HomeMy WebLinkAbout1973-08-22 4fJ9 Bozr>mall, Montana ?2 August I')73 The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal Building, 22 August 1973, at 1:15 o'clock p.m. Present were Mayor Grabow, Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer, Acting City Manager Keyes, City Attorney O'Connell and the Clerk. Commissioner Vandeventer opened the meeting with a prayer and the following proceedings were had: I Minutes of the regular meeting held 15 August 1973 were approved as read. C,msid",rat];lll of Ch'orine Rids Wat"'r Dept. & Waste Water Treatment PlAnt The City staff having checked the bids on the purchase of approximately 90,000# Liquid Chlorine for the Water Department and the Waste Water Treatment Plant recommended the bid of the following: Pennwalt Corp., Tacoma, Washington SEC Corp., Billings, Montana 35,000# in 150# Cylinders 0.152 55,000# in 1 Ton Cylinders $133.50 per ton Sur Charge 7.00 The City Commission concurred with the recommendation of the City Manager and it was moved by Commissioner Sedivy, seconded by Commissioner Lehrkind, that the above bids be accepted, they being the lowest and best bids submitted and meeting all specifications of the "eall for Bids." The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer, and Mayor Grabow; those voting No being none. This was the time and place set for hearing on levying assessment for the Street Lighting for the year 1973 in the amount of $16,966.12. Affidavit of Publication of notice was presented. No one appeared to protest and no written protests having been filed, Commission Resolution No. 1602 provisionally passed the recommendation of the City Manager it was moved by Commissioner Lehrkind, seconded by Commissioner I and adopted at the regular session held 15 August was presented for final passage. In concurrence with Vandeventer, that the resolution be finally passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy, and Mayor Grabow; those voting No being none. No one protested verbally and no written protest having been received, Resolution No. 1603 provisionally passed and adopted at the regular meeting held 15 August 1973 was presented for final passage. It was moved by Commissioner Vandeventer, seconded by Commissioner Vollmer, that the resolution be finally passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy, Commissioner Lehrkind, and Mayor Grabow; those voting No being none. No one appeared to protest and there being no protests on file, Commission Resolution No. 1604 provisionally passed and adopted on 15 August 1973 was presented for final passage. It was moved by Commissioner Vollmer, seconded by Commissioner Sedivy, that the resolution be finally passed and adopted and the motion was carried by the following Aye and No Vote: those voting Aye being Commissioner Vollmer, Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer, and Mayor Grabow; those voting No being None. Affidavit of publication of Notice was presented. No one appeared to protest verbally and there being no protest on file, it was moved by Commissioner Sedivy, seconded by Commissioner Lehrkind, that Commission Resolution No. 1605 provisionally passed and adopted on 15 August 1973 be finally passed. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer, and Mayor Grabow; those voting No being none. Hearing, Connnission Resolution No. 1606, Final Assessment SID No. 517, ($15,859.88) Lateral Sanitary Sew~ai Lane & Boylan Addition This was the time and place set for public hearing on levying final assessment for lateral Sanitary Sewer Tai Lane & Boylan Addition, SID No. 517 in the total amount of $15,859.88. Affidavit of publication of Notice was presented. No one appeared to protest verbally and there being no written protests on file, it was moved by Commissioner Lehrkind, seconded by Commissioner Vandeventer, that Commission Resolution No. 1606 provisionally passed and adopted on 15 August 1973 be finally passed. Ordinance No. 935, Bozeman ~rea 7.oning Code Ordinance No. 935 establishing Section 17.10 of the "Bozeman Area Zoning Ordinance" as prepared by the 480 City Attorney and the City-County Planning Dept. was presented, entitled: Ordinance No. 935 set forth in full: Ordinance No. 935 AN ORDINANCE OF THE CITY OF BOZEMAN, MONTANA, ESTABLISHING SECTION l7.l0 OF THE BOZEMAN MUNICIPAL CODE ENTITLED "BOZEMAN AREA ZONING ORDINANCE" Following a thorough discussion of the Ordinance it was moved by Commissioner Sedivy, seconded by Commiss Lehrkind that Ordinance No. 935 be passed and adopted in its entirety and the motion was carried by the Vandeventer, Commissioner Vollmer, and Mayor Grabow; those voting No being none. following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Lehrkind, Commissioner Request to Vacate Beall ~treet, Tenth to Eleventh Avenue; A letter received from several property owners on Beall Street requesting that the City vacate Beall Street between North Tenth and North Eleventh Avenue was presented. Following a thorough discussion and in response to the recommendation of the City Manager, it was moved by Commissioner Lehrkind, seconded by Commissioner Vandeventer, that this request be referred to the City-County Planning Board for their review and recommendation as to whether or not Beall Street be vacated. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy, and Mayor Grabow; those voting No being none. Interim Subdivis~on Regulations The Interim Subdivision Regulations for the purpose of promoting the public health, safety, and general welfare by regulating the subdivision of lands within the subdivision jurisdicition as prepared by the City- County Planning Staff to be adopted by the City Commission and the Gallatin County was presented. Following a thorough discussion and in concurrence with the recommendation of the City Manager, it was moved by Commissioner Sedivy, seconded by Commissioner Lehrkind, that they delay action on the proposed Interim Subdivision Regulations for a period of one week for further study and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer, and Mayor Grabow; those voting No being none. Con~ideration of Sale of Property - Lot 3 and NO.5 I Block B. Aldersons addition It was moved by Commissioner Lehrkind. seconded by Commissioner Vandeventer, that consideration of the sealed bid of Howard Nelson of Dokken Nelson Funeral Home in the amount of $7.500.00 and the oral bid in the amount of $9,000.00 for the sale of Lot 3 and the No. 5 feet of Lot 4, Block B. Aldersons Addition be tabled for another week and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy, and Mayor Grabow; those voting No being none.
