SUBJECT: Payment Agreement for Construction of Graf Street From South 15th Avenue to McNab Street

RECOMMENDATION: Authorize the City Manager to sign the Payment Agreement for
Construction of Graf Street From South 15th to McNab Street between Gilhousen Property Trust and the City of Bozeman.
BACKGROUND: The Gilhousen Property Trust (GPT) was recently granted approval for a 5
lot minor subdivision at the intersection of South 19th Avenue and the future Graf Street for the
purpose of creating a development to be known as The Yellowstone Center (TYC). As part of that development GPT is going to install the section of Graf Street adjacent to their project. City staff recognized this as an opportunity to partner with GPT to complete Graf street all the way
from South 19th to McNab Street, much as we did with Town Pump at the intersection of
Huffine and Cottonwood.
This will be of immense benefit to residents living south of Kagy as well as serving as an indispensible detour route during the future reconstruction of Kagy Boulevard. There will be
substantial benefit to the immediately adjacent properties at the time of development by
providing an immediately functional road. The coordination of efforts will reduce the overall
expense of constructing the road. Staff members developed a funding strategy for this potential project which includes the use of
Street Impact Fees for the eligible portions of Graf Street.

The Fiscal Year 2017 Approved Budget included SIF077 – Graf Street Extension project (19th
Avenue to Ritter) appropriations in the Street Impact Fee fund in the amount of $1,035,000. On
October 3, 2016, the Commission approved a budget amendment to increase the appropriations
in the Street Impact Fee fund for the project by $1,120,000, to a total of $2,155,000. GPT is responsible for $1,215,000 of the improvements to Graf Street where adjacent to their property
boundary and $38,000 of signal improvements at the intersection of Graf Street and South 19th
Avenue as summarized in the attachment, “The Yellowstone Center Impact Fee Reimbursement
Summary.”
UNRESOLVED ISSUES: None.
FISCAL EFFECTS: As a result of approving this Payment Agreement, the city will make
payments up to $1,728,793.70 to GPT from the Street Impact Fee Fund for the construction of
Graf Street as described in the Agreement. The City also intends to adopt a payback district upon completion of the project for future repayment of portions of the Impact Fee money when
development occurs adjacent to the improvements.
ALTERNATIVES: As suggested by the City Commission.
