The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall
Building, Wednesday, 18 October, 1967, at 1:00 o'clock p.m. Present were Mayor Sedivy, Commissioner
Morrow, Commissioner Langohr, Acting City Manager Fryslie, City Attorney Berg and the Clerk.
Commissioner Langohr opened the meeting with a prayer and the following proceedings were had: I
Minutes of the regular session held 11 October, 1967, were readn and it was moved by Commission-
er MorroW, seconded by Commissioner Langohr, that the minutes be approved as read and the motion was
carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner
Langohr and Mayor Sedivy; those voting No, none.
Phi llips '66' - Request for Fifty Foot Sign - Postpone Consideration:
The request of Phillips Petroleum Company for permission to erect a fifty foot standing sign at
the Phillips '66' Station located at 1007 East Main Street was again presented and the reques twas
tabled for another week at the request of Mr. C. W. Crosnoe, Construction Engineer for Phillips '66' .
Ordinance No. 8_68 - Building Code - Final Cons~deration:
Ordinance No. 868 provisionally passed and adopted by the CommSsion at its meeting, 20 September,
1967, to include the adoption of the 1967 Uniform Building Code by reference, to be known as the
"Bozeman Municipal Building Code" was presented.

AN ORDINANCE OF THE CITY OF BOZEMAN, MONTANA, REGULATING
THE ERECTION, CONSTRUCTION, ENLARGEMENT, ALTERATION, REPAIR
MOVING, REMOVAL, DEMOLITION, CONVERSION, OCCUPANCY, EQUIP-
MENT, USE, HEIGHT, AREA, AND MAINTENANCE OF ALL BUILDINGS I
AND/OR STRUCTURES IN THE CITY OF BOZEMAN, MONTANA; PROVIDING
FOR THE ISSUANCE OF PERMITS AND COLLECTION OF FEES THEREFOR;
PROVIDING PENALTIES FOR THE VIOLATION THEREOF; REPEALING
ORDINANCE NO. 827 OF THE CITY OF BOZEMAN AND ALL OTHER ORD-
INANCES AND PARTS OF ORDINANCES IN CONFLICT THEREWITH.
Affidavit of publication of Ordinance No. 868 was presented. No written protests having been
filed and there being only one verbal protest the Acting City Manager concurred with the Building
Inspector recommending that Ordinance No. 868 be finally passed and adopted. After a thorough dis-
cussion, it was moved by Commissioner Langohr, seconded by Commissioner Morrow, that Ordinance No.
868 be finally passed and adopted and the motion was carried by the following Aye and No vote: those
voting Aye being Commissioner Langohr, Commissioner Morrow and Mayor Sedivy; those voting No, none.

A letter received from Mr. Donald R. Satterthwaite, District Sales Manager of the Mountain States
Telephone & Telegraph Company, Helena, Montana, requesting permission to place two (2) Public Tele-
phones upon City Property as follows was presented. Harold Powers of the Bozeman office was present
to further discuss the request and make the necessary clarifications for immediate installations at
the following locations.
1) South East Corner of Main Street and South Black Avenue near the First National Bank;
2) North West Corner of Main Street and North Tracy Avenue near the Chamber Fisher Company. I
It was moved by Commissioner Morrow, seconded by Commissioner Langohr, that the request be
granted on a trial basis and the Agreement be executed by the City contingent upon the approval of
the adjacent property owners and that the installation not include overhead wiring and the motion
was carried by the following Aye and No vote: those voting Aye being Commissioner MorroW, Commissioner
Langohr and Mayor Sedivy; those voting No, none.

Cam.l?..-..firc Girls - Blue Bird Nut Sale - 17 November, 1967:
A letter received from Mrs. Gerald D. Robertson, of the Bozeman Council of Camp Fire Girls
requesting permission to conduct a Blue Bird Nut Sale, starting 17 November, 1967, was presented.
It was moved by Commissioner Langohr, seconded by Commissioner Morrow, that the above request be

Commissioner Langohr, Commissioner MOrrow and Mayor Sedivy; those voting No, none.
Red Heart Tag Day - Women of the Moose 28 October, 1967 - Proclamation:
A request from the ladies of the Moose for the Mayor to proclaim October 28th as "Red Heart
Tag Day" and to conduct the Red Heart Tag Sale in the City of Bozeman for the benefit of sick and
crippled children to be used for hospitalization and treatment of children from all sections of
Montana in Shodair Crippled Children's Hospital at Helena, Montana, and for the purchase of new and
modern equipment for the treatment of crippling diseases was presented.
Mayor Sedivy issued the proclamation and in concurrence with the recommendation of the Acting
City Manager, it was moved by Commissioner Morrow, seconded by Commissioner Langohr, tha t the Comm-
ission concur in proclaiming 28 October, 1967 as "Red Heart Tag Day" and that the request for the
Women of the Moose to conduct the Red Heart Tag Sale on October 28th be granted and the motion was
carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner
Langohr and Mayor Sedivy; those voting No, none.
Report of Director of Public Service - September:
The report of the Director of public Service for the month of September was presented. The
I Acting City Manager commented on the report and recommended the approval thereof. I t was moved by
Commissioner Langohr, seconded by Commissioner Morrow, that the report be approved and ordered fi 1 ed
and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner
Langohr, Commissioner Morrow and Mayor Sedivy; those voting No, none.
Authority to Reinvest $50,000.00 Miscellaneous Funds - Certificates of Deposit 180 Days:
The Director of Finance reported there are Miscellaneous Funds in the amount of $50,000.00
available for reinvestment and requested authorization to invest the funds in Certificates of De-
posit for a period of 180 days. It was moved by Commissioner Morrow, seconded by Commissioner
Langohr, that authorization for the reinvestment, as requeste~ be granted and the motion was carried
by the following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner Langohr,
Mayor S.edivy; those voting No, none.
Contract Documents with Change-Order No. 1 for SID No. 470:
The Contract Documents for the construction of Park Developments in Special Improvement District
No. 470, with Change-Order No. 1, as awarded to Haggerty-Messmer Company, Bozeman, Montana, on
4 October, 1967, was presented.
The contract documents with Change-Order No. 1 was approved as to form by the Ci ty Attorney
I and it was moved by Commissioner Langohr, seconded by Commissioner Morrow, that the Mayor and the
Clerk of the City Commission be authorized to sign the contract and change-order for the City of
Bozeman and that Haggerty Messmer Company be authorized and directed to proceed on the constru-
ction of Special Improvement District No. 470 and the motion was carried by the following Aye and
No vote: those voting Aye being Commissioner Langohr, Commissioner Morrow and Mayor Sedivy; those
voting No, none.

There being no further business to come before the Commission at this time, it was moved
by Commissioner Morrow, seconded by Commissioner Langohr, that the meeting be adjourned and the
