The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal
Building, 12 September 1973, at 1:15 o'clock p.m. Present were Mayor Grabow, Commissioner Sedivy,
Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer, City Manager Fryslie, City
Attorney O'Connell and the Clerk.
Commissioner Lehrkind opened the meeting with a prayer and the following proceedings were had.
Minutes of the regular meeting held Wednesday, 5 September 1973 were approved as read.
Hearin~, Resolution No. 1601, Vacate Alley, Block 1, North Seventh Addition
Ordinance No. 936, Vacating Alley, Block 1, North Seventh Addition
This was the time and place set in Commission Resolution No. 1601 for hearing protests to vacat-
ing the North 120 feet of the Alley located in Block 1 of North Seventh Addition to the City of
Bozeman. Affidavit of publication of Notice was presented together with signed acknowledgement of
service of Notice from owners of all abutting and adjoining property. There being no one present
to protest and no protests having been filed, it was moved by Commissioner Sedivy, seconded by Com-
missioner Lehrkind, that they concur in the recommendation of the City Manager and instruct the City
Attorney to draw an Ordinance vacating the North 120 feet of the Alley located in Block 1 of North
Seventh Avenue Addition to the City of Bozeman. The motion was carried by the following Aye and
No vote: those voting Aye being Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer,
Commissioner Vollmer, and Mayor Grabow; those voting No, none.

An application received from Connie Smylie, 409 East Olive, requesting a kennel license in
accordance with Ordinance No. 857, Section 5.16.040 of the Bozeman Municipal Code, together with the
required fee was presented.
Following a discussion, the Commission concurred with the recommendation of the City Manager and
it was moved by Commissioner Lehrkind, seconded by Commissioner Vandeventer, that the request of
Connie Smylie, 409 East Olive be denied in view of the fact that the dogs are running at large, making
too much noise and there are no kennel arrangements on the property. The motion was carried by the
following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vandeventer,
Commissioner Sedivy, Commissioner Vollmer, and Mayor Grabow; those voting No, none.
An application received from Vicki Moffet, 414 North Plum, requesting a kennel license in accord-
ance with Ordinance No. 857, Section 516.040 of the Bozeman Municipal Code, together with the required
fee was presented.
Following a discussion and after reading the Dog Marshall's comments regarding the license applica-
tion, the City Manager recommended the request for the Kennel license be denied. It was moved by
Commissioner Vandeventer, seconded by Commissioner Vollmer, that the request be denied based upon the
dogs creating a nuisance and the motion was carried by the following Aye and No vote: those voting
Aye being Commissioner Vandeventer, Commissioner Vollmer, Commissioner Lehrkind, Commissioner Sedivy,
and Mayor Grabow; those voting No, none.
Ener~ Conservation, Chet Beldon - Montana Power Company
Chet Beldon of the Montana Power Company, Bozeman, appeared before the Commission to present an
Energy Conservation Program to urge all customers to conserve electricity now to help avert possible
electrical shortages in the coming months caused by critical water shortages in the Pacific Northwest

and Western Montana.
The Commission thanked Mr. Beldon for coming down to present the Energy Conservation Program
and stated they would do everything they could to comply with his request to avert the possible electri-
cal shortage.
Bozeman High School HomecominR Parade - 22 September 1973
A letter received from the Bozeman Senior High School for permission to conduct a Homecoming
Parade on Saturday, 22 September 1973, at 10:30 o'clock A.M. was presented. The parade will begin at
Lindley Park and proceed down Main Street to the Bozeman Senior High School where it will disband.
It was moved by Commissioner Vollmer, seconded by Commissioner Sedivy, that permission to con-
duct the Homecoming Parade on Saturday, 22 September 1973 be granted and the motion was carried by the
following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Sedivy, Com-
missioner Lehrkind, Commissioner Vandeventer, and Mayor Grabow; those voting No, none.
Acceptance and Final P~ent, SID No. 519. 520 and No. Wallace Avenue
The certificate of the engineer of Thomas, Dean & Hoskins, Inc., on Special Improvement Dis-
trict Nos. 519, 520 and North Wallace Avenue, stating the Construction has been completed in accordance
with the plans and specifications was presented. The City Manager concurred in the recommendation of
the Engineers and recommended that the project be accepted and approved by the City Commission and
final payment made. This final acceptance and payment does not relieve the contractors of the res-
ponsibility for negligence or faulty materials or workmanship within the extent and period provided
by law. The contractor has furnished a performance bond equal to the total contracts bid to guarantee
materials and workmanship for a period of one year commenc.ing upon final acceptance. It was moved
by Commissioner Sedivy, seconded by Commissioner Lehrkind, that as recommended the projects be accepted
as completed and the motion was carried by the following Aye and No vote: those voting Aye being
Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer, and
Mayor Grabow; those voting No, none.
Commission Resolution No. 1611, Levying the Solid Waste Collection & Disposal
$132,096.71
Commission Resolution No. 1611 levying the Solid Waste Collection and Disposal Assessment in
the amount of $132,096.71 was presented.

A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA LEVYING AND ASSESSING A
SPECIAL ASSESSMENT OF TAXES UPON ALL REAL PROPERTY IN THE CITY OF BOZEMAN, COUNTY OF
GALLATIN, STATE OF MONTANA, SERVICED AND FROM WHICH GARBAGE WAS COLLECTED AND REMOVED
DURING THE YEAR 1973, TO DEFRAY THE COST AND EXPENSE OF COLLECTING AND DISPOSING OF
GARBAGE UNDER THE PROVISIONS OF ORDINANCE NO. 696 OF THE CITY OF BOZEMAN MUNICIPAL CODE.
It was moved by Commissioner Lehrkind, seconded by Commissioner Vandeventer, that the resolution
be provisionally passed and adopted and Wednesday 19 September be set as the date for public hearing
and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner
Lehrkind, Commissioner Vandeventer, Commissioner Sedivy, Commissioner Vollmer, and Mayor Grabow; those
voting No, none.

Construction Bid OpeninR 10 October 1973
Plans and Specifications covering the proposed improvement in Special Improvement District No.
525 for the construction of a Sanitary Sewer Trunk Line, Figgins and Graf's Third Addition, Special
Improvement District No. 526 for the construction of a Trunk Water Main, Figgins and Graf's Third Addi-
tien, Special Improvement District No. 527 for the construction of Sanitary Sewer Laterals, Figgins and

Grafls Third Addition, Special Improvement District No. 528 for the construction of Lateral Watermains,
Figgins and Graf's Third Addition, Special Improvement District No. 529 for the construction of Water-
mains and Sanitary Sewer, North Twenty-First from Beall to Durston, Special Improvement District No.
530 for the construction of Paving North Twenty-first from Beall to Durston, Special Improvement Dis-

the consulting engineers, the City Manager recommended that the plans and specifications as presented
be approved and that a call for construction bids and sale of bonds for SID No. 525 in the maximum
amount of $61,000.00, SID No. 526 in the maximum amount of $95,000.00, SID No. 527 in the maximum
amount of $91,000.00, SID No. 528 in the maximum amount of $73,000.00, SID No. 529 in the maximum
amount of $69,000.00, SID No. 530 in the maximum amount of $109,000.00, SID No. 532 in the maximum
amount of $48,000.00 and SID No. 533 in the maximum amount of $21,500.00 be authorized. It was moved
by Commissioner Vandeventer, seconded by Commissioner Vollmer, that the plan and specifications be
approved and the Clerk of the Commission be authorized and directed to publish a "Call for Bids" for
the construction of Special Improvement Districts No. 525, 526, 527, 528, 529, 530, 532 and 533 with an
opening date of 10 October 1973 and to advertise for bids for the sale of the bonds in the approximate
amount of $61,000.00 for Special Improvement District No 525, $95,000.00 for SID No. 526, $91,000.00
for SID No. 527, $73,000.00 for SID No. 528, $69,000.00 for SID No. 529, $109,000.00 for SID No. 530,
$48,000.00 for SID No. 532 and $21,500.00 for SIn No. 533 to be received 17 October 1973. The motion
was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Com-
missioner Vollmer, Commissioner Lehrkind, Commissioner Sedivy, and Mayor Grabow; those voting No, none.

Proclamation - "Punt, Pass and Kick" Day, 29 September 1973
Mayor Grabow announced his proclamation of 29 September 1973 as "Punt, Pass and Kick" d8\Y' in
the City of Bozeman and called upon all citizens of Bozeman to observe the da.y with the traditional
American spirit of competition and good sportsmanship. It was moved by Commissioner Lehrkind, seconded
by Commissioner Vandeventer, that the proclamation as requested by KBMN and Bozeman Ford be endorsed
and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner
Lehrkind, Commissioner Vandeventer, Commissioner Sedivy, Commissioner Vollmer, and Mayor Grabow; those
voting No, none.
Authority to Purchase Two Butterfly Valves, Approximately $3,718.00 - Water Dept.
The Water Department has need for two Butterfly Valves in the approximate amount of $3,718.00
and the City Manager requested authority to purchase the valves. It was moved by Commissioner Vandeven-
ter, seconded by Commissioner Vollmer, that the request to purchase the Two Butterfly Valves for the
Water Department be approved and the motion was carried by the following Aye and No vote: those
