HomeMy WebLinkAbout1967-06-07 39 Bozeman, Montana 7 June 1967 The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall Building, Wednesday, 7 June 1967, at 1:00 o'clock p.m. Present were Mayor Sedivy, Commissioner Langohr, Acting City Manager Fryslie, City Attorney Berg and the Clerk. I Mayor Sedivy opened the meeting with a prayer and the following proceedings were had: Minutes of the regular session held 31 May 1967, were read and it was moved by Commissioner Langohr, seconded by Mayor Sedivy, that the minutes be approved as read and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, and Mayor Sedivy; those voting No, none. Agreemen~~to Obta~~.Sewer Connections (SID No. 432): Hugh Biggs - 1506 West Babcock St.: - ..~._- Mr. & Mrs. Hugh Biggs, 1506 West Babcock Street requested permission to connect their property to the City's Sewer system at 1506 West Babcock Street and at their own expense. They fur ther agreed to pay their share at the time the property is platted. It was moved by Mayor Sedivy, sec- onded by Commissioner Langohr, that permission for connections be granted, subject to the landowners' payment of all costs of installation, and that the Mayor and the Clerk of the City Commission be authorized and directed to sign the Agreement for the City and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr and Mayor Sedivy; those voting No, none. Consideration of Street Truck Bids opened 31 May 1967: The Commission was referred to the opening of bids for the 2 1/5 ton dump truck for use by the I Street Department on 31 May 1967. The bids having been studied in detail by the City Engineering Departmen t, it was found that none of the bids submitted conformed to the specifications of the "Call for Bids." After considerable discussion, it was moved by Commissioner Langohr, seconded by Mayor Sedivy, that all bids be rejected, the City specifications reviewed and rewritten if necessary and the Clerk of the Commission be authorized to issue a new "Call for Bids" for the purchase of the 2 1/5 ton Dump Truck and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, and Mayor Sedivy; those voting No, none. Rearing on ~esolution No. 132/+ : Intention to Create SID No. 481: Payi~_Mendenhall & Lamme S ts. Between 10th & 11th: Th is was the time and place set in Commission Resol~tion No. 1324 to hear protests to the creation of Special Improvement District No. 481, affidavit of publication of Notice and the Clerks mailing certificate stating that all property owners had been notified as required by law were presented. The City Engineer presented written protests filed with the Clerk of the City Commission and signed by owners of property representing 70.45% of the proposed district. Several property owners were present to affirm their written protests to the creation of Special Improvement District No. 481, and the City Commission having determined the protests to be sufficient, it was moved by Mayor Sedivy, I seconded by Commissioner Langohr, that under the provisions of section 11-2205 R.C.M., no further proceedings be had upon Commission Resolution No. 1324 during 1967 and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sedivy and Commissioner Langohr; those voting No, none. Authorit~ to Attend Annual Montana State Fire~ Service Conference - Chief Huber and Fi eman Lewis: The fifth annual Montana State Fireman's Conference is scheduled to be held in Whitefish, 15- 17 June 1967. Upon recommendation of the Fire Chief and the City Manager, it was moved by Commissioner 40 Langohr, seconded by Mayor Sedivy, that it being in the public interest, Fire Chief Huber and Fire- man Lewis be authorized to attend this convention and the expenses of the delegates incurred by such attendance be paid out of the General Fund and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, and Mayor Sedivy; those voting No, none. Heari9Lgp ResolutionNo;__l~~~~nt~nt to Create SID No. 482: Paving on South 4th Avenue ; I Resolution No. 1328 - Creating District No. 482: This was the time and place set in Commission Resolution No. 1325 to hear protests to the creation of Special Improvement District No. 482. Affidavit of Publication of Notice and the Clerks mailing certificate stating that all property owners had been notified as required by law were presented. The City Engineer presented written protests filed with the Clerk of the Commission and signed by two property owners representing 21% of the proposed district. Mrs. H. S. Cannon was present to affirm the written protests. The City Commission having determin~d that the improvement being in the public interest and the protests to be sufficient, it was moved by Commissioner Langohr, seconded by Mayor Sedivy, that the City Attorney be instructed to prepare a resolution creating the district: Commission Resolution No. 1328 COMMISSION RESOLUTION NO. 1328 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN CREATING A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DISTRICT NO. 482 OF THE CITY OF BOZEMAN FOR THE PURPOSE OF CONSTRUCTING AND INSTALLING AN ASPHALTIC-CONCRETE TYPE PAVEMENT TOGETHER WITH INTREGAL CONCRETE CURBS AND GUTTERS AND NECESSARY APPURTENANCES THERETO, ALSO CONSTRUCTION AND RECONSTRUCTION OF NECESSARY DRAINAGE INLETS AND APpURTENANCES THERETO ON THAT PORTION OF SOUTH FOURTH AVENUE BE '!WEEN WEST ARTHUR STREET AND WEST GARFIELD STREET. prepared by the City Attorney was presented. In concurrence with the recommendation of the City I Manager, it was moved by Mayor Sedivy. seconded by Commissioner Langohr, that the resolution be passed and adopted to create Special Improvement District No. 482 and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sedivy and Commissioner Langohr; those voting No, none. It was moved by Commissioner Langohr, seconded by Mayor Sedivy, that the Mayors proclamation of June as "Dairy Month" be endorsed and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr and Mayor Sedivy; those voting No, none. ~~~_~1~...J:Q_ Install Sidewalk Flag Sleeves on M~~~~reet: Junior Chamber of Commerce: A letter received from Gary L. Christie, Flag Posting Chairman of the Bozeman Jaycees, reques ting permission to install sleeves in the concrete in front of the merchants establishments, who do not I have parking meter posts in front of their places, for the purpose of leasing and posting Flags on all populat holidays was presented. In concurrence with the recommendation of the City Manager, it was moved by Mayor Sedivy, seconded by Commissioner Langohr, that further permission for the Bozeman Jaycees to install the subject sidewalk sleeves in front of those establishments where a meter post is not available, provided that the sleeves are properly installed and capped when not in use was granted and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sedivy, and Commissioner Bangohr; those voting No, none. 41 ~eapEoin tmen ~_ to City Boards: Mayor Sedivy announced his reappointments to various City Boards or Commissions as follows: CEMETERY B0ARD TERM EXPIRATION DATE Mrs. F. t. Bond 46.68 Band 16.08 SID Revolving 34.55 $113,668.38 The City Manager commented on the claims and found them to be true and lawful claims against the City of Bozeman and recommended that they be approved and the Director of Finance be directed to issue warrants in payment. After examination of the claims and checking against the claim reg- ister, it was moved by Mayor Sedivy, seconded by Commissioner Langohr, that the claims be approved and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Langohr; those voting No, none. Absence of Commissioner Morrow: ~~"._-~.. In concurrence with the recommendation of the City Manager, it was moved by Mayor Sedivy, seconded by Commissioner Langohr, that the absence of Commissioner Morrow be authorized for June 17th and June 14th in compliance with Section 2.08-060 of the Bozeman Municipal Code.
