Bozeman, Montana 30 August, 1967 The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall Building, Wednesday, 30 Augus t , 1967, at 1:00 o'clock p.m. Present were Mayor Sedivy, Comm- issioner Morrow, Commissioner tangohr, City Manager Cutting, Ass't City Manager Frywlie, City I Attorney Berg and the Clerk. Mayor Sedivy opened the meeting with a prayer and the following proceedings were had: Minutes of the regular session held 23 August, 1967, were read and it was moved by Commissioner Morrow, seconded by Commissioner Langohr, that the minutes be approved as corrected and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Comm- issioner Langohr and Mayor Sedivy; those voting No, none. Sale of Bonds: Special Improvement District No. 482 - Paving One Block on South Fourth Ave. - $11,000.: No. 483 - Sanitary Sewer South of Babcock - $16,500.: This was the time and place set for the sale of the bonds of Special Improvement District No's. 482 and 483. Affidavit of publication of the separate notices of the sale of the bonds of each district was presented. The Mayor and the City Manager outlined the proceedure for conducting this bond sale and stated that the amount of bonds to be sold for each district would be in accordance with the low con- struction bids received as follows: SID No's. Advertised Amount AmoQnt to be sold 482 $11 , 000 .00 $11 , 000 . 00 483 16,500.00 16,500.00 I Mayor Sedivy then announced the City was ready to conduct oral bidding on the bonds of Special Improvement District No. 482 in the amount of $11,000.00. The following Bidders qualified by depositing with the Clerk of the City Commission the nec- essary bid security: Bidder Repre sen ting Mrs. Jean Roby First National Bank - Bozeman, Mr. J. D. Street Security Bank & Trust Company - Bozeman, The lowest effective interest rate accruing to the City of Bozeman offered as oral bids were as fo 110ws : Bidder Interest Rate Security Bank & Trust Company 4.4% First National Bank 4.3% Following the recommendation of the Director of Finance, concurred in by the City Manager, it was moved by Commissioner Morrow, Seconded by Commissioner Langohr, that the bid of the First Nat- ional Bank, Bozeman, Montana, being the lowest and best bid submitted, the sale of the bonds be awarded to the First National Bank of Bozeman, Montana and the bid security of the unsuccesful bidder be returned and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner Langohr and Mayor Sedivy; those voting No, none. I Mayor Sedivy announced the City was ready to conduct oral bidding on the Bonds of Special Improvement District No. 483 in the amount of $16,500.00. The following Bidders qualified by depositing with the Clerk of the Commission the necessary bid securi ty Bidde r Representing Mrs. Jean Roby First National Bank - Bozeman Mr. J. D. Hearing Resolution No. 1336 Special Levy for Snow Removal - for Final Passage: This was the time and place set for hearing on levying assessment for the removal of snow and ice from sidewalks for the year 1966-1967, in the amount of $566.62. Affidavit of publication of Notice was presented. No one was present and no written protests having been filed, Resolution No. 1336, as presented and provisionally passed at the meeting of August 23, 1967, was presented for final passage. It was moved by Commissioner Morrow, seconded by Commissioner Langohr, tha t the resolution be finally passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner Langohr and Mayor Sedivy; those voting No, none. Hearing Resolution No. 1337 Special Levy for Weed Removal - for Final Passage: I This was the time and place set for hearing on Levying assessment for the extermination and removal of noxious weeds for the year 1967, in the amount of $1,480.00. Affidavit of publication of Notice was presented. No one was present to protest and no written protests haveing been filed Resolution No. 1337, as presented and provisionally passed at the meeting of 23 August, 1967, wes presented for final passage. It was moved by Commissioner Langohr, seconded by Commissioner Morrow, that the resolution be finally passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner Morrow and Mayor Sedivy; \ those voting No, none. Contract Document for Execution: SID No. 482, paving, SID No. 483, Sanitary Sewer: The contract documents for the construction of street pavement and sanitary sewer improvements in Special Improvement District No's. 482 and .83 as awarded to Long Construction Company, Billings, Man tana, on 23 Augus t , 1967, was presented. The contract bonds were approved as to form by the City Attorney, and it was moved by Commissioner MorroW, seconded by Commissioner Langohr, that the Mayor and the Clerk of the Commissioner be autho- rized to sign the contracts for the City of Bozeman, and that the Long Construction Company be autho-- rized to proceed on the construction of the street pavement and sanitary sewer improvements in I Special Improvement District No's. 482 and 483 and the pledge for bid security be returned to Long Construction Company and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner Langohr and Mayor Sedivy; those voting No, none. ---- 75 Financeing documents for Dump Tractor Purchase: Note & Sales Contract: Based upon the bid of the Tractor and Equipment Company, Billings, Montana, in the amount of $26,000.00 received on 16 August, 1967, on a Caterpillar Model No. 977 "Traxcavator" and upon action taken by the City Commission on the 23rd day of August, 1967, in accepting this bid, it was desirable I to finance the unpaid balance of $26,000.00 plus the finance charge at the rate of four percent in- terest per annum or a total of $27,239.33 to be made to the First National Bank in three annual pay- ments as follows: $9,079.78 on November, 1967 9,079.78 on November, 1968 9,079.77 on November, 1969 The subject documents having been reviewed by the City Attorney and in concurrence with the recommendation of the City Manager, it was moved by Commissioner Morrow, seconded by Commissioner Langohr, that this proposed conditional Sales Contract be approved and the Mayor and the Clerk of the Commission be authorized and directed to sign the subject note and the Sales Contract Agree- ment for the Model No. 977 "Traxcavator" for the City and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner Langohr and Mayor Sedivy; those voting No, none. :\uthorization to Attend Hontana Municipal League - 36th Annual Convention East Glacier, 31 Augus t - 2 September, 1967: City Conroission & City Manager: The Montana Municipal League has scheduled its 36th Annual Convention to be held at East Glacier Montana 31 August - 2 September, 1967. and the City Manager recommended that members of the City I Commission and the City Manager be authorized to attend the Convention and that Harold A. Fryslie, Ass't City Manager. be designated to perform the duties of the City Manager during this period. It was moved by Commissioner Langohr, seconded by Commissioner Morrow, that the authorization for Mayor Sedivy, Commissioner Morrow (President of the Montana Municipal League). Commissioner Langohr and City Manager Cutting to attend the meeting be grated and, it being in the public interest, the expenses incurred be paid from the General fund and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr. Commissioner Morrow and Mayor Sedivy; those voting No. none. ~xamination of Depository Bonds: In compliance with the provisions of Section 16-2618, R.C.M. 1947, the City Commission proceeded to examine the receipts for Depository Bonds and Securities held by the Director of Finance as Sec- urity for City funds deposited in Bozeman banks. It was moved by Commissioner Morrow, seconded by Commissioner Langohr, that the securities be approved and a list thereof be set forth in full in the minutes of the meetin' . The motion was carried by the following Aye and No vote, those voting Aye being Commissioner Morrow, Commissioner Langohr and Mayor Sedivy; those voting No, none. Library Assoc.~ City Librarian, Margaret Hileman gave a report on her attendance at the Annual Convention of the Pacific Northwest Library Association held at Coeur d'Alene, Idaho, 24-26 August, 1967. I twas moved by Commissioner Langohr, seconded by Commissioner Morrow, that Miss Hileman be commended on being designated as Chairman of the Pacific Northwest Library Association for the years 1967-1969, and that her report of the convention be approved and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner Morrow and Mayor Sedivy; those voting No, none. Request for off-street Parking Development: Rambler Mote 1: A diagram of proposed off-street parking development at the Rambler Motel and Topper Restaurant, including a portion of the area of the presently dedicated frontage road bordering on North Seventh Avenue, was presented on behalf of that firm, for consideration. Upon examination of the plans and I discussion of the request and upon recommendation of the City Manager, it was moved by Commissioner Morrow, seconded by Commissioner Langohr, that the proposal be approved contingent upon the following conditions and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner Langohr and Mayor Sedivy; those voting No, none. 77 l. That a "Use permit" agreement be entered into permitting use for parking purposes of the portion of the dedicated frontage involved; 2. That the barrier blocks in parking stalls numbered -30" to "57" inclus- ive be set in a manner to provide an on-pavement walk~way in front of the stalls; and 3. That the property owner maintain in a manner satisfactory to the City the 12 ft. grass strip between the proposed paving and the Seventh Ave- I nue curb. School District No. 7 - Traffic Safety Commission: A letter received from Dr. Robert Brockway, Chairman of the School Traffic Safety Committee, setting forth recommendations for School Traffic Safety on West Main Street and North Eleventh Avenue was presented as follows: Commis s ione rs City of Bozeman Bozeman, Mon tana Ref: School Traffic Safety Recommendations Gen t lemen : The School Traffic Safety Committee has finalized recommendations for re- lieving the congestion on West Main and North Eleventh involving school busses, student vehicles, and student pedestrians. Most of the recommendations involve student control, however, one major recommendation involves a city ordinance. After a thorough study of the area during the past year, the committee members feel that a "noleft turn" regulation off North Eleventh and the High School parking lots would relieve a great deal of the tie-up in traffic during the hours when students are going to and from school. This regulation would also discourage traffic from using that area when not necessary. We also recommend no parking signs during the hours of 7:30 a.m. to 4:30 p.m. weekdays on the north side of West Main between North Eleventh and I Fifteen th. It has been observed that trucks and other large vehicles pose a traffic hazzard. We urge your adoption of the recommendations. TheCommittee members appreciate the interest and assistance of Police Chief Ron Cutting. Together, we feel the City arid School District can achieve the aims of the School Traffic Safety Committee. Respectfully submitted, School Traffic Safety Committee Following a thorough discussion of the recommendation set forth and in concurrence with re- of commendations of theChief/police and the City Manager, it was moved by Commissioner Langohr, seconded by Commissioner Morrow, that left turning into Main Street by the traffic from North Eleventh Avenue, on the west end of the Senior High School "oval" and from the parking lot west of the Senior High School be prohibited and that the request that parking be prohibited during the hours of 7:30 a.m. to 4:30 p.m. weekdays on the North side of West Main Street between North Eeventh and North fifteenth Aveunue be tabled for further study by the City and the motion was carried by the following Aye and ... no vote: those voting Aye being Commissioner Langohr, Commissioner Morrow and Mayor Sedivy; those -- voting No, none.
