Present were Mayor Sedivy, Commissioner Morrow, Commissioner Langohr, City Manager Cutting, Ass't City Manager Fryslie, City Attorney Berg I and the Clerk. Commissioner Langohr opened the meeting with a prayer and the following proceedings were had: Minutes of the regular meeting held, 3 May 1967, were read and it was moved by Commissioner Morrow, seconded by Commissioner Langohr, that the minutes be approved as corrected and the motion was carried by the fo llowing Aye and No vote: those voting Aye being Commissioner Morrow, Commiss- ioner Langohr and Mayor Sedivy; those voting No, none. Appoin tment of Campus Police as Special Ci ty Police Officers: A letter from D. J. Skerritt, Chief Traffic and Security Department Officer of the Montana State University requesting that the following members of their campus Police force be designated as Special Policeman of the Bozeman City Police force for another year ending May lO, 1968, with- out cost to the City, was presented: Donald J. Skerritt, Chief Loren A. Winks Harold W. Pettys Everett E. Edsall It was moved by Commissioner Langohr, seconded by Commissioner Morrow, that in concurrence with the recommendation of the Police Chief and the City Manager, the appointment as requested be approved and the motion was carried by the following Aye and No vote: those voting Aye being I Commissioner Langohr, Commissioner Morrow and Mayor Sedivy; those voting No, none. Request for Variance on Sign Ordinance: Conoco: Rouse & Main (Carl Hanson): Mr. Carl Hanson, Construction Engineer for the Continental Oil Company appeared before the Commission to request permission to remove the existing sign and installing a sign forty feet high, projecting four feet over the property line at the Conoco Station on the oorner of East Main Street \ and South Rouse Avenue. After discussing the proposed request, the City Manager informed the Commission that he rec~ ommended that the request be denied on the basis of Chapter 14.16-420 of the Bozeman Municipal Code. It was moved by Commissioner Morrow, seconded by Commissioner Langohr, that the matter be tabled for a week to permit reviewing the situation before making a final decision and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner Langohr and Mayor Sedivy; those voting NO, none. Request to place can~Stand at Gambles 11-13 May 1967 - Key Club: A letter from Stanley Crouse, President of the Bozeman Key Club, requesting permission to set up a stand to sell candy in front or just inside of Gambles Store on East Main Street on Thursday, Friday and Saturday, May ll-l3, 1967, for the purpose of a fund raising project to finance a Mother1s I Day Banquet for the mothers of the Key Club members was presented. It was moved by Commissioner Langohr, seconded by Commissioner Morrow, that the above request be granted and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner Morrow and Mayor Sedivy; those voting No, none. Continuation Certificate - License Bond: William S. Lynas: Gas Fitter - Plumber: In compliance with Chapter l6 of the Bozeman Municipal Code, the Certificate for the plumbing and gas fitter bonds of William S. Lynas, Bozeman, were presented. The City Manager stated the 24 Building Inspector had recommended the approval of the bonds, and the certificates had been approved as to form by the City Attorney. It was moved by Commissioner Morrow, seconded by Commissioner Lan~ gohr, that the aforementioned bonds be approved and the motion was carried by the following Aye and no vote: those voting Aye being Commissioner Morrow, Commissioner Langohr and Mayor Sedivy; those voting No, none. Request to Hold Inter-Fraternity Dance at Bogart Grove 9-12 P.M. Sat. 13 May 1967: I A verbal request from the inter-fraternity Council of the Sigma Nu Fraternity, to hold an inter-fraternity dance at Bogart Park between 9:00 and 12:00 P.M. on Saturday, 13 May 1967, was presented. In concurrence with the recommendation of the City Manager, it was moved by Commissioner contingent upon the following Langohr, seconded by Commissioner Morrow, that the request be approved /conditions and the motion , . was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Comm- issioner Morrow and Mayor Sedivy; those voting No, none. l. That the sound level of the music be held to a level that will not provoke the concerted protest of the adjoining homes; 2. That the swimming pool and other park facilities, not related to the function, be unmolested; 3. That no beer be consumed on the premises, and 4. That the groups clean up any litter resulting from the dance. Authority to attend Montana Water Pollution Council Stream Classification hearing - Helen~, 16 May 1967: City Manager, City Engineer, Water Superintendent: There will be a Montana Water Pollution Council Stream Classification Hearing in Helena, Montana, on 16 May 1967 and in concurrence with the recommendation of the City Manager, it was moved by Commissioner Morrow, seconded by Commissioner Langohr, that the City Manager, the City Engineer and the Water Superintendent be authrozied to attend the hearing and the motion was I carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner Langohr and Mayor Sedivy; those voting No, none. Paving on South Fourth Avenue between West Garfield and West Arthur Streets: The request for the paving on the one block of South Fourth Avenue between South Garfield and South Arthur Streets was again presented. The City Engineer and the City Attorney recommended that the District boundaries be set up equally distant on each side of Fourth Avenue. After hearing the report of the City Engineer and the City Attorney, it was moved by Commissioner Langohr, seconded by Commissioner Morrow, that the City Attorney be directed to prepare the resolution of intention for paving the one block of South Fourth Avenue between Garfield and Arthur Street and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Commiss- ioner Morrow and Mayor Sedivy; those voting No, none. Paving Mendenhall Street, Lan~e Street between 10th and 11th Avenues: The request for the installation of paving or sidewalks on Mendenhall and Lamme Streets between North lOth and 11th Avenue was again brought before the Commission for further consideration. The City Engineer and the City Attorney presented the report they had prepared on the proposed installation of paving. The City Attorney recommended that due to the difference in cost in completing the I paving, that the paving of both blocks be combined in one special improvement district in order to make a more equitable cost to all lots. After hearing the recommendation of the City Attorney and the City Engineer, it was moved by Commissioner Morrow, seconded by Commissioner Langohr, that the City Attorney be directed to prepare the resolution of intention for the installation of paving for both Lamme and Mendenhall Streets between tenth and eleventh avenues and the motion was carried by 25 the following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner Langohr and Mayor Sedivy; those voting No, none. Dogs at Large and a Nuisance: Cloyce E. Smith: Mr. Cloyce E. Smith of 221 South Ninth Avenue appeared to complain about dogs which he be- I lieves to be at large and a nuisance in violation of Section 5.l6.0S0 of the Bozeman Municipal Code. Mr. Smith was informed by the Commission that the law permits any citizen to sign a com- plaint against the owners of nuisance animals. The Chief of Police again urged all dog owners to cooperate with the City in complying with the ordinance. " Retirement of Police Chief B. G. Davis effective 23 May 1967: " A letter dated 3 May 1967 from Chief of Police B. G. Davis addressed to the City Manager and requesting that he be passed from the active Police Force to the Police Reserve, upon completion of twenty years of service with the Police Department on 23 May 1967, in accordance with the pro-- visions of the Montana Law was presented. The Board of Trustees of the Police Reserve Fund met on Wednesday, 3 May 1967, to consider Chief Davis's request and its written recommendation that Chief B. G. Davis's request to be passed from the active to the Police Reserve, effective as of 23 May 1967, in accordance with Section ll-l8l8, R.C.M., 1947, was presented. The City Manager paid tribute to Chief Davis for the service he rendered to the City of Boze- man for so many years and for the manner in which he carried on the Department since December 1966 and in turn recommended that his request be granted upon completion of twenty years of service, I effective 23 May 1967. It was moved by Commissioner Langohr, seconded by Commissioner Morrow, that the Chief of Police B. G. Davis be passed from the active Police Force to the Police Reserve in accordance with his request and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner Morrow and Mayor Sedivy; those voting No, none. Promotion of Captain C. R. Cutting to Police Chief to fill vacancy: The City Manager announced his promotion of Captain C. Ronald Cutting to Chief of Police for the Police Department to be effective upon the retirement of Chief Davis on 23 May 1967, in accord- ance with the strong recommendation of the Bozeman Civil Service Board in its letter of 28 December 1966. The Police Commission at its meeting on 2 May 1967, also unanimously concurred 1n the re- commendation of the Bozeman Civil Service Board. It was moved by Commissioner Morrow, seconded by Commissioner Langohr, that the Commission concur in this promotion and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner Langohr and Mayor Sedivy; those voting No, none. Proclamation Realtor's Week (Wm. Cocales, Chairman Realtor's Board)~ Mayor Sedivy announced his proclamation of May 21 through May 27, 1967, as Realtors Week and asked all citizens to join with the Bozeman Board of Realtors in observing the Week. I t was moved I by Commissioner Langohr, seconded by Commissioner Morrow, that this proclamation of the Mayor be endorsed and the motion was carried by the following Aye and No vote: those voting Aye being Comm- issioner Langohr, Commissioner Morrow and Mayor Sedivy; those voting No, none. Ben Berg - Excused 3:30 o'clock P.M: S ta tus_ Report - Kirk Park: The City Manager called upon the Assistant City Manager to present to the City Commission a 26 proposed revision of the Kirk Park Development Project SID 470. The City Commission was informed that recommended revisions propose to landscape and develop the full l2.3 acre area thereby including two regulations Babe Ruth Baseball fields to help meet the critical local demand for more baseball facili ties. These revisions may be accomplished without an overall increase in the project cost by deletion of previously proposed undeground sprinkling system, a picnic shelter and possibly some playground equipment. Following discussion, it was moved by Commissioner Morrow, seconded by I Commissioner Langohr, that this matter be considered after receipt of the recommendations of the park board and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner Langohr, and Mayor Sedivy; those voting No, none. Reports for April (Continued): The following reports were presented: Cemetery Director of Public Service (March) Cashier Director of Finance O1arch) Water Collector Building Inspector Police Judge The City Manager commented on the reports and recommended their approval. I t was moved by Commissioner Langohr, seconded by Commissioner Morrow, that the reports be approved and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being Comm- Langohr, Commissioner Morrow, and Mayor Sedivy; those voting No, none. Claims for April (Continued): Claim No's. 8909 thru 8930 inclusive were presented as follows: General $l,lSS.77 Cemetery $ 89.20 Street 286.29 Band 13.59 Water 964.67 Garbage 1,111.37 I SDS 54.96 Parking Meter 88.00 Library 179.27 Permanent Care 50.00 Park l76.66 Driver Education 468.00 Total $4,637.78 The City Manager commented on the claims and found them to be true and lawful claims against the City of Bozeman and recommended that they be approved and the Director of Finance be directed to issue warrants in payment. After examination of the claims and checking against the claim re- gister, it was moved by Commissioner Morrow, seconded by Commissioner Langohr, that the claims be approved and the motion was carried by the following Aye and No vote: those voting Aye being Comm- issioner Morrow, Commissioner Langohr and Mayor Sedivy; those voting No, none. Increase of Garbage Base Rate Assessment: The City Manager stated that a basic rate of $l7.00 for garbage collection for a four room house has been used since 1959; that a complete re-survey of the garbage situation in the City had recently been completed, and that it had been determined that a a basic rate of $20.00 for the current calendar year of 1967 would be required to pay present operational costs and to maintain the service of garbage collection and land fill disposal. In concurrence with the recommendation of the City Manager, it was moved by Commissioner Langohr, seconded by Commissioner Morrow, that the basic rate of $17.00 for garbage collection and disposal be increased to $20.00 for a four I room house and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner Morrow and Mayor Sedivy; those voting No, none. -- Memorial Day Parade - Tuesday, 30 May 1967: A request from Mr. M. L. Hamblin, Parade Chairman, Gallatin Post No. 14 of the American Legion, 27 for permission to conduct the 1967 Memorial Day Parade on Tuesday, 30 May 1967, at 9:30 o'clock t A.M. was presented. The parade wil1begin at South Third Avenue and West Main Street and proceed to the Cemetery. It was moved by Commissioner MorrQW, seconded by Commissioner Langohr, tha t the request be granted and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner Langohr and Mayor Sedivy; those voting No, none.
