HomeMy WebLinkAbout1973-09-26 Bozeman, Montana 26 September 1973 I The Commission of the City of Bozeman met in regular session Wednesday, 26 September 1973, at 1:15 o'clock p.m. Present were Mayor Grabow, Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer, City Manager Fryslie, Ass't. City Manager Keyes, City Attorney O'connell and the Clerk. Commissioner Vollmer opened the meeting with a prayer and the following proceedings were had. Minutes of the regular meeting held 19 September were approved as read. HHearing, Final Adoetion R-:,s. No. l6"!1..z. Estimated Assessment SID 531 - Paving Circle Drive, $88,000. This was the time and place set for public hearing on levying assessment for the construction and installation of Paving Circle Drive in the estimated amount of $88,000.00. Affidavit of publication of Notice was presented. No one was present to protest verbally and there being no protests on file, it was moved by Commissioner Sedivy, seconded by Commissioner Lehrkind, that Commission Resolution No. 1612 provisionally passed and adopted on 19 September be finally passed. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer and Mayor Grabow; those voting No, none. Hearing, Final Adoption Res. No. 1613, Sidewalks and Curbs for 1973, $23,464.17. This was the time and place set for public hearing on levying final assessment for the construc- tion and replacement of sidewalks and curbs for theyear 1973 in the amount of $23,464.17. Affidavit of publication of Notice was presented. No one appeared to protest verbally and there being no pro- tests on file, it was moved by Commissioner Lehrkind, seconded by Commissioner Vandeventer, that Comm- ission Resolution No. 1613 provisionally passed and adopted on 19 September be finally passed. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy and Mayor Grabow; those voting No, none. Hearing, Final Adoption 1614., SID 519, Paving Lamme and Mendenhall, $21,194.74 This was the time and place set for public hearing on levying final assessment for the constru- ction and installation of paving Lamme and Mendenhall Streets from Tenth to Eleventh Avenue, SID No. 519 in the amount of $2l,l94.74. Affidavit of publication of Notice was presented. There being no one present to protest and no protests having been filed, it was moved by Commissioner Vandeventer, seconded by Commissioner Vollmer, that Commission Resolution No. l6l4 provisionally passed and adopted on 19 September be finally passed and the motion was carried by the following Ayeand No vote: those voting Aye being Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy, Commissioner Lehrkind and Mayor Grabow; those voting No, none. Hearing, Final Adoption 1615, SID 520, Paving North 20th from Main to Beall, $49,149.17 This was the time and place set for public hearing on levying final assessment for the constru- ction and installation of paving North Twentieth Avenue from Main Street to Beall, SID No. 520 in the amount of $49,149.17. Affidavit of publication of Notice was presented. There being no one present and no protests having been filed, it was moved by Commissioner Vollmer, seconded by Commissioner Sedivy, that Commission Resolution No. 1615 provisionally passed and adopted on 19 September be finally passed and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer and Mayor Grabow; those voting No, none. Open Bids - Purchase of four Police Vehicles: Police Department This was the time and place set for opening bids for the purchase of three sedans and one station wagon to be used by the Police Department. It was moved by Commissioner Sedivy, seconded by Commiss- ioner Lehrkind, that the bids be opened and read and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer and Mayor Grabow; those voting No, none. CommissioIl Res~,on No. 1616, Designa te Payment Agent, Sewer Revenue Bonds COMMISSION RESOLUTION NO. l6l6 RESOLUTION OF CITY OF BOZEMAN, MONTANA, DESIGNATING SECURITY BANK & TRUST COMPANY OF BOZEMAN, BOZEMAN, MONTANA, AS PAYMENT OFFICE as prepared by the City Attorney designating the Security Bank & Trust Company of Bozeman as the place for payment of said principal and interest of the Bozeman Sewerage System Refunding Revenue Bonds, issued in the amount of $l,325.00 and dated 23 May 1972 as required by the State Examiners was presen ted . The Commission concurred in the recommendation of the City Manager and it was moved by Commiss- ioner Vandeventer, seconded by Commissioner Vollmer, that Commission Resolution No. l6l6 be passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy, Commissioner Lehrkind and Mayor Grabow; those voting No, none. T.V. Inspection, Sanitary Sewer Lines: The City Manager requested authorization to contract with penetryn of Salt Lake City for a tele- vision inspection of approximately 13,000 feet of Sanitary Sewer Lines at an estimated cost of between nine and ten thousand dollars. Following a thorough discussion, it was moved by Commissioner Vollmer, seconded by Commissioner Sedivy, that they contract with penetryn of Salt Lake City for a television inspection as an item of the 1973~1974 budget and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer, and Mayor Grabow; those voting No, none. Author~~to pU~~1a~~_Air Compressor, Fire Department, $1,450.00 The fire department has need for an air compressor and the City Manager requested authority to purchase a Cyclone Compressor through Western Fire Equipment in the approximate amount of $l,450.00. The Commission concurred with the City Manager and it was moved by Commissioner Sedivy, seconded by Commissioner Lehrkind, that they purchase a Cyclone Air Compressor from Western Fire Equipment in the amount of $1,450.00 and the motion was carried by t~e following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer and Mayor Grabow; those voting No, none. V'lcating Beall Street;." between North Tenttl and North Eleventh.Avc::....t:I~ The Bozeman City-County Planning Board staff having reviewed the request of the property owners on Beall Street requested that the City Vacate Beall Street between North Tenth and North Eleventh Avenue, recommended that the portion of Beall Street between North Tenth and North Eleventh Avenue be vacated but the closing of the streets between North Seventh and North Tenth Avenue would take more of a review before making a recommendation. Following a discussion, it was moved by Commissioner Sedivy, seconded by Commissioner Lehrkind, that they delay action on the request to vacate Beall Street between North Tenth and North Eleventh Avenue for additional study and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, CommissionerLehrkind, Commissioner Vandeventer, Commissioner Vollmer, and Mayor Grabow; those voting No, none. License Bond: Mobile Home Doctors, Inc. - $5,000. Plumbing Heans Electric Co., - $5,000. Electri. In compliance with Chapter 15 of the Bozeman Municipal Code the Electrical Bond of Means Electric Company in the amount of $5,000.00 and in compliance with Chapter 16 of the Bozeman Municipal Code, the Plumbing Bond of Mobile Home Doctors, Inc., in the amount of $5,000.00 was presented. The City Manager stated the Building Inspector had recommended approval of the bonds and the City Attorney approved the bonds as to form. It was moved by Commissioner Lehrkind, seconded by Commissioner Van- deventer, that the above license bonds be approved and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy and Mayor Grabow; those voting No, none. Supervision Final plats: The final plat of the Sourdough Ridge No. II was presented along with the favorable recommendation of the City County Planning Board. I I I I I I Noting that the plat conformed generally with the master plat, the City Manager recommended that the plat be approved as presented. It was moved by Commissioner Vollmer, seconded by Commiss- ioner Sedivy, that the plats be approved as recommended and that the City Manager be authorized and directed to sign the plats as the Director of Public Service and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Sedivy, Comm- issioner Lehrkind, Commissioner Vandeventer and Mayor Grabow; those voting No, none. The final plat of Mae's Subdivision was presented along with the favorable recommendation of the City-County Planning Board. Following a discussion and noting that the plat conformed generally with the master plat of this area, the City Manager recommended that the plat be approved as presented. It was moved by Commissioner Sedivy, seconded by Commissioner Lehrkind, that the plat be approved as recommended and the City Manager be authorized and directed to sign the plat as Director of Public Service and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer and n ayor Grabow; those voting No, none. The final plat of RealIrangement of Subdivision No.8, "B" of Sourdough Creek properties was presented along with favorable recommendation of the City-County Planning Board. Following a tho- rough discussion and in concurrence with the recommendation of the City Manager it was moved by Comm- issioner Lehrkind, seconded by Commissioner Vandeventer, that they approve the plat as presented and direct the City Manager to sign the plat as Director of Public Service and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vande- venter, Commissioner Vollmer, Commissioner Sedivy and Mayor Grabow; those voting No, none. Proclamation - "Fire Prevention Week", 7-13 October 1973 "League of Women Voters h1eek" 25-30 S~ Mayor Grabow announced his proclamation designating the week of 7-13 October as "Fire Preven- tion Week" and called upon all departments and agencies of the City Government to participate actively in a campaigrt for improved fire safety. It was moved by Commissioner Vandeventer, seconded by Comm- issioner Vollmer, that they concur in Mayor Grabows proclamation and the motion was carried by the vol lowing Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy, Commissioner Lehrkind and Mayor Grabow; those voting No, none. In accordance with a request from the League of Women Voters, Mayor Grabow announced his pro- clamation of 25-29 September 1973 as '~eague of Women Voters Week: in the City of Bozeman and en- couraged all ci tizens of this community to recognize the League of Women Voters for its civic endea- vors and support the League durin?, their finance drive 5 October 1973. It tl7as moved by Commissioner Vollmer, seconded by Commissioner Sedivy, that they endorse the Mayors proclamation as requested by the League of Homen Voters and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer, and Mayor Grabow; those voting No, none. Ordinance No. 937, Amend Dog and Animal Control ORDINANCE NO. 937 AN ORDINANCE AMENDING TITLE 5, CHAPTER 5.16 OF TIlE BOZEMAN MUNICIPAL CODE TO REQUIRE THAT EACH OWNER, UPON REGISTRATION OF A DOG PURSUANT TO SECTION 5.16.020 , SHOW PROOF OF RABIES VACCINATION AND REPEALING ~LL ORDINANCE AND PARTS OF ORDINANCES IN CONFLICT THEREWITH. as prepared by the City Attorney to create Section 5.l6.020l of the Bozeman Municipal Code to show proof of rabies vaccination in the form of a certificate from a licensed veterinarian as directed by the City Commission was presented. It was moved by Commissioner Vollmer, seconded by Commissioner Sedivy, that Ordinance No. 937 be passed and adopted and the motion was carried by the following Aye and No vote: those voti.ng Aye being Commissioner Vollmer, Commissioner Sedivy, Commissioner Lehrkind Commissioner Vandeventer and Mayor Grabow; those voting No, none. Ordinance No.. 938, Amend Dog and Animal Control - Set ting forth new Proceedure for Impounded ~'\nimaL~ ORDINANCE NO. 938 AN ORDINANCE AMENDING TITLE 5, CHAPTER 5.16 OF TIlE BOZEMAN MUNICIPAL CODE ELIMINATING THE REQUIREMENT OF AN IMPOUNDING FEE AND SETTING FORTH NEW PROCEDURES FOR TIlE REDEMPTION OF IMPOUNDED ANIMALS AND REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT THEREWITH. as prepared by the City Attorney to amend Title 5, Chapter 5.l6 of the Bozeman Municipal Code as directed by the City Commission was presented. Comrni~:!:.on Resolution No. l6l~, Final Assessment SIn No. 52l" "WateJ; & Sewer - Circle Dr. $l.9,649.6l+) COMMISSION RESOLUTION NO. l6l7 A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA LEVYING AND ASSESSING A SPECIAL ASSESSMENT OF TAXES UPON ALL THE PROPERTY IN SPECIAL IMPROVEMENT DISTRICT NO. 524 IN THE CITY OF BOZEMAN, COUNTY OF GALLATIN, STATE OF MONTANA, TO DEFRAY THE COST OF CONSTRUCTING AND MAKING THE IMPROVEMENTS WITHIN SAID SPECIAL IMPROVEMENT DISTRICT NO. 524. Commission Resolution No. 1617 levying the final assessment for the water and sewer construction of Circle Drive, SID No. 524 in the amount of $49,649.64 was presented. It was moved by Commissioner Lehrkind, seconded by Commissioner Vandeventer, that Commission Resolution No. 1617 levying and assessing the final assessment in SID No. 524 be provisionally passed and adopted and 3 October 1973 be set as the date for public hearing and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner T"ehrkind, Commissioner Vandeventer, Con~issioner Vollmer, Commissioner Sedivy and Mayor Grabow; those voting No, none. Sale of Property - Lot 3 and North 5" of Lot 4, Block B, Aldersons Addition - Howard Nelson of DOkken Nelson Funeral Home Having received an oral bid in the amount of $12,500.00 for the sale of Lot 3 and the North 5' of Lot 4, Block B, Aldersons Addition from Howard Nelson of Dokken Nelson Funeral Home, the City Manager recommended that the City Commission Approve the sale of the lot at the above price. Following a thorough discussion, it was moved by Commissioner Vandeventer, seconded by Comm- issioner Vollmer, that they remove the action on the sale of the property from the table and accept the oral bid of Howard Nelson of Dokken, Nelson Funeral Home in the amount of $12,500.00 in concurr- ence with the recommendation of the City Manager, for the sale of Lot 3 and the North 5" of Lot 4, Block B, Aldersons Addition and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy, Commissioner Lehrkind, and Mayor Grabow; those voting No, none.
