The Corrnnission of the City of Bozeman met in regular session in the Commission Room, City
Ha]l Building, Wednesday, 28 June 1967, at 1:00 o'clock p.m. Present were Mayor Sedivy, Commissioner
Morrow, Commissioner Langohr, City Manager Cutting, Ass't City Manager Fryslie, City Attorney Berg
I and the Clerk.
Commissioner Langohr opened the meeting with a prayer and the following proceedings were had:
Minutes of the regular meeting held 21 June 1967, were read and it was moved by Commissioner
Morrow, seconded hy Corrnnissioner Langohr, that the minutes be approved as corrected and the motion
was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner
L8ngohr and Mayor Sedivy; those voting No, none.
North Seventh Avenue - Texaco SLation: Driveway S~ns:

Mr. E. J. Miers and Mr. J. D. Fagan, But te, and Mr. Harold Owens, Bozeman, representatives of the
Texaco Company appeared before the Commission to further discuss the Texaco ground sign and the vari-
ance of the driveways for the new Texaco Service Station now under construction on North Seventh
Avenue.

Following a thorough discussion of the request and in concurrence with the recommendation of the
City Manager, it was moved by Commissioner Langohr, seconded by Commissioner Morrow, that the forty-
foot driveway on North Seventh Avenue be approved as requested and that the fifty-five foot driveway
on Baxter Lane be approved with minormodifications subject to the approval of the City Engineer, and
that the height of the texaco ground sign, to be located ina different area than originally planned,
I be approved for a maximum height of not to exceed fifty-six feet above the ground and the motion
was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner
Morrow and Mayor Sedivy; those voting No; none.

Fire Chief Huber reported on the Montana State Fire Conference held in Whitefish 15-17 June
1967, explaining that it was a very well planned convention. He also reported that the Resolution
he had intL'oduced requesting that the Fireman Training Instructors and Training Program be trans-
ferred to Montana State University was brought before the convention, but that no final decision
had been made as to where it would be held. It was moved by Commissioner Morrow, seconded by
Commissioner Langohr, that the Fire Chief be highly commended for his very thorough report of the
conven t ion and that it be accepted and approved and the motion was carried by the following Aye
and No vote: those voting Aye being Commissioner Morrow, Commissioner Langohr and Mayor Sedivy;
those voting No, none.

The Street Department has need for a supply of crushed gravel for u~ in its repair program
I on various streets within the City. The City Manager requested authority to purchase 200 cubic
yards one-half inch crushed gravel at an approximate cost of $550.00. It was moved by Commissioner
Langohr, seconded by Commissioner Morrow, that the purchase be approved and the motion was carried

Richard Wike of the Ellen News Stand, 19 West Main Street, appeared befor the Commission to

request permission to place paper racks on Main Street, as well as the placing of an old Cigar
Store Indian in front of the Ellen News Stand.
The Commission requested the Mr. Hike address a letter to the City requesting this penuission.

Several property owners from East Main Street were present to discuss the paving, sidewalks I
and curb openings to be allowed to serve their property along the proposed State Highway Commission
East Main Street reconstruction. The Commission requested the group to complete questionaires
sent to them and submit them to the Engineers office promptly to penuit a field investigation of
their requests.

The Director of Finance has requested authority to invest water funds in the amount of $75,000.00
for a period of approximately 180 days in Treasury Bills. It being in the public interest, the City
Manager concurred with the request of the Director of Finance and recommended authority to reinvest
the above funds be granted. It was moved by Commissioner Morrow, seconded by Commissioner Langohr,
that the reinvestment as requested be authorized and the motion was carried by the following Aye
and No vote: those voting Aye being Commissioner Morrow, Commissioner Langohr and Mayor Sedivy; those
voting No, none.

The continuation certificate for the Il'cnewal of the gas fitters license bond of the Montana
Power Company was presented. It was reported that the Building Inspector had approved the con tin-
uation of the bond and after approval of the certificate as to fonu by the City Attorney, it was I
moved by Commissioner Langohr, seconded by Commissioner Morrow, that the certificate be approved
and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner
Langohr, Commissioner Morrow and Mayor Sedivy; those voting No, none.

In accordance with the provisions of Ordinance No. 785, the Building Movers bond as surety
for a moving permit on Cotton's House Moving Co., Helena, Montana, was presented. I t was reported
the Building Inspector had recommended that the bond be approved and it having been approved as to
form by the City Attorney, it Has moved by Commissioner Morrow, seconded by Commissioner Langohr,
that the hond be approved and the motion was carried by the following Aye and No vote: those voting
Aye being Commissioner MorroHJ Commissioner Langohr and Mayor Sedivy: those voting No, none.

The City Manager reported that the Water Department has need for additional supply of 3/4 inch
water meters and requested authority to purchase thirty water meters at an approximate cost of $980.00.
It was moved by Commissioner Langohr, seconded by Commissioner Morrow, that the purchase be authorized
and the motion was carried by the following Aye and No vote: thos voting Aye being Commissioner Langohr,
Commissioner Morrow and Mayor Sedivy; those voting No, none. I

A letter received from Mr. W. J. Sullivan, President of Allied Manufacturing Corporation, re-
questing permission to build and use audio equipment on the roof of the building at 120 East Main
Street and at 135 East Main Street and at 135 East Mendenhall, was presented. It was moved by Comm-

issioner Morrow, seconded by Commissioner Langohr, that the subject request be tabled for further
study and the motion was carried by the following Aye and No vote: those voting Aye heing Comm-

I Mayor Edmund P. Sedivy announced that he has issued a proclamation designating this program
of "Bells of America Ringing for Freedom" conducted by each Montana American Legion Post. The Be 11s
Ringing for Freedom Program was established by the American Legion in 1963 in recognition of the
aniversary of the signing of the Declaration of Independence. He urged all citizens of the City
of Bozeman to participate in ringing the bells to let the world know tha t patriotism lives wi thin
the heart of every citizen of this City.
