HomeMy WebLinkAbout1967-08-23 69 Bozeman, Montana 23 August, U67 The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall Building, Wednesday, 23 August, 1967, at 1:00 o'clock p.m. Present were Commissioner Morrow, Commissioner Langohr, City Manager Cutting, Ass't. City Manager Frysl1e, Acting City Attorney Angel and the I Clerk. Commissioner Morrow opened the meeting with a prayer and the following proceedings were had: Minutes of the regular session held 16 August, 1967, were read and it was moved by Commiss- ioner Langohr, seconded by Commissioner Morrow, that the minutes be approved as read and the motion was carried by the following Aye and No vote: tho~voting Aye being Commissioner Langohr, Comm- issioner Morrow and ~; those voting No, none. Absence of Mayor Sedivy: In concurrence with the recommendation of the City Manager, it was moved by Commissiner Morrow, seconded by Commissioner Langohr, that the absence of Mayor Sedivy, be authorized in com- pliance with Section 11-3245, R.C.M., 1947, and that Commissioner Morrow be designated to act as President Pro Tempor of the Commission and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner Langohr and ~; those voting No, none. Open Bids on SIn No. 482 - Paving One Block on South Fourth Avenue: This was the time and place set for receiving bids for construction of street pavement to be constructed in Special Improvement District No. 482. Affidavit of publication of "Notice to Bidders" I was presen ted . One sealed bid on this project was on file and it was moved by Commissioner Lang- ohr, seconded by Commissioner Morrow, that the bid be opened and the motion was carried by the foll- owing Aye and No vote: those .voting Aye being Commissioner Langohr, Commissioner Morrow and ~ I. ~; those voting No, none. The following bid was then opened: Long Construction Company - Billings, Montana = $8,784.50 The bid was then referred to the City Engineer and the engineers representing consultant Thomas, Dean & Hoskins, Inc., to check the bid in detail, prepare a tabulation and make recommend- ations in regard to the bid for construction of the improvement within the district. Open Bids on SIn No. 483 - Sanitary Sewer: South of Babcock - East from South 15th Avenue: This was the time and place set for receiving bids for construction of sanitary sewer im- provements within Special Improvement District No. 483. Affidavit of publication of Notice to Bidders was presented. Two sealed bids were on file and it was moved by Commissioner Langohr, seconded by Commissioner Morrow, that the bids be opened and the motion was carried by the follow- ing Aye and No vote: those voting Aye being COIllllissioner Langohr, COIllllissioner Morrow and :thpse voting, No, none. I The following bids were then opened: Wallace Diteman, Inc., - Bozeman, Montana $13, 179 . 50 Long Construction Co., - Billings, Montana 11,270.00 The bids were then referred to the City Engineer and the engineers representing consultant Thomas, Dean & Hoskins, Inc., to check the bids in detail, prepare tabulation and make recommendat- ions in regard to the lowest and best bid(8) for the construction of the improvements within the district. 70 Hearing Resolution No. 1335 - Authorizing 1967 Garbage Assessment for final Passage: This was the time and place set for hearing on levying assessments for the collection and disposal of garbage for the year 1967 in the amount of $75,582.55. Affidavit of publication of Notice was presented. No one was present to protest and no written protests having been filed, Resolution No. 1335 was presented for final passage. It was moved byCommissioner Morrow, seconded by Commissioner Langohr, that the resolution be finally passed and adopted and the motion was carried. Consideration of Tractor Bid - City Land Fill Disposal Site - Dump: The-Commission was referred to the opening of bids for the large crawler type tractor for the City Land Fill Disposal Site. The bid of the Tractor & Equipment Company, Billings, Montana, in the amount of $26,000.00 being the only bid, the City Manager concurred with the recommendation of the City Engineer, that the purchase of the tractor be awarded to the Tractor and Equipment Company on the bais of that bid. It was moved by Commissioner Langohr, seconded by Commissioner Morrow, that the purchase of the large crawler type tractor be awarded as recommended and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr and Commiss- I ioner MorroW; those voting No, none. Resolution No. 1336 - Special Levy for Snow Removal (Sidewalks): Resolution No. 1336 levying the assessment in the total amount of $566.62 for snow removal for the year 1966-67 was presented, entitled: COMMISSION RESOLUTION NO. 1336 A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN LEVYING AND ASSESSING A SPECIAL ASSESSMENT OF TAXES UPON CERTAIN PROPERTIES IN I THE CITY OF BOZEMAN, COUNTY OF GALLATIN, STATE OF MONTANA, TO DE FRAY THE COST OF REMOVAL OF SNOW FOR THE YEAR 1966-1967 PURSUANT TO PROVISIONS OF ORDINANCE NO. 502 ENTITLED: " AN ORDINANCE PRO~ VIDING FOR THE REMOVAL OF SNOW AND ICE FROM THE SIDEWALKS IN THE CITY OF BOZEMAN AND REPEALING ORDINANCE NO. 385, ENTITLED: 'AN ORDINANCE PROVIDING FOR THE REMOVAL OF SNOW AND ICE, DIRT, FILTH AND OTHER OBSTRUCTION FROM SIDEWALKS ON MAIN STREET BETWEEN WALLACE AVENUE AND FOURTH AVENUE IN THE CITY OF BOZEMAN' " It was moved by Commissioner Langohr, seconded by Commissioner MorroW, that the resolution be provisionally passed and adopted and 30 August, 1967, be set as the date for public hearing and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr and Commissioner MorroW; those voting No, none. Resolution No. 1337 - Special Levy for Noxious Weed Assessment (1967) Resolution No. 1337 levying the assessment in the total amount of $1,480.00 for the exter- mination and removal of Roxious weeds for the year 1967, was presented, entitled: A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN LEVYING AND ASSESSING A SPECIAL ASSESSMENT OF TAXES UPON CERTAIN PROPERTIES IN THE CITY OF BOZEMAN, COUNTY OF GALLATIN, STATE OF MONTANA, TO DEFRAY THE COST OF EXTERMINATION AND REMOVAL OF NmXIOUS WEEDS FOR THE YEAR 1967, PURSUANT TO THE PROVIS IONS OF CHAPTER 6.50 OF THE BOZEMAN MUNICIPAL CODE. It was moved by Commissioner MOrrow, seconded by Commissioner Langohr, that the resolution be provisionally passed and adopted and 30 August, 1967, be set as the date for public hearing I and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow and Commissioner Langohr; those voting No, none. Highway Department Right of way Taking: Lindley Park, Offer $8,455.00: A Right~of-Way Agreement for the City to sell to the State Highway Department a tract of land in the SEt NE~ of Section 7, Township 2 South, Range 6 East, M.P.M., Gallatin County, Montana, con- 71 taining 483 square feet in consideration of payment of the sum of $8,455.00 as land value and damages and a Bargain and Sale Deed conveying that property to the State for the proposed East Main Street project was presented. The City Manager reported that the Chairman of the Park Re- creation Board, following an informal poll of Board members, had recommended acceptance of this Highway Department proposition, and following a review of the documents by the Acting City Attorney, I recommended that the City enter in the Agreement and convey the property as requested. I twas moved by Commissioner Morrow, seconded by Commissioner Langohr, that the subject Agreement be entered into by the City, and the Mayor and the Clerk of the City Commission be directed and authorized to sign the Agreement and the Bargain and Sale Deed conveying the property for the City and the motion was carried by the following Aye and No vote; those voting Aye being Comm- issioner Morrow,~ Commissioner Langohr; those voting No, none. Consideration of Construction Bids SID No. 482: - Paving One Block on South Fourth Avenue: The City Engineer and the engineers representing consultant Thomas, Dean & Hoskins, Inc., having completed their study of the bid submitted for pavement improvements within District No. 482, and having prepared a tabulation of the bid, recommended that Long Construction Company of Billings, Montana, be awarded the contract of paving one block on South Fourth Avenue on the basis of its bid being $8,784.50. The City Manager concurred in the recommendation of the engineers and it was moved by Commissioner Langohr, seconded by Commissioner Morrow, that the contract be awarded to Long Construction Company on the basis of its bid,: as noted above, contingent upon the success- ful sale of the bonds of Special Improvement District No. 482, which sale is scheduled for 30 I Augus t, 1967, and the motion was carriedby the following Aye and No vote: those voting Aye being Commissioner Langohr and Commissioner Morrow; those voting No, none. Comsideration of Construction Bids SID No. 483 - Sanitary Sewer South of Baboock: The City Engineer and the engineers representing consultant Thomas, Dean & Hoskins, Inc., having completed their study of the bids submitted for sanitary sewer improvements within Special Improvement District No. 483, and having prepared a final tabulation of the bids recommended that Long Construction Company of Billings, Montana, be awarded the contract for construction of SID No. 483 on the basis of its bid in the amount of $11,270.00 being the lowest and best bid submitted. The City Manager concurred in the recommendation of the engineers and it was moved by Commissioner Morrow, seconded by Commissioner Langohr, that the contract be awarded to Long Construction Company on the basis of its bid as noted above, contingent upon the successful sale of the bonds of Special Improvement District No. 483 which .ale is scheduled for 30 August, 1967, and that the bid security .. of the unsuccessful bidder be returned and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow and Commissioner Langohr; those voting No, none. Claim: Partial Payment 1967 Walks and Curbs: w. D. Howells, $2,133.68: The City Manager presented a claim from Mr. W. D. Howells for partial payment in the amount of I $2,133.68 for construction of Walks and Curbs. Following discussion, it was moved by Commissioner Langohr, seconded by Commissioner Morrow, that the claim for partial payment for construction of Walks and Curbs was presented. After eamanination of the claim, it was moved by Commissioner Langohr, seconded by Commissioner Morrow, that the claim for partial payment of the construction of Walks and Curbs be approved and the Director of Finance issue Walks and Curbs Warrants in payment thereof and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr and Commissioner Morrow; those voting No, none. 72 Reports for July - Director of Public Service, Director of Finance: The following reports were presented: Director of Public Service Director of Finance The City Manager commented on the reports and recommended their approval. It was moved by Commissioner MOrrow, seconded by Commissioner Langohr, that the reports be approved and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being Comm-- I issioner Langohr and Commissioner Morrow; those voting No, none. Primary Election not to be held - 29 August, 1967: 11-3215 R.C.M., 1947: It was reported that only three nominating petitions had been filed for the office of City Commissioner. It was moved by Commissioner Langohr, seconded by Commissioner MorroW, that in comp- liance with Chapter 11-3215, paragraph (5) of R.C.M., 1947, since the number of legally qualified candidates for the office of Commissioner for such primary election does not exceed twice the num- ber of vacancies in the Commission to be filled, no Municipal Primary Election shall be held for the year 1967, and the three qualified candidates, Edmund P. Sedivy, Don M. Langohr, Jr., and John S. Holland shall be deemed duly nominated and shall be placed on the general ballot. Request to Hold Dance - Girls Key Club - West End Laundromat"" 30 August, 1967: A letter received from Cheryl Gates, President of the Girls Key Club, requesting permission to hold a dance at the West End Laundromat across from the High School on 30 August, 1967, from 9:00 o'clock to 12:90 o'clock p.m. was presented. In concurrence with the recommendation of the City I Manager, it was moved by Commissioner Morrow, seconded by Commissioner Langohr, that permission to hold the dance be granted, provided that the sound of the music be held to a level that will not provoke the concerted protests from the adjoining residential area and the motion was carried by the following Aye and No vote; those voting Aye being Commissioner Morrow and Commissioner Langohr; those voting No, none. Authority to invest Funds in U.S. Treasury Bonds: The Director of Finance reported there are Police Reserve Funds in the amount of $4,000.00 and Cemetery Permanent Care Funds in the amount of $5,000.00 available for reinvestment and requested authorization to invest the funds in U. S. Treasury Bonds. In oncurrence with the recommendation of the City Manager, it was moved by Commissioner Langohr, seconded by Commissioner Morrow, that authorization for the investment, as requested, be granted and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr and Commissioner MorroW; those voting No, none. Amend Policy in regard to Curb Openings from 35 feet to 40 feet: It was moved by Commissioner Morrow, seconded by Commissioner Langohr, that the width of the curb openings be amended to permit a maximum opening of forty feet rather than thirty-five feet to I conform to new Highway Standards adopted in 1966 and that any requests for openings in excess of this maximum will be presented to the Commission for consideration and the motion was carried by the fo llowing Aye and No vo te : those voting Aye being Commissioner Morrow and Commissioner Langohr, those voting, No, none.
