HomeMy WebLinkAbout1967-08-09 63 Bozeman, Montana 9 August 1967 The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall Building, Wednesday, 9 August, 1967, at 1:00 o'clock p.m. Present were Mayor Sedivy, Commissioner Morrow, Corinnissioner Langohr, City Manager Cutting; Ass't City Manager Fryslie, City Attorney Berg I and the Clerk. Commissioner Morrow opened the meeting with a prayer and the following proceedings were had: Minutes of the regular session held 2 August, 1967, were read and it was moved by Commissioner Langohr, seconded by Mayor Sedivy, that the minutes be approved as read and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr and Mayor Sedivy; those voting No, none. Authority to Attend "Emergency Care" dJrogram: Livingstone 6-7 September: 2 members of Fire Dept.: A letter received from Fire Chief Jack Huber requesting permission for two men of the Fire Department to attend a two day "Emergency Care" program in Livingston, 6-7 September, 1967 was presen ted. The Commission concurred with the recommendation of the City Manager, and it was moved by Commissioner Morrow, seconded by Commissioner Langohr, that authority for two men of the Fire Department to attend the "Emergency Care" Program be granted, and it being in the public interest, their expenses be paid from the General Fund and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner Langohr and Mayor Sedivy; those voting No, none. Authority to Attend Pacific Northwest Library Association Coeur d'A1ene, Idaho, 24-26 August, 1967, Librarian Margaret Hileman: I A letter received from Margaret Hileman, Librarian, requesting permission to attend the Annual Convention of the Pacific Northwest Library Association, to be held at Coeur d'Alene, Idaho, 24- 26 August, 1967, was presented. The City Manager recommended that Miss Margaret Hileman, City Librarian be authorized to attend the convention and, it being in the public interest, her expenses be paid from the Library Fund. It was moved by Commissioner Langohr, seconded by Commissioner Morrow, that this travel be authorized as recommended and the motion was carried by the followin Aye and No Vote: those voting Aye being Commissioner Langohr, Commissioner Morrow and Mayor Sedivy; those voting No, none. SID No. 469. Storm Drainage & Pavement: Change Order No. 3: Miscl. Extra Work - $271.30 (Long Construction); Change Order No.4: Syphon Drain - $408.00 (Diteman): The Change-Order of Sid No. 469 prepared by Thomas, Dean & Hoskins, Inc., to become a part of the original contract for construction of improve~ents in the project described was presented as follows: Change-Order No. 3 1. Remove and replace l75 square feet of sidewalk. 2. Build 40 linear feet of asphalt curb at the North end of l6th Avenue. 3. Place 8 linear feet of 18" R. C. Pipe in Walton's irrigation ditch at 15th Avenue and Durston Road. I Increase Contract Cost $271. 30 Change-Order No. 4 A. Install 4" Cast Iron Pipe drain line with 4" gate valve and valve box to connect irrigation syphon to storm drain at l5th avenue North and Beall Street. Increase Contract Cost $408.00 The City Manager concurred with the Engineer and recommended the above Change-Orde~ be accepted. It was moved by Commissioner Morrow, seconded by Commissioner Langohr, that the Change-orders be approved and that the Mayor and the Clerk of the City Commission be authorized to sign for the City and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner 64 Morrow, Commissioner Langohr and Mayor Sedivy; those voting No, none. Lease of Mackleberg Building - 109 North Rouse Avenue - Water Depart~ent: A lease Agreement between A. R. Mackleberg, Bozeman, Montana, and the City of Bozeman for the pu~pose of providing an additional building located at 109 North Rouse Avenue for the Water De- partment was presented. The Lease Agreement is for a period of five years commencing on the first day of July, 1967, and ending on the 30th day of June, 1972. The rental of which is $275.00 per I month together with any increase in taxes over the amount assessed against said premises for the year 1967 during the term thereof and is payable on or before the 10th of each month. In concurrence with the recommendation of the City Manager, it was moved by Commissioner Langohr, seconded by Commissioner Morrow, that the Lease Agrement be approved and the Mayor and the Clerk of the Commission be authorized and directed to sign for the City and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner Morrow and Mayor Sedivy; those voting No, nom. Proclamation: "Willing Water Week": Mayor Sedivy announced his proclamation of 13-l9 August, 1967, as "Willing Water Week" and sincerely urged all citizens of Bozeman to join in developing a wider understanding of the contri- butions, the services, and the future needs of the Bozeman City Water Works. It was moved by Commissioner Morrow, seconded by Commissioner Langohr, that this proclamation of the Mayor be endorsed and the motion was carried by the following Aye and No vote: those voting Aye were Commissioner MOrrow, Commissioner Langohr and Mayor Sedivy; those voting No, none. Commission Resolution No. 1333 - Special Levy for St. Lighting Districts - Provisional Passage: I Commission Resolution No. 1333 levying assessment in the total amount of $l7,560.l5 for the various lighting districts for the year 1967, was presented, entitled: COMMISSION';:RESOLUTION NO. 1333 A. RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTlNA, LEVYING AND ASSESSING LIGHTING DISTRICT MAINTENANCE AND ELECTRICAL CURRENT COSTS FOR SPECIAL IMPROVEMENT LIGHTING DISTRICTS OF THE CITY OF BOZEMAN, ~URSUANT TO THE PROVISIONS OF SECTION 11-2252, R. C. M., 1947. It was moved by Commissioner Langohr, seconded by Commissioner MorroW, that the resolution be provisionally passed and adopted and Wednesday, l6 August, 1967, be set as the date for public hearing and the motion was carried by the following Aye and No vote: those voting Aye being Comm- issioner Langohr, Commissioner Morrow and Mayor Sedivy; those voting No, none. Commission Resolution No. 1334 - Levying 1967 Sprinkling Assessment - Provisional Passage: Resolution No. 1334 levying the assessment in the total amount of $7,014.24 for street sprinkling and cleaning for the year 1967 was presented, entitled: COMMISSION RESOLUTION NO. 1334 A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN LEVYING AND ASSESSING A SPECIAL ASSESSMENT OF TAXES UPON ALL THE PROPERTY IN STREET SPRINKLING DISTRICTS OF THE CITY OF BOZEMAN, COUNTY OF GALLATIN, STATE OF MONTANA, TO DEFRAY THE SEVENTY-FIVE PERCENT OF THE COST OF SPRINKLING STREETS WITHIN I SAID STREET SPRINKLING DISTRICTS OF THE CITY OF BOZEMAN FOR THE YEAR 1967. It was moved by Commissioner Langohr, seconded by Commissioner Morrow, that the resolution be provisionally passed and adopted and Wednesday, l6 August, 1967, be set as the date for public hearing and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner Morrow and Mayor Sedivy; those voting No, none. 65 Electrical Code - Mr. Con Mannix: Mr. Con Mannix appeared before the Commission to request that the City of Bozeman adopt a resolution similiar to one adopted by the Billings City Council incorporating an agreement with the State Electrical Board to avoid double electrical inspection and double fees for electrical inspection in the cities of Montana. The Commission thanked Mr. Mannix for bringing this pro- I posal to the attention of the Commission and it was moved by Commissioner Langohr, seconded by Commissioner Morrow, that the matter be taken under advisement and further study and brought back to the Commission for consideration at a later date and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner Morrow and Mayor Sedivy; those voting No, none. Reports for July, 1967: The following reports were presented: Disposal Plant Operator Fire Chief Librarian Police Chief Water Collector Po lice Judge Cemetery Cashier Bldg. Inspector The City Manager commented on the reports and recommended their approval. I t was moved by Commissioner Morrow, seconded by Commissioner Langohr, that the reports be approved and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being Commiss- ioner Morrow, Commissioner Langohr and Mayor Sedivy; those voting No, none. Claims for July, 1967 - Continued: Claim No's. 9777 thru 9818 inclusive were presented on the various funds as follows: I Gene ra 1 $ 3,370.81 Cemetery $ 122.36 Street 811. 94 Band 17.88 Water 1,501.97 Garbage 195.71 S.D.S. 105.76 Parking Meter 173.94 Library 63.24 SID's. 1,973.36 Park 337.60 Total $8,674.57 The City Manager commented on the claims and found them to be true and lawful claims against the City of Bozeman and recommended that they be approved and the Director of Finance be directed to issue warrants in payment. After examination of the claims and checking against the claim re- gis ter, it was moved by Commissioner Langohr, seconded by Commissioner Morrow, tha t the c la ims be approved and the motion was carried by the following Aye and No vote: those voting Aye being Comm- Langohr, Commissioner Morrow and Mayor Sedivy; those voting No, none. Report of 44th Annual Congress of Cities: Commissioner R. Harry Morrow: Commissioner Morrow reported on his attendance at the 44th Annual Congress of Cities held in Boston, Massachussetts, 29 July to 2 August, 1967. Commissioner Morrow attended this meeting as a representative of the City of Bozeman and also as President of the Municipal League. Mayor Sedivy extended the appreciation of the Commission on the completeness of his report. I t was moved by I Mayor Sedivy, seconded by Commissioner Langohr, that Commissioner Morrow be commended for representing the City of Bozeman in this capacity and for his complete report and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr and Mayor Sedivy; those voting No, none.
