavit of publication of "Notice to Bidders" was presented.
The sealed bids were on file and it was moved by Commissioner Langohr, seconded by Commissioner Morrow,
that the bids be opened and read and the motion was carried by the following Aye and No vote: tho s e
voting Aye being Commissioner Langohr, Commissioner Morrow and Mayor Sedivy; those voting No, none.

The bids were then referred to the City Engineer and the engineers representing consultant
Thomas, Dean and Hoskins, Inc., to check the bids in detail, prepare a tabulation and make recommend~
ations in regard to the lowest and best bids for the construction of the Park development within the
district.

This was the time and place set for receiving bids for the construction project for fencing the
City's South Reservoir site located three miles South of Bozeman. Affidavit of publication of "Notice
to Bidders" was presented. The sealed bids were on file and it was moved by Commissioner Morrow,
seconded by Commiss ioner Langohr, that the bids be opened and the motion was carried by the following
Aye and No vote: those voting Aye being Commissioner MorroW, Commissioner Langohr and Mayor Sedivy;

Proclamation: Law Enforcement Arpreciation:
Mr. Robert Bodin, President of the Bozeman Optimist Club appeared to ask the Mayor to declare the
week of the 16-2l October, 1967, as "Law Enforcement Appreciation Week' and to advise that the Law
Enforcement Appreciation Dinner is to be held on the 18th day of October, in recognition of the ex-
cellent job done by the taw Enforcement Agencies of our Community.
Mayor Sedivy accordingly announced his proclamation of the week of 16-21 October as "Law En-
forcement Appreciation Week" and sincerely urged all citizens of the community to join in honoring
these dedicated men. It was moved by Commissioner Langohr, seconded by Commissioner Morrow, that
the proclamation be endorsed and the motion was carried by the following Aye and No vote: those voting
Aye being Commissioner Langohr, Commissioner Morrow and Mayor Sedivy; those voting No, none.

I This was the time and place set for public hearing on Levying assessment for construction of
Special Improvement District No. 471 in the amount of $10,795.56. Affidavit of publication of Notice
was presented. No one was present to protest and no written protests having been filed, Resolution
No. 1344 was presented for final passage. It was moved by Commissioner Langohr, seconded by Comm-
issioner Morrow, that the resolution be finally passed and adopted and the motion was carried by the
following Aye and No vote: those voting Aye being Commissioner Langohr, :ommissioner Morrow and Mayor

City Recreation Director, A. Glen White, reported on his attendance and that of the Ass't City
Recreation Director, Judy Gleason, at the State-wide Conference on Outdoor Recreation held at the Montana
State University Biological Station, Flathead Lake, 15-16 September. His reports consisted of a
complete resume of the programs and the value derived therefrom. It was moved by Commissioner Langohr,
seconded by Con~issioner Morrow, that the above report be accepted as presented and the motion was
carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner
Morrow and Mayor Sedivy; those voting No, none.

Mayor Edmund P. Sedivy issued a proclamation designating the week of 8-14 October as "Fire
Prevention Week". The Fire Chief reported a breakfast will be served at the Bozeman Fire Hall on
Monday, 9 October, 1967, from 7:00 to 10:00 o'clock A.M. to kick off the Annual Fire Prevention Week
activities and the public is invited. The City Fire Department has scheduled its usual program for I
the entire week. In concurrence with the recommendation of the City Manager, it was moved by Comm-
issioner Morrow, seconded by Commissioner Langohr, that the Mayors proclamation and the program of
the Fire Department be approved and the motion was carried by the following Aye and No vote: those
voting Aye being Commissioner Morrow, Commissioner Langohr and Mayor Sedivy; those voting No, none.

In compliance with chapter 16 of the Bozeman Municipal Code, the certificates to continue the
plumbing and gas fitter bonds of Fullerton Plumbing and Heating, Hamilton, Montana, was presented.
The City Manager stated the Building Inspector had approved the continuation of the bonds and the
certificates were approved as to form by the City Attorney. It was moved by Commissioner tangohr,
seconded by Commissioner Morrow, that the continuation of the aforementioned bonds be approved and
the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr,
Commissioner Morrow and Mayor Sedivy; those voting No, none.
Surety Bond_: Jim W. Smith (Director of Finance) $60,000.00 - Term:
A Surety Bond in the amount of $60,000.00 written by Western Surety Company for James W. Smi th,
Director of Finance, and for a period of one year beginning 2 October, 1967, and ending 2 Oct9ber,
1968, approved as to form by the City Attorney was presented. It was moved by Commissioner Morrow, I
seconded by Commissioner Langohr, that the bond be approved as presented and the motion was carried

The Fire Department has need for 450 linear feet 3" double jacket hose with akron brass couplings
at an approximate cost of $950.00. It was moved by Commissioner Langohr, seconded by Commissioner

Police Chief Cutting appeared before the Commission to report on the law En forcemen t Coo rd i-
I nation Conference held in Billings 14-15 September, 1967. It was moved by Commissioner Morrow,
seconded by Commissioner Langohr, that Police Chief Cutting be commended on the completeness of
his report and the acceptance thereof and the motion was carried by the following Aye and No vote:
those voting Aye being Commissioner Morrow, Commissioner Langohr and Mayor Sedivy; those voting No, none.
Report on MSU Water Meeting 21-25 September, 196 7 - Ralph Dunahoo:
Water Superintendent, Ralph Dunahoo reported on his attendance at the Montana State University
on the use of water which was held on the 21st and 25th day of September. His report consisted of a
complete resume of the meetings and the value derived the re from. It was moved by Commissioner
Langohr, seconded by Commissioner Morrow, that Mr. Dunahoo's report be accepted as presented and that
he be commended for the completeness of the report and the motion was carried by the following Aye and
No vote: those voting Aye being Commissioner Langohr, Commissioner Morrow and Mayor Sedivy; those
voting No, none.
~y thority to a t tend 53rd Annual ICMA Conf~rence: New Orleans 8-13 Oc t. -Ci ty Manager plus leave to 10/27/67:
The City Manager reported the 53rd Annual International City Managers Association Conference is
. scheduled to be held in New Orleans, 8-12 October, 1967, and requested authority to attend and also
I requested two weeks additional leave following the conference, and that Ass't City Manager, Harold A.
Fryslie be designated as Acting City Manager during this period. It was moved by Commissioner Morrow,
seconded by Commissioner Langohr, that the City Manager be authorized to attend the International City
Managers Association Conference and, that it being in the public in teres t. his expense be paid from the
General fund and that he be granted additional leave of absence through the 27th of October and the
motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow,
Commissioner Langohr and Mayor Sedivy; those voting No, none.
Proclamation: National Employ the Physical Handicapped Week 1-7 October 1967:

Mayor Edmund P. Sedivy announced his proclamation of 1~7 October, 1967, as "Employ the Physically
Handicapped Week" and urged all citizens to support such organized program and urged all employers to
consider the handicapped for employment on the basis of their ability, not their disability. It was
moved by Commissioner Langohr, seconded by Commissioner Morrow, that this proclamation be endorsed
and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner
Langohr, Commissioner Morrow and Mayor Sedivy; those voting No, none.
Snow Removal - Ivan Richardson Chevron Station - 711 East Main Street:
Ivan Richardson of the East Main Chevron Station located at 711 East Main Street appeared to com-
I plain about the cost of the removal of snow from in fronTof his place of business for the year 1966-
1967. He explained that the price was out of line with past years and he would like to have some
reconsideration on the price. Mr. Richardson was informed that the above subject billing would be
thoroughly reviewed for correctness and he would be informed of the outcome of that review.
Consideration of Bids for Ch~in Link Fence - _South Rese:r;voir:

The Commission was referred to the opening of bils for the "Chain Link" fencing of the City's

South Reservoir located three miles south of Bozeman.
The bids having been analyzed, the City Manager concurred with the City Engineer, recommending
that the construction of the fence be awarded to the Mountain States Fence Company. Inc., on the
basis of their low bid of $5,897.02, it being the lowest bid and equaling the specifications as con-
tained in the "Call for Bids". In concurrence with the recommendation of the City Manager. it was
moved by Commissioner Morrow, seconded by Commissioner Langohr, that the construction of the Chain I
Link Fence be awarded to the Mountain States Fence Company, Inc. as recommended and the motion was
carried by the following Aye and No vote: those voting Aye being Commissioner Morrow. Commissioner
Langohr and Mayor Sedivy; those voting No. none.
At the request of the Engineers, the consideration of the bids for SID No. 470 and for the
purchase of the Cast Iron Pipe and Fittings was tabled until 4 October, 1967.
