The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall
Building, Wednesday, 26 April 1967, at l:OO o'clock p.m. Present were Mayor Sedivy, Commissioner
Morrow, Commissioner Langohr, City Manager Cutting, Assistant City Manager Fryslie, City Attorney
Berg and the Clerk. I
Mayor Sedivy opened the meeting with a prayer and the following proceedings were had:
Minutes of the regular meeting held, Wednesday, 19 April 1967, were read and it was moved by
Commissioner Langohr, seconded by Commissioner Morrow, that the minutes be approved as read and the
motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr,
Commissioner Morrow and Mayor Sedivy; those voting No, none.
Open Bids: Pickup Vehicle for Fire Department:
This was the time and place set for opening bids on a pickup vehicle for use by the Fire
Departmen t. The affidavit of publication of the "Call for Bids" was presented. I t was moved by
Commissioner Morrow, seconded by Commissioner Langohr, that the bids be opened and read and the
motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow,
Commissioner Langohr and Mayor Sedivy; those voting No, none.
The following bids were opened and read:
Bozeman Motors 1800 W. Main St. $1,916.15
Northern Automobile Company 202 W. Main St. 2,298.22
Upon request of the City Manager, the Commission directed that the bids be referred to the
Fire Chief for checking and tabulation and for recommendation to be made to the Commission.
Open Bids: Utility Truck for Water Departments: I
This was the time and place set for opening bids on a new Utility Body Pickup Truck for use
by the Water Department. The affidavit of publication of the "Call for Bids' was presented. It
was moved by Commissioner Langohr, seconded by Commissioner Morrow, that the bids be opened and
read and the motion was carried by the following Aye and No vote: those voting Aye being Commiss-
ioner Langohr, Commissioner MOrrow and Mayor Sedivy; those voting No, none.
The following bids were opened and read:

Upon request of the City Manager, the Commission directed that the bids be referred to the
Water Superintendent for checking and tabulation and for recommendation to be made to the Commiss-
ion.
Purchase of Series "B" Water Bonds:
A letter received from the E. H. Pringle & Company, Charleston, S. C., offering $5,000.00
City of Bozeman 3% Water System Revenue Bonds due July l, 1980, available at a price of 91.28 plus I
interest which would save $436.00 on the principal amount and a letter received from McLiney and
Company, Kansas City, Mo., offering $5,000.00 Water Revenue Bonds, 3.00% coupon, due July 1, 1980,
available at 9l.300 or $4,565.00, called for 1 July 1967 to the City of Bozeman was presented. It
was moved by Commissioner Morrow, seconded by Commissioner Langohr, that the Director of Finance
be authorized to purchase the two Water Revenue Bonds as offered and the motion was carried by the
following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner Langohr and
Mayor Sedivy; those voting No, none.

Long Construction Co., - Construction Schedule: SID No. 469:
The Contractor's proposed construction schedule for Special Improvement District No. 469 as
assigned to Long Construction Company by R. J. Studer & Sons, Billings, Montana, was presented.
The City Manager and the Engineers concurred in recommending approval of the schedule except for
I Item 3, perferring that manhole rings and covers be adjusted after the first lift of pavement is
placed; also contingent upon receipt of a letter from Long Construction Company they have accepted
assignment of the contract to them. It was moved by Commissioner Langohr, seconded by Commissioner
Morrow , that the proposed construction schedule be approved as recommended and the motion was
carried by the following Aye and No vote: Those voting Aye being Commissioner Langohr, Commissioner
Morrow and Mayor Sedivy; those voting No, none.
Westlake Plans & Specifications for Water and Sewer Mains: Area E. North 7th Ave. - north of Oak St.:
Mr. Myron Westlake appeared before the commission to present the plans and specifications for
Water & Sewer Mains to serve a tract of his land east of North Seventh Avenue and north of Oak
Street to Baxter Lane (extended to the east); the water and sewer lines to also be installed
to meet the City specifications. The State Board of Health had approved the plans and specifications
and the Commission was informed that Mr. Westlake was agreeable to the annexation of this Seventh
Avenue frontage to a depth of 137 feet in order to be permitted to connect to the City utilities.
The City Manager concurred with the City Engineer in recommending that the City Commission approve
the plans and specifications and permit connectionw the Cl~y Systems cantingent upon the annexation
of the area to be completed not later than 1 July 1967 and also enter into an agreement with the
I City to carry out such annexation if connections are sought at an earlier date. I t was moved by
Commissioner Morrow, seconded by Commissioner Langohr, that the plans and specifications for the
water and sewer lines be approved as presented and the City Attorney be instructed to draft the
proper Agreement as recommended and prepare the necessary resolution to initiate the annexation
requested and the motion was carried by the following Aye and No vote: those voting Aye being
Commissioner Langohr, Commissioner Morrow and Mayor Sedivy; those voting No, none.
Discuss "1" Block Paving: South 4th Ave. S of Garfield - W. Mendenhall & Lamme Streets between 10th
& 11 th :
Phoebe Reed and Hal MacWithey, representatives from the Bozeman Senior High School Senior
Senate appeared before the Commission to submit a request on behalf of the Student Body requesting
that paving or sidewalks be installed on Mendenhall and Lamme Streets between North Tenth and
Eleventh Avenues. Repeated requests from the Sigma Beta Chapter of Chi Omega, requesting paving
on the one block of South Fourth Avenue between Garfield and Arthur Street were also cited.
Following a discussion, it was moved by Commissioner Langohr, seconded by Commissioner Morrow, that
the above requests be acknowledged and taken under serious consideration in a continued effort to
improve the situation. The motion was carried by the following Aye and No vote: those voting Aye
being Commissioner Langohr, Commissioner Morrow and Mayor Sedivy; those voting No., none.
I Change Order No. 2 - SID No. 469, Utilities (Diteman):
,< The Change-Order on SID No. 469 prepared by Thomas, Dean & Hoskins, Inc., to become a part
of the original contract for construction of improvements in the project described was presented
as follows:
SID No. 469 m Grade and shape the ditch on the South side of Durston Road
between l5th and l6th avenues, in Special Improvement
District No. 469.

To provide drainage for the culvert on 16th Avenue due to deletion of

storm drain on Durston Road, as per Ch~ge-Order No.1.
Increase contract cost by $50.00.
The City Manager concurred with the Engineers and recommended the Change-Order be accepted
and approved as presented. It was moved by Commissioner Morrow, seconded by Commissioner Langoh;
that the Change-Order be approved and that the Mayor and the Clerk of the Commission be authorized I
to sign for the City and the motion was carried by the following Aye and No vote: those voting Aye
being Commissioner Morrow, Commissioner Langohr and Mayro Sedivy; those voting No, none.
Mayor's Proclamation: Arbor Day 28 April 1967: Toastmasters Week 30 April 1967:thru 6 May 1967:
National Radio Month - May:
Mayor Sedivy announced his proclamation of 28 April 1967, as "Arbor Day" in the City of Boze-
man and urged all of the citizens to encourage and take part in all efforts made in planting new
trees within the City and lend wholehearted support to landscape beautification on this occasion.
It was moved by Commissioner Langohr, seconded by Commissioner Morrow, that Mayor Sedivy be supported
in the proclamation of 28 April 1967 as Arbor Day in Bozeman and the motion was carried by the
following Aye and No vote: those voting Aye being Commissioner Langohr, Commissioner Morrow and
Mayor Sedivy; those voting No, none.
Mayor Sedivy announced his proclamation of April 30 through May 6, 1967, as Toastmasters week
in and for the City of Bozeman and called upon ail Citizens to recognize the good work being done
by Toastmasters in this City and throughout the world. It was moved by Commissioner Morrow,
seconded by Commissioner Langohr, that the Mayor's Proclamation be endorsed and the motion was
carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner I
Langohr and Mayor Sedivy; those voting No, none.
Mayor Sedivy announced his proclamation designating the month of Mayas "National Radio Month."
It was moved by Commissioner Langohr, seconded by Commissioner Morrow, that this proclamation of
the Mayor also be endorsed and the motion was carried by the following Aye and No vote; those
voting Aye being Commissioner Langohr, Commissioner Morrow and Mayor Sedivy; those voting No, none.
Appointment of Municipal Band Director - Mike Roberty:
A letter received from Ralph C. Challender, Secretary of the Bozeman Municipal Band reporting
that the City Municipal Band Board had elected Mike Roberty as Director of the Bozeman Municipal
Band for the 1967 season, the term covering a period of one year and ending in April 1968, was
presented. It was moved by Commissioner Morrow, seconded by Commissioner Langohr, that the Comm-
ission approve the election of Mike Roberty as Band Director and the motion was carried by the
following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner Langohr and
Mayor Sedivy: those voting No, none.
Parking - Chamber of Commerce:
A letter addressed to the City Commisssion from Guy Sperry, Manager of the Bozeman Chamber
of Commerce requesting the City to look into the possibility of starting a courtesy parking tie- I
ket program in Bozeman for out of State and possibly out of County visitors was presented. A del-
egation from the Board of the Bozeman Chamber of Commerce also attended the meeting to discuss the
matter further. It was moved by Commissioner Langohr, seconded by commissioner Morrow, that the
City Commission take the request under advisement and authorize the Ci ty Manager and the Chief of
Police to work out a recommendation to be presented to the City Commission on 3 May 1967 and the
motion was carried by the following Aye and No vote: those voting Aye being Commissioner Langohr,
Commissioner Morrow and Mayor Sedivy; those voting No, none.

Old Post Office Property - Chamber of Commerce:
A letter received from Guy Sperry, Manager of the Bozeman Chamber of Commerce, requesting
that the Board of Directors of the Chamber of Commerce meet with the City Commission for the pur-
pose of issuing a joint protest to the General Service Administration, Auburn, Washington, re-
I garding the Old Post Office being turned over to the Department of the Army and the manner in which
this action was taken. A large delegation of businessmen and members of the Chamber also appeared
before the Commission to inquire into this matter. Following a thorough discussion, the City
Manager was instructed to call Senator Mansfield in an effort to clarify and further confirm the
information wired to the Bozeman Daily Chronicle on l7 April 1967.

Meeting Reconvened 3:45 P.M:
The City Manager having reported that Senator Mansfield was not available due to the Senate
being in session, the Commission tabled the matter pending receipt of the further information in-
dicated above.
City Swimming Pool Facility - Chamber of Commerce:
A letter received from Guy Sperry, Manager of the Bozeman Chamber of Commerce, regarding a
Community Swimming Pool was presented. Several Officers and Committee members of the Chamber of
Commerce were also present for the meeting. Mr. Oswald Berg, Chamber Director -responsible for
recreation matters, attended the meeting and further explained the Swimming Pool Facility con-
templated to the Commission.
I Mrs. Eleanor Lamb of the League of Women Voters informed the Commission that their organiza-
tion would support such a project in any election held.
The City Manager reported that in accordance with the action of the Commission, 1 September
1966, that the estimated cost of the proposed project had been established but that the matter
of this site selection and operating arrangements had not been determined. The City Manager also
informed the Commission that in his opinion the City would be unable to operate a facility of the
proposed magnitude of $732,000.00 under the presently limited operational funds available for that
purpose. It was moved by Commissioner Langohr, seconded by Commissioner Morrow, that the measure
be taken under consideration pending the receipt of further information from School District No.7,
followinga meeting of its Board of Trustees, now scheduled for lO May 1967, at which time it was
understood that Board would further discuss the matter and the motion was carried by the following
Aye and No vote: those voting Aye being Commissioner Langohr, COmmissioner Morrow and Mayor Sedivy;
those voting No, none.
Examination of Depository Bonds:
In compliance with the provisions of Section 16-2618, R.C.M., 1947, the City Commission pro-
ceeded to examine the Receipts for Depository Bonds and Securities held by the Director of Finance
I as Security for City Funds deposited in Bozeman Banks. It was moved by Commissioner Morrow,
seconded by Commissioner Langohr, that the securities be approved and a list thereof be set forth
in full in the 'minutes of this meeting and the motion was carried by the following Aye and No
vo te : those voting Aye being Commissioner Morrow, Commissioner Langohr and Mayor Sedivy; those
voting No, none.

Request to hold Carnival in Bozeman 7-8-9 July 1967: Jaycees:
A letter received from Rodney B. &poor, Secretary of the Bozeman Junior Chamber of Commerce
requesting permission to sponsor a carnival in the City of Bozeman, 7-8-9-July 1967, was presented.
The City Manager recommended that the permission to sponsor the Carnival as requested be granted.
It was moved by Commissioner Langohr, seconded by Commissioner Morrow, that permission be authorized
and that in view of the fact that net proceeds of this carnival be used for charitable purposes,
the license fee be set at one.ha1f of the customary fee, and the motion was carried by the following
