HomeMy WebLinkAbout1967-07-12 53 Bozeman, Montana \ 12 July 1967 The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall Building, Wednesday, 12 July, 1967, at 1:00 o'clock p.m.. Present were Mayor Sedivy, Commissioner Morrow, Commissioner Langohr, City Manager Cutting, Ass't City Manager Fryslie, City Attorney Berg I and the Clerk. Commissioner Morrow opened the meeting with a prayer and the fo llowing proceed ings were had: Minutes of the regular meeting held 1967, were read and it was moved by Commissioner 5 July, Langohr, seconded by Commissioner Morrow, that the minutes be approved as read and the motion was carried by the following Aye and No vote: those voting Aye heing Commissioner Langohr, Comm- issioner Morrow snd Mayor Sedivy; those voting No, none. Execution of Documents: 1967 Sidewalk Construction: W. D. HO~lells' awarded ') JtJly, 1967, for the construction of miscellaneous Walks and Curbs within the City of Bazeman for the year 1967, were presented. The bond and contract were approved as to form by the City Attorney, and the City Manager reported that the City had evidence the contractor is adequately insurc~ and re- I commended tha t the dOCIlments be approved and the Mayor and the Clerk of the Commission be autho- rized to sign the contract for the City. The bids having been studied in detail by the City Engineering Departmen t, it was found that the bid of Rolfe and Wood, Inc. was the lowcBt bid submitted but elid not meet specifications in rer;ard to width of clutch or model and the delivery date offered 1'rlaS indefinite; also that the bid of Owenhouse Hardware Company did fully meet or exceed specifications. The City Manager concurred in the recommendation of the City Engineer that the City reject the bid of Rolfe and Hood, Inc., and accept the bid of Owenhouse Hardware Company for the reasons stated above and it was moved by Commissioner Morrow, seconded by Commissioner Langohr, tha t the bid of Rolfe and t.Jood, Tnc. , be re jec ted for fa 11 ure to meet specifications as stated above and I that the purchase of the 2 1/2 ton dump truck be awarded to 01'rJenhouse Hard~.,arp Company, Bozeman, Montana, on the basis of its hid in the amount of $5,lR3.00 being the best bid and meeting 'dth or exceeding the specifications of the "Call for Bids" and the motion was carried by the fo Hawing Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner Langohr and Mayor Sedivy; those voting No, none. Affidavit of Publication of Notice and the Clerks mailing certificate stating that all property owners had been notified as required by law were presented. The City Engineer presented written protests filed with the Clerk of the Commission and signed by the Delta Sigma Phi Fraternity representing 13.07% of the proposed district. The City Commission having determined that the improvement being in the public interest and the protest being insuffi- cient, it was moved by Commissioner Langohr, seconded by Commissioner Morrow, that the City Attorney I be instructed to prepare a resolution creating the district: Commission Resolution No. 1331 COMMISSION RESOLUTION NO. 1331 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN CREATING A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DISTRICT NO. 4.8Lf OF THE CITY OF BOZEMAN FOR THE PURPOSE OF OPERATING AND MAINTAINING A STREET LIGHTING SYSTEM TO LIGHT GREEK WAY BElWEEN SOUTH THIRD AVENUE AND KAGY BOULEVARD AND A PORTION OF KAGY BOULEVARD LYING WESTERLY OF SOUTH THIRD AVENUE AND ADJOINING GREEK ~i1AY SUBDIVISION SAID LIGHTING SYSTEM TO BE INSTALLED AND PAID FOR BY THE MONTANA POWER COMPANY, ALL UNDER THE AUTHORITY OF AND IN CONFORMITY WITH SECTIONS 11-2245 TO 11-2257 INCLUSIVE OF THE REVISED CODES OF MONTANA 1947. prepared by the City Attorney was presented. J. Sullivan, President of Allied Manufacturing Corporation, for permission I to build and use audio equipment on the roof of the building at 120 East Main Street and at 135 East Mendenhall Street was again brought before the Commission. Following a further discussion of this request, it was moved by Commissioner Morrow, seconded by Cormnissioner Langohr, tha t the reques t be tabled indefinitely and the motion was carried by the following Aye and No vote: those voting Aye being Cormnissioner Morrow, Commissioner Langohr and Mayor Sedivy; those voting No, none.
