The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal
Building, Wednesday, 3 October 1973, at 1:15 o'clock p.m. Present were ~myor Grabow, Commissioner
Sedivy, Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer, City Manager Fryslie,
Assistant City Manager Keyes, City Attorney O'Connell and the Clerk.
Commissioner Sedivy opened the meeting with a prayer and the following proceedings were had.
Minutes of the regular meeting held 26 September 1973 were approved as read.
Hearing, Resolution No. 1617, Final Adoption, AssessinR SID 524, $49,649.64, Water and Sewer - Circle
Drive
This was the time and place set for public hearing on levying final assessment for the water and
sewer construction of Circle Drive, SID No. 524 in the amount of $49,649.64. Affidavit of publication
of Notice was presented. No one was present to protest verbally and there being no protests on file,
it was moved by Commissioner Sedivy, seconded by Commissioner Lehrkind, that Commission Resolution
No. 1617 provisionally passed and adopted on 26 September be finally passed and the motion was carried
by the following Aye and No vote; those voting Aye being Commissioner Sedivy, Commissioner Lehrkind,
Commissioner Vandeventer, Commissioner Vollmer and Mayor Grabow; those voting No, none.
Request to Vacate Beall Street, Tenth to Eleventh Avenue
The letter received from property owners on Beall Street requesting that the City Vacate Beall
Street between North Tenth and North Eleventh Avenue having been reviewed for a week, was again pre-
sented with the City Manager's recommendation that they vacate a portion of Beall Street from Tenth to
Eleventh Avenue.
Following a discussion, it was moved by Commissioner Lehrkind, seconded by Commissioner Vandeventer,
that the City Attorney be instructed to draw up a resolution of intention to vacate a portion of Beall
Street between North Tenth and North Eleventh Avenue in concurrence with the City Manager's recommenda-
tion and that the property owners construct a culvert in the irrigation ditch on Beall Street between
North Tenth and North Eleventh Avenue to accommodate the intersecting alley right-of-way. The motion
was carried by the following Aye and No vote; those voting Aye being Commissioner Lehrkind, Commissioner
Vandeventer, Commissioner Sedivy, Commissioner Vollmer and Mayor Grabow; those voting No, none.
Authority to Purchase Water Meters and Sewer Rods:
The Bozeman Water Department has need for Water Meters in the approximate amount of $1,700.00 and
Sewer Rods in the approximate amount of $850.00 and the City r1anager requested authority to purchase
the water meters and sewer rods. The Commission concurred in the City Managerb recommendation and it
was moved by Commissioner Vandeventer, seconded by Commissioner Vollmer, that the request to purchase
the Water Meters and Sewer Rods be granted and the motion was carried by the following Aye and No vote;
those voting Aye being Commissioner Vandeventer, Commissioner Vollmer, Commissioner Lehrkind, Commis-
sioner Sedivy and Mayor Grabow; those voting No, none.
Authority to Conduct M.S.U. Homecoming Parade, 13 October 1973
A letter received from Dan L. Rieder, Assistant Secretary, Montana State University Alumni Ass6cia-
tion requesting permission to stage their annual Homecoming Parade on Saturdalf, 27 September 1973 at
10:00 a.m. from Buttreys Parking Lot on to West Main Street and proceed down Main Street to Rouse Avenue
where the parade will disband was presented. It was moved by Commissioner Vollmer, seconded by Commis-
sioner Sedivy, that permission to stage the parade be granted and the motion was carried by the follow-
ing Aye and No vote; those voting Aye being Commissioner Vollmer, Commissioner Sedivy, Commissioner
Lehrkind, Commissioner Vandeventer and Mayor Grabow; those voting No, none.

Resolution No. 1619 Callin Election for 6 November 1973 - Park Playgrounds, and Swimming Pool Bond

RESOLUTION PERMITTING THE CITY OF BOZEMAN TO ISSUE GENERAL OBLIGATION
BONDS, FIXING THE EXACT AMOUNT OF THE BONDS TO BE ISSUED, AND CALLING
AN ELECTION FOR THE ISSUANCE OF SUCH BONDS.

Following a thorough discussion, it was moved by Commissioner Sedivy, seconded by Commissioner
Lehrkind, that Commission Resolution No. 1619 calling an election to be held 6 November 1973 permit-
ting the City of Bozeman to issue General Obligation Bonds and the motion was carried by the follow-
ing Aye and No vote; those voting Aye being Commissioner Sedivy, Commissioner Lehrkind, Commissioner
Vandeventer, Commissioner Vollmer and Mayor Grabow; those voting No, none.
Proclamation - "Employ the Handicapped Week" 7-13 October 1973, MOILtana Employment
In accordance with the request from the Montana Employment Compensation Commission, Mayor Grabow
proclaimed the week of 7-13 October 1973 as "National Employ the Handicapped Week" in the City of
Bozeman and urged all public officials, leaders of business, industry, labor, etc., to consider the
handicapped for employment on the basis of their ability to perform a job in observance of this pro-
clamation. It was moved by Commissioner Lehrkind, seconded by Commissioner Vandeventer, that the
Mayor's proclamation be endorsed and the motion was carried by the following Aye and No vote; those
voting Aye being Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Sedivy, Commissioner
Vollmer and Mayor Grabow; those voting No, none.
Accept~ce and_Recommendation for P~ent - Seal Coat Improvement, HB254-SB362, Project 212(23)
The certificate of the engineer of Thomas, Dean & Hoskins, Inc., stating. the construction of
the Seal Coat Improvements by Bozeman Sand & Gravel, Inc., have been completed in accordance with
the terms and stipulations given in the plans and specifications for such work was presented. The
City Manager concurred in the recommendation of the consulting engineers and recommended approval
and final acceptance of the project with recommendation to the Montana State Highway Department,
that full and complete p~ent be made from HB-254-SB362 for Project 212(23).
The final acceptance does not relieve the contractor of responsibility for negligence in
faulty materials or workmanship to the extent or period provided by law. The contractor has furnished
a performance bond equal to the contract bid to guarantee materials and workmanship for a period of
one (1) year commencing upon final acceptance. It was moved by Commissioner Vandeventer, seconded
by Commissioner Vollmer, that the project be accepted as completed with a recommendation to the Montana
State Highway Department that the full and complete payments be made and the motion was carried by the
following Aye and No vote; those voting Aye being Commissioner Vandeventer, Commissioner Vollmer,
Commissioner Lehrkind, Commissioner Sedivy and Mayor Grabow; those voting No, none.
Consideration of Bids, Police Cars:
The Commission was referred to the opening of bids on 26 September for the purchase of three sedans
and one station wagon to be used by the Police Department. The bids having been tabulated and analyzed the
Chief of Police recommended to the City Manager that Bozeman Ford be awarded the bid for five sedans (two
with air and three without air) in place of three sedans and one station wagon on the basis of their bid
in the amount of $3,113.33 without air and $3,427.07 with air, it being the lowest bid and equaling or
exceeding the specifications as contained in the "Call for Bids." The City Manager having concurred in
the recommendation of the Chief of Police recommended that the purchase be authorized., It was moved by

Commissioner Vollmer, seconded by Commissioner Sedivy, that the purchase of five sedans (two with air
and three without air) be awarded to Bozeman Ford on the basis of their bid as stated above and the
motion was carried by the following Aye and No vote; those voting Aye being Commissioner Vollmer, Con-
missioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer and Mayor Grabow; those voting No,
none.
Request to Conduct UNICEF Drive - 30 October 1973, Church Women United
A letter received from Mrs. F. I. Sabo, President of Church Women United of Bozeman, requesting
authority to conduct a UNICEF drive to be held on Tuesday, 30 October 1973 was presented. It was moved
by Commissioner Sedivy, seconded by Commissioner Lehrkind, that permission to conduct the fund drive as
requested be granted and the motion was carried by the following Aye and No vote; those voting Aye being
Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer and Mayor
Grabow; those voting No, none.

Resolution No. 1618, Intent to Annex, Bozeman Creek Annex No.1, Hearing 31 October 1973
Commission Resolution No. 1618 declaring the City Commission's intention to annex an addition to be
known as Bozeman Creek Annex No.1, entitled:
