HomeMy WebLinkAboutResolution 4756 Amending Annual Budget and Downtown Tax Increment District Workplan to Add Appropriations for FEMA Floodplain Map Appeal in FY17 CIO COMMISSION RESOLUTION NO. 4756 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,MONTANA,AMENDING THE CITY'S ANNUAL BUDGET AND DOWNTOWN TAX INCREMENT DISTRICT WORKPLAN TO ADD APPROPRIATIONS FOR FEDERAL EMERGENCY MANAGEMENT AGENCY (FEMA) FLOODPLAIN MAP APPEAL PROJECT IN FISCAL YEAR ENDING JUNE 30,2017. WHEREAS,the City Commission did, on the 201h day of June,2016, after due and proper legal notice, conduct a public hearing and adopt a municipal budget for Fiscal Year 2016-2017 (Fiscal Year 2017); and WHEREAS, the need to add the project "Federal Emergency Management Agency (FEMA) Floodplain Map Appeal" to the approved Fiscal Year 2017 work-plan for the Downtown Tax Increment District funding now exists; and WHEREAS, the need to add the project "Federal Emergency Management Agency (FEMA) Floodplain Map Appeal" to the approved Fiscal Year 2017 budget in the amount of $42,000 for the Downtown Tax Increment District fund now exists; and WHEREAS,the City Commission did,on the 28th day of November,2016,after due and proper legal notice, conduct a public hearing on proposed amending the Downtown Tax Increment District work- plan and municipal budget. NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman, Montana, to wit: Section 1 —Appropriation Changes The City Commission of the City of Bozeman, Montana, does hereby authorize the following changes to expenditures in the Downtown Tax Increment Finance Fund: Page 1 of 2 Additions: The project and amount is added to the FYI work-plan and budget. Floodplain Map Appeal—Study and Mapping $42,000 Total Appropriations Changes: $42,000 Section 2—Use of Cash on Hand in the Downtown Tax Increment District Fund The increased appropriation will be funded with cash on hand in the Downtown Tax Increment District Fund. Section 3 Pursuant to Section 7-6-4030, M.C.A., this resolution, upon its passage, shall be in full force and effect on July 1, 2016. Section 4 That should it be found by any court of competent jurisdiction that any section, clause, portion, sentence, word, or phrase of this resolution is deemed to be contrary to any existing law or regulations, that in this instance, it is the intent of the City Commission of the City of Bozeman, Montana, that all other portions, sections,words, clauses,phrases, or paragraphs of this document shall remain in full force and effect. APPROVED AS TO FORM: S LIVAN City A rney Page 2 of 2 NOTICE OF PUBLIC HEARING FOR BUDGET AMENDMENT NOTICE IS HEREBY GIVEN that, pursuant to the provisions of Section 7-6- 4021, Montana Code Annotated, the City Commission of the City of Bozeman, Montana may conduct a public hearing on amending the municipal budget for Fiscal Year 2016-2017, embodied in Commission Resolution No. 4756, at 6:00 pm on Monday, November 28, 2016, at City Hall, 121 N. Rouse Avenue, Bozeman, Montana. THE COMMISSION WILL CONSIDER AMENDING THE CITY'S ANNUAL BUDGET FOR DOWNTOWN TAX INCREMENT DISTRICT APPROPRIATIONS AND THE DISTRICT'S WORK PLAN FOR THE FISCAL YEAR ENDING JUNE 30, 2017. THE INCREASE IN APPROPRIATIONS AND CHANGE TO THE WORKPLAN WILL FUND FLOODPLAIN STUDY AND MAPPING WORK AND WILL BE PAID FOR WITH EXISTING CASH ON HAND IN THE DOWNTOWN TAX INCREMENT DISTRICT FUND. Copies of Commission Resolution No 4756 are on file in the office of the City Clerk, City Hall, 121 N. Rouse Avenue, and may be examined by all interested citizens. Any and all interested persons are invited to attend the public hearing and to submit testimony in support or in opposition to the proposed budget amendment or to submit written testimony prior to or during the public hearing.
