HomeMy WebLinkAbout1967-05-24 32 Bozeman, Montana 24 May 1967 The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall Building, Wednesday, 24 May 1967, at 1:00 o'clock p.m. Present were Mayor Sedivy, Commissioner Morrow, Commissioner Langohr, City Manager Cutting, Ass't City Manager Fryslie, City Attorney Berg and the Clerk. I Commissioner Morrow opened the meeting with a prayer and the following proceedings were had. Minutes of the regular meeting held 17 May 1967, were read and it was moved by Commissioner Langoh r , seconded by Commissioner Morrow, that the minutes be approved as ccilrrected and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Comm- issioner Morrow and Mayor Sedivy; those voting No, none. Reques t to hold In ter-Fra ternity Dance - Bogert Park (pos tponed from 13 May to 30 May 1967 -9 to 12:00 P.M.: A verbal request from the Inter-Fraternity Council of the Sigma Nu Fraternity, to reschedule the Inter-Fraternity dance at Bogert Park, postponed 13 May 1967, to Tuesday, 30 May 1967, from 9:00 to 12:00 o'clock P.M., was presented. In concurrence with the recommendation of the City Manager, it was moved by Commissioner Morrow, seconded by Commissioner Langohr, that the request be approved contingent upon the same conditions as previously stipulated and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner Langohr and Mayor Sedivy; those voting No, none. Request to_hold Key Club Dance Buttrey's Parking Lot: 9:00 - 12:00 P.M., 27 May 1967: A request from Stanley Crouse of the Key club for permission to hold a dance on Buttrey's Parking Lot on Saturday, 27 May 1967, from 9:30 o'clock until midnite was presented. In concurrence with I the recommendation of the City Manager, it was moved by Commissioner Langohr, seconded by Commissioner Morrow , that permission to hold the proposed dance be granted provided that the consent of the owner is obtained and that the sound of the music be held to a level that will not provoke the concerted protest of the adjoining residential area and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner Morrow and Mayor Sedivy; those voting No, none. Authori ty to Purchase Police Unifomrs (Summe r) 1967-1968 Budge t - Approxima te!.L $600.00: A request from the Chief of Police for authorization to purchase police summer uniforms in the approximate amount of $600.00 was presented. Following advise of the City Manager that the delivery of the uniforms will involve several weeks and that funds for payment of the purchase will be in- cluded in the 1967-1968 Budget, it was moved by Commissioner Morrow, seconded by Commissioner Lan- gohr, that the purchase of the uniforms be authorized and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner MorroW, Commissioner Langohr and Mayor Sedivy; those voting No, none. Authority to Call for" Bids ~?O,OOO 1bs. Sodium Si1ico Fluoride - Water Department: Open Bids 21 June 1967 - Approximately $9.70 per cwt.: I The City Manager reported the Water Department has need to replenish its supply of Sodium Silico Fluoride for use as an additive to the City's water supply and requested that the purchase of 50,000 Ibs. at an estimated cost of $9.70 per cwt., as a three year supply be authorized. It was moved by Commissioner Langohr, seconded by Commissioner Morrow, that the purchase as requested be authorized and the Clerk of the City Commission be directed to issue a "Call for Bids" for the 33 purchase of 50,000 lbs. sodium silico fluoride, to be opened 21 June 1967, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner Morrow and Mayor Sedivy; those voting No, none. Request to hold Teen-Age Dance at Fairgrounds Friday, 9 June 1967: A letter received from Mrs. Rodney B. Spoor, Social Chairman, Bozeman Jayceens, requesting I permission to sponsor a teenage dance at the Gallatin County Fairgrounds, 9 June 1967, to help cover the cost of the mass Measles Immunization to be held in conjunction with the Gallatin County Medical Association on 3 June 1967 was presented. In concurrence with the recommendation of the Ci ty Manager, it was moved by Commissioner Morrow, seconded by Commissioner Langohr, tha t the Bozeman Jayceens request to hold a teenage dance at the Fairgrounds be granted and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner Langohr and Mayor Sedivy; those voting No, none. Request to be exem~ from future SID assessments for Sanitary Sewer and Water: A letter received from Mr. Myron Westlake was presented requesting that he be exempt from any future special improvement district assessments for extension of water and sanitary sewer lines west of said property as follows: A tract of land in the Southeast one-quarter of the Northeast one-quarter (SE~,NE~) of Section 1, Township 2 South, Range 5 East of Montana Prinicipal Meridian, Gallatin County, Montana, being more particularly described as follows, to-wit: Beginning at the northwesterly corner of Westlake's Second Subdivision of Bozeman, Montana, said point being North 88000' West a distance of l252.9 feet and North l016'30" East a distance of 30 I feet from the east one-quarter corner of Section 1, T2S, RSE, M.P.M., thence North 10l6'30" East along the easterly right of way line of the Interstate Highway 1-90-6 (13) 296 as now constructed a distance of 529.43 feet; thence South 88043'30" East a distance of 137 feet; thence South 1016' 30" West parallel to and 137 feet easterly distant from said Interstate right of way a distance of 531.16 feet to the northeasterly corner of Westlake's Second Subdivision of Bozeman, Montana; thence North 88000' West along the northerly line of said subdivision being also the northerly street line of Oak Street, a distance of 137 feet to the point of beginning. Containing wi thin the above described exterior oundaries a total of 72,650.42 square feet or 1.6881 acres, of this total the northerly 60 feet of the above described tract or 8220 square feet is to be deeded to the City of Bozeman for street purposes leaving a net area of 64,430,415 square feet or 1.479l acres. It was moved by Commissioner Langohr, seconded by Commissioner Morrow, that in consideration of the fact that Mr. Westlake has installed water and sanitary sewer lines to serve the above described property at his own expense and in accordance with City approved plans and specifications, that this subject tract be exempt from any future SID assessments for installation of those utilities and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner Morrow and Mayor Sedivy; those voting No, none. Confirmatioi! .of Park ~equirements for Wesqake Property: I A letter received from Mr. & Mrs. Myron Westlake requesting that the City of Bozeman waive the lien of the park agreement of 21 October 1964, in regard to the tract of land fronting on North 7th Avenue, between Oak Street and Baxter Land (extended) was presented. Following a discussion on the portion to be released, it was moved by Commissioner Morrow, se- conded by Commissioner Langohr, that the following tract be released from the lien of the 1964 Agreement on the basis that the park requirements of the subject tract be met by dedication of other areas of Westlake property as contemplated in the 1964 Agreement and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner Langohr and Mayor Sedivy; those voting No, none. 34 Being in the Southeast Quarter of the Northeast Quarter (SE~NE~) of Section One (I), Township Two (2) South, Range Five (5) East, M.P.M., and being more particularly described as follows: Beginning at the point of intersection of the Northerly right of way line of Oak Street (presently 30 feet wide) and the easterly right of way line of Seventh Avenue (U.S. 10), and running thence in a Northerly direction along and with said Easterly right of way line of Seventh Avenue (U.S. 10), a distance of 180 feet to a point for corner; thence in an Easterly direction and parallel to the Norther- I ly right of way line of Oak Street 137 feet to a point for corner; thence in a Southerly direction and parallel to the Easterly right of way line of Seventh Avenue (U.S. lO) 180 feet to a point on the existing northerly right of way line of Oak Street; thence in a west- erly direction along and with said northerly right of way line of Oak Street 137 feet to the place of beginning. AuthQ...t.~~g Attend Park-Recreation Convention: Lewistown 3-4 June 1967: Park Board Chairman Park~ Park Superin tend en t Cloninger, Ass' t Park Superin tenden t Chan~ ler: It was announced that the Park Recreation Convention is scheduled to be held in Lewis town , 3-4 June 1967, and in concurrence with the City Manager's recommendation, it was moved by Commissioner Langohr, seconded by Commissioner Morrow, that the Park Board Chairman John Parker, the Park Superin~ tendent Thurman Cloninger, and the Ass't Park Superintendent Merle Chandler be authorized to attend the Convention and, it being in the public interest, their expenses be paid out of the appropriate Park fund and the motionwas carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner Morrow and Mayor Sedivy; those voting No, none. Continuation of License Bond: Mannix Electric, Inc., Bozeman: -~_.,------~_.~ In compliance with Chapter 15 of the Bozeman Municipal Code, the Certificate for the Electrical bond of Mannix Electric, Inc., Bozeman, was presented. The City Manager stated the Building In- spector had recommended the approval of the bond which has been approved as to form by the City Attorney. It was moved by Commissioner Morrow, seconded by Commissioner Langohr, that the afore- I mentioned bond be approved and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner Langohr and Mayor Sedivy; those voting No, none. Vacation for City Manager: Week of 29 May 1967: The City Manager requested that he be granted vacation leave of absence from 29 May to 4 June 1967, and that Harold A. Fryslie, Ass't. City Manager, be designated to perform the duties of the City Manager during that period. It was moved by Commissioner Langohr, seconded by Commissioner Morrow, that the request for vacation be granted and that the Ass't. City Manager be designated as Acting City Manager during the period stated and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner Morrow and Mayor Sedivy; those voting No, None. Bozeman City Bus Termination Agreement: In further reference to the action by the City Commission, taken 17 May 1967, in regard to the indefinite suspension of the Bozeman City Bus Service, there was presented by the City Attorney a suspension Agreement prepared to comply with the requirements of the Public Service Commission to permit the proposed suspension. In concurrence with the recommendation of the City Attorney and the City Manager, it was moved by Commissioner Morrow, seconded by Commissioner Langohr, that the City I of Bozeman enter into the subject Agreement as presented and that the Mayor and the Clerk of the City Commission be authorized and directed to sign the Agreement as presented and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner Langohr and Mayor Sedivy; those voting No, none. 35 Report of Electrical Board Meeting Helena - 16 May 1967 - Bldg. Inspector Barrick: The City Building Inspector reported on the meeting of the State Electrical Board with City Building Officials in Helena, l6 May 1967. He presented a letter written to the State Electric Board by John Campana, Chairman of City Electrical Inspectors Committee containing a five-point I program to avoid duplication in inspections and duplications of inspection fees chargeable to persons subject to fees in cities, and yet to promote the general safety of the public in electrical in- stallation. It was moved by Commissioner Langohr, seconded by Commissioner Morrow, that the report of the City Building Inspector be approved and that Mr. Barrick be commended on his complete resume of the meeting and that committees five-point program be approved and submission to the State Elect- rical Board for consideration be authorized and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner Morrow and Mayor Sedivy; those voting No, none. Reports: The following reports were presented: Director of Public Service Director of Finance The City Manager commented on the reports and recommended their approval. It was moved by Commissioner Morrow, seconded by Commissioner Langohr, that the reports he approved and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being Comm- issioner Langohr, Commissioner Morrow and Mayor Sedivy; those voting No, none.
