The Commission of the City of Bozeman met in regular session in the Commission Room, City
Hall Building, Wednesday, 19 July, 1967, at 1:00 o'clock p.m. Present were Mayor Sedivy, Comm-
issioner MorroW, Commissioner Langohr, City Manager Cutting, Ass't City Manager Fryslie, Ac ting
I City Attorney Angel and the Clerk.
Commissioner Langohr opened the meeting with a prayer and the following proceedings were had:
Minutes of the regu1at meeting held 12 July, 1967, were read and it was moved by Commissioner
Morrow, seconded by Commissioner Langohr, that the minutes be approved as read and the motion was
carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner
Langohr and Mayor Sedivy; those voting No, none.

A letter received from Carl l.ehrkind, Jr., of the Bozeman Coca Cola Bottling Company, reques ting
permission to park their "Vlinkmobile" sampling truck, ",hich is conducting a National Flavor Poll in the
City of Bozeman, in a parking stall in front of Owenhouse Hard'o1are Company, Friday, ?l July, 1967,
was presented. It was moved by Commissioner Langohr, seconded by Commissioner Morrow, that permisrc-
ion to park the ''1:\1inkmobi Ie" sampling truck be gran ted on the basis that they had already received
permission from O'o1enhouse HArdware Company to park their vehicle in front of the store, that they
clean up litter upon departure, and that they take every percaution to assure the safety of the
children in the recreational areas and the motion was carried by the following Aye and No vote:
those voting Aye being Commissioner Langohr, Commissioner Morrow and Mayor Sedivy; those vo ting

A request received from Stanley Crouse, President of the Bozeman Key Cluh for permission to set
lip and maintain a concession stand in front of one of the businesses along Main Street during the
Sidewalk Bazaar on Friday, 21 July, 1967, was presented.
It was moved by Commissioner Morro,", seconded hy Commissioner Langohr, that permission to set
up and maintain the concession be granted with the stipulation that the consent of the owner or
husiness firm of the building in front of which they propose to place their concession be obtained
and that they clean up any litter upon removal of the stand and the motion was carried by the
following Aye and No vote: those voting Aye being Commissioner Morrmo1, Commissioner Langohr and
Mayor Sedivy; those voting No, none.

The Director of Finance has requested authority to invest miscellaneous funds in the amoun t 0 f
$100,000.00 for a period of approximately 180 days. It being in the public in teres t, the City Mana-
ge r concurred ~yi th the reques t of the Di rec tor of Finance and recommended au thori ty to re inves t the
above funds be granted. It was moved by Commissioner Langohr, seconded by Commissioner Morrow,
I that the reinvestment as requested be authorized and the motion was carried by the following Aye
and No vote: those voting Aye being Commissioner Langohr, Commissioner Morrmv and Mayor Sedivy;
those voting No, none.
Revised Dumpi1UL_Charges - Single Load Basis:
The City Manager reported that it has become necessary to increase the schedule of dumping
individual loads and presented the following proposed dumping schedule of dumping charges for the
consideration of the Commission:

The City Manager also stated that. as in the past. the charges for car bodies and tree stumps
would not be covered by the free dumping penvit. A general discussion was had and it was moved by
Commissioner Morrow, seconded by Connnissinner Langohr. that the above dumping schedule be approved
and put into effect and the motion was carried by the following Aye and No vote: those voting Aye
being Commissioner Morrow, COtmlissioner Langohr and Mayor Sedivy; those voting No, none.
Confirma tion of Police Officer: Ernest T. Cox - Effective 16 July 1967:

A letter received frnm the Chief of Police announcing that Office Ernest T. Cox had satis-
factorily completed the required six month probationary period in the Bozeman Police Department
\\'as presented. The City Manager announced that h~'concurred in the recommendation of the Chief of
Pol ice and 'confirmed the appoin tment of Po lice Office Ernes t T. Cox as a member of the Police De-
partment subject to the approval of the Commission. It was moved by Commissioner Langohr. seconded
by Commissioner Morrow. tha t the confirma tion of Police Officer Brnes t T. Cox be approved and the
motion was carried by the following Aye and No vote: those voting Aye being Connnissioner Langohr.

Report for June: Continued - Director of Finance:
The report of the Direc tor Finance for the month of June was presented. The City Manager
connnen ted on the report and recommended the approval thereof. It was moved by Commissioner Morrow,
seconded by COmTI1iss ioner T.angohr. that the report be approved and ordered filed and the motion was
carried by the fdlowing Aye and No vote; those voting Aye being Commissioner Morrmol, Commissioner
Langohr and Mayor Sedivy; those voting No. none.
PLAT: Wilbur Smith Subdivision: South from Durston Road (1305' ) about l/4 mile west of Northwestern Dr.

The Final Plat of the Smith Subdivision located about one-fourth mile west of Northwestern Drive
was presented along with the favorable recommenda tion from the Ci ty-Coun ty Planning Board.
After thoroughly discussing Smith's Subdivision, the City Manager stated that on the basi$ of
the action of the City-County Planning Board he would recommend the approval of the Plat contingent
upon Mr. Wilbur E. Smith providing for the park requirements of this plat from other areas of his
property that mClY be platted at some future date. It was moved by Commissioner Langohr. seconded
by Commissioner Morrow. tha t the pIa t be approved as recommended and the City Manager be authorized
and d iree ted to sign the plat as the Director of ~lblic Service and the motion was carried by the
following AYf~ and No vote: those voting Aye being Commiss ioner Langohr, Connniss iolner Morrow and I
Mayor Sedivy; those voting No. none.

Ordinance No. 865, the annual salary ordinance covering salaries of the heads of depart-
ments and employees who are direct appointees of the Connnission, was presented entitled:

Resolution (Unnumbered) authorizing Purchase of Road Oil from State Highway: Year 1967-1968:
A resolution authorizing the purchase of not to exceed 25,000 gallons of road oil during
I the fiscal year July 1. 1967 to June 30, 1968 for use by the Street Department in repairing
pavement ano for sealf,ng certain sections of existing pavement within the City from the Montana
State Highway Department was presented as follml7s:

HHEREAS the City of Bozeman will have need during the fiscal
year July 1. 1967 - June 30. 1968, for road oi Is for use in
repairing streets and for sealing certain sections of existing
pavement wi thin the City, and
HHEREAS the City of Bozeman does not have proper facilities
for handling and storing the needed quantities of oils. and
WHEREAS the Montana State Highway Department does have storage
facilities and normally does have quantities of the required
types of oils stored in Bozeman from which it can supply the
quantities needed by the City of Bozeman,
NOW, THEREFORE, BE IT RESOLVED:
That an emergency does exist relative to the procurement of
road oils by the City of Bozeman and the City Manager is hereby
authorized to purchase from the Montana State Highway Department,
from its stocks in storage in Bozeman, approximately twenty-five
thousand (25,000) gallons of road oil, this to be purchased from
time to time during the fiscal year July 1, 1967 - June 30, 1968,
as needed by the City of Bozeman for repair and sealing of
existing pavements, and these quantities of road oils to be
I purchased at cost plus normal handling charges.
Passed and adopted by the City Commission of Bozeman, Montana.

July, 1967.

A letter received from Mr. Walter Elder, Gallatin Ringers Horseshoe Club, requesting permission
to lIse the club house and for the Camp Fire Girls to use the i.nformation booth at the Olel Country
Club for the operation of a concession during the Horseshoe Doubles Tourney on 30 July, 1967, was presented.
It lvas moved by Commissioner Morrow, seconded by Commissioner Langohr, that their request for use
of the club house during the Horseshoe Doubles Tourney on 30 July. 1967, and for the operation of
the concession booth by the Camp Fire Girls at the site of the tou rnamen t on the above date and the
motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow,
Commissioner Langohr and Mayor Sedivy; those voting No, none.
