The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal Building, 29 August 1973, at 1:l5 o'clock p.m. Present were Mayor Grabow, Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer, City Manager Fryslie, Ass't. City Manager Keyes, City Attorney O'Connell and the Clerk. Commissioner Vollmer opened the meeting with a prayer and the following proceedings were had: Minutes of the regular meeting held 22 August 1973 were approved as read. nearing, Commission Resolution No. 1607, Assess SID No. 502, $354,533.17 - Final Passage This was the time and place set for public hearing on levying final assessment for the constru- ction and installation of the Westside Watermain, SID No. 502 in the amount of $354,533.11. Affidavit of publication of Notice was presented. No one appeared to protest verbally and there being no pro- tests on file, it was moved by Commissioner Sedivy, seconded by Commissioner Lehrkind, that Commission Resolution No. 1607 provisionally passed on 22 August 1973 be finally passed. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer, and Mayor Grabow; those voting No, none. Hearing, Commission Resolution No. 1608, Assess SID No. 523, $12.52L~.20 - Final Passage This was the time and place set for public hearing on levying final assessment for the construction of Water Main on North 19th Avenue between Beall Street and Durston Road, SID No. 523 in the total amount of $12,524.20. Affidavit of publication of Notice was presented. There were no written protests filed and no one appeared to protest verbally. It was moved by Commissioner Lehrkind, seconded by Commissioner Vandeventer, that Commission Resolution No. l608 provisionally passed and adopted on 22 Augus t 1973 be finally passed. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy and Mayor Grabow; those voting No, none. Sale of Property, Lot 3 and No.5' Lot 4, Block B, Alderson's Addn. - Howard Nelson Following a short discussion in regard to the sealed bid of Howard Nelson of Dokken, Nelson Funeral Home in the amount of $7,500.00 and the oral bid in the amount of $9,000.00 now revised upward to $10,500.00 by letter dated 23 August 1973, for the sale of Lot 3 and the North 5' of Lot 4, Block B, Alderson's Addition, it was moved by Commissioner Vandeventer, seconded by Commissioner Vollmer, that they concur in the recommendation of the City Manager and table the action on the sale of the lot indefinitely. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy, Commissioner Lehrkind, and Mayor Grabow; those voting No, none. Interim Subdivision Re~ulations The Interim Subdivision Regulations for the purpose of promoting the public health, safety and general welfare by regulating the subdivision of lands within the subdivision jurisdiction as prepared by the City-County Planning Staff to be adopted by the City Commission and the Gallatin County was again presented following a week of study. It was moved by Commissioner Vollmer, seconded by Commissioner Sedivy, that the action be delayed another week in view of the questions that have been asked and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer and Mayor Grabow; those voting No, none. Authority to Attend APWA Convention, Denver, 17-20 September - City Engineer Van't Hul The American Public Works Association Congress is scheduled to be held in Denver on 17-20 Sept- ember and the City Manager requested authority for the City Engineer to attend the Congress and, it being in the public interest his expenses be paid from the appropriate fund. It was moved by Commissioner Sedivy, seconded by Commissioaer Lehrkind, that the City Engineer be granted permission to attend the congress and the mbtion was carried by the following Aye and No vote: those voting Aye being Commiss- ioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer and Mayor Grabow; those voting No, none. License Bond - William A. Miller, Electrician - $5,000.00 In compliance with Chapter 15 of the Bozeman Municipal Code, the Electrician bond of William A. Miller was presented. The Building Inspector had recommended approval of the bond and the City Attorney approved the bond as to form. It was moved by Commissioner Lehrkind, seconded by Commissioner Vande- venter, that the Electricians bond in the amount of $5,000.00 be approved and the motion was carried by the Following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy and Mayor Grabow; those voting No, none. I I I I I I 483 Petition for Annexation - Ice Pond Road Area for Obtaining Sanitary Facilities A petition signed by property owners and interested taxpayers of property bordering and in the area of the Ice Pond Road requesting annexation to the City of Bozeman for the purpose of obtaining sanitary facilities was presented. Following a thorough discussion, the Commission concurred in the recommendation of the City Manager and it was moved by Commissioner Vandeventer, seconded by Commissioner Vollmer, tthat they acknowledge receipt of the petition and that upon receiving the property description from the City Engineer the City Attorney be instructed and directed to draw a resolution of intention to annex the area surrounding Ice Pond Road. The motion was carried by the following Aye and No vote: those voting Aye being Comm- issioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy, Commissioner Lehrkind and Mayor Grabow; those voting No, none. Circus License - Bozeman Firefighters Association, 30 May 1974 - "George Matthews Great London Circus" A letter received from Gordan Duntsch, Secretary~Treasurer of the Bozeman Firefighters Association requesting permission to obtain the proper license for "The George Matthews Great London Circus," to be presented in Bozeman at the Gallatin County Fair Ground 20 May 1074 was presented. Following a discussion, it was moved by Commissioner Vollmer, seconded by Commissioner Sedivy, that they concur in the City Managers recommendation to approve the request for the "George Matthews Great London Circus" with the instructions that this circus be fully licensed in the total amount of $120.00 in compliance with the provisions of Chapter 3.04.080 of the Bozeman Municipal Code and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer and Mayor Grabow; those voting No, none. Acceptance of Street Right-of-Way Deed, Steven D. & Cynthia J. Clark, So. Tracy Ave. For Street Purposes A warranty deed whereby Steven D. & Cynthia J. Clark granted unto the City of Bozeman a tract of land adjacent to South Tracy Avenue, a portion of Lot 2, Block 1, of 1962 Rearrangement of Block 2 of University Subdivision containing 2870.23 square feet to be deeded for street purposes was presented. Following a discussion, it was moved by Commissioner Sedivy, seconded by Commissioner Lehrkind, that the warranty deed for a portion of South Tracy Avenue be accepted by the City Of Bozeman and filed for record with the Gallatin County Clerk and Recorder and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vande- venter, Commissioner Vollmer and Mayor Grabow; those voting No, none. Commission Resolution No. 1609, Estimated Assessment SID No. 512, Paving University Subdv. & University #2 Commission Resolution No. 1609 levying the estimated assessment for the construction and install~ ation of paving University Subdivision & University No.2, SID No. 512 in the estimated amount of $688,000.00 was presented, entitled: COMMISSION RESOLUTION NO. 1609 A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA, LEVYING AND ASSESSING A SPECIAL ASSESSMENT OF TAXES UPON ALL THE PROPERTY IN SPECIAL IMPROVEMENT DISTRICT NO. 512 IN THE CITY OF BOZEMAN, COUNTY OF GALLATIN, STATE OF MONTANA, TO DEFRAY THE COST OF CONSTRUCTING AND MAKING THE IMPROVEMENTS WITHIN SAID SPECIAL IMPROVEMENT DISTRICT NO. Sl2. It was moved by Commissioner Lehrkind, seconded by Commissioner Vandeventer, that Commission Resolution No. 1609 levying and assessing SID No. 512 be provisionally passed and adopted and 5 Sept- ember 1973 be the date set for the public hearing and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy and Mayor Grabow; those voting No, none. Commission Resolution No. 1610 Final Assessment SID No. 518, Park Area Hyalite Subdivision Commission Resolution No. l610 levying the ~ assessment for the development and improve- ment of a park area in Hyalite View Subdivision, SID No. 518 in the estimated amount of $l6,000.00 was presented, entitled COMMISSION RESOLUTION NO. 1610 A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA, LEVYING AND ASSESSING A SPECIAL ASSESSMENT OF TAXES UPON ALL THE PROPERTY IN SPECIAL IMPROVEMENT DISTRICT NO. 518 IN THE CITY OF BOZEMAN, COUNTY OF GALLATIN, STATE OF MONTANA, TO DEFRAY THE COST OF CONSTRUCTING AND MAKING THE IMPROVEMENTS WITHIN SAID SPECIAL IMPROVEMENT DISTRICT NO. 518. It was moved by Commi.ssioner Vandeventer, seconded by Commissioner Vollmer, that Commission Final Resolution No. l6l0 levying and assessing the ~ amount in SID No. 518 be provisionally passed 484 and adopted and 5 September 1973 be set as the date for the public hearing and the motion was carried by the following Aye and No vote; those voting Aye being Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy, Commissioner Lehrkind and Mayor Grabow; those voting No, none. Canvass of Votes - Tabulation of Election Returns, Primary Municipal Election, Tuesday 28 August 1973 Under the provisions of Section 23-1801, R.C.M., 1947, and this being the first legal day after the Clerk of the Commission had received the returns of the Primary Election held Tuesday, 28 August 1973, the Clerk of the City Commission aided by the City Commission proceeded to canvass ~he said returns.
