The COmmission of the City of Bozeman met in regular session in the COmmission Room, Municipal
Building. 8, August 1973. at 1:15 o'clock p.m. Present were Mayor Grabow. COmmissioner Sedivy, Commissioner
Lehrkind, COmmissioner Vandeventer, Commissioner Vollmer, City Manager Fryslie, Ass't City Manager Keyes,
Acting City Attorney Morgan and the Clerk.
Commissioner Sedivy opened the meeting with a prayer and the following proceedings were had:
Minutes of the regular meeting held 1 August 1973 were approved as read.
Sales of Property, Lot 3 and N. 5' Lot 4, Block B, Aldersons Addition
This was the time and place set for the opening for the sale of Lot 3 and the North 5' of Lot 4,
Block B. Aldersons Addition. Affidavit of publication of "Notice of Sale of Real Property" was presented.
It was moved by Commissioner Sedivy, seconded by Commissioner Lehrkind, that the bid of Howard Nelson of
the Dokken Nelson Funeral Service being the only bid submitted be opened and read.
Dokken Nelson Funeral Home - $7,500.00
The City Manager recommended that in the absence of any other sealed bids that if the Commission
felt the bid of Howard Nelson of Dokken Nelson Funeral Home was not sufficient he be given a chance to bid
orally.
Following a discussion, it was moved by Commissioner Sedivy. seconded by Commissioner Lehrkind that
the sealed bid of Howard Nelson of Dokken Nelson Funeral Home, it being the only bid submitted. and his
oral bid in the amount of $9,000.00 be tabled for a period of one week for further negotiation and study
and the motion was carried by the following Aye and No vote, those voting Aye being COmmissioner Sedivy,
Commissioner Lehrkind, Commissioner Vandeventer. Commissioner Vollmer, and Mayor Grabow; those voting No
none.
Hearing, Ordinance No. 934 - Appropriation Fiscal Year 1973-1974
This was the time and place set for public hearing on the appropriation ordinance No. 934 for the
fiscal year ending 30 June 1974. Affidavit of publication of Notice of hearing was presented. No one
appeared to verbally protest and the Clerk of the Commission stated no formal protests had been filed in
opposition to the adoption and passage of the proposed ordinance and accompanying annual appropriation
budget. In concurrence with the recommendation of the City Manager. it was moved by Commissioner Lehrkind,
seconded by Commissioner Vandeventer, that no protests having been received the Clerk of the Commission be
authorized and directed to publish the ordinance as required by law, Section 11-3319. R.C.M., 1947 and the
motion was carried by the following Aye and No vote. Those voting Aye being COmmissioner Lehrkind, Commissioner
Vandeventer, Commissioner Vollmer, Commissioner Sedivy, and the Mayor Grabow; those voting No being none.
Request to Vacate Portion of Alley - Block 1, North Seventh Addition
A letter received from American Inns requesting that the City Vacate a portion of the Alley between
Lot 25, Block 1. North Seventh Addition and Lots 1 & 2, Block 1, North Seventh Addition was presented.
Several interested persons were present in regard to the vacation of the above alley.
Following a thorough discussion and in response to the recommendation of the City Manager, it was
moved by Commissioner Vandeventer, seconded by Commissioner Vollmer, that the City Attorney be instructed to
draw a Resolution of Intention to vacate the above requested portion of the Alley and the motion was carried
by the following Aye and No vote. those voting Aye being Commissioner Vandeventer, Commissioner Vollmer,
COmmissioner Sedivy, COmmissioner Lehrkind, and Mayor Grabow; those voting No being none.
Release Lien, Park Requirements, Westlake Property
An Agreement made and entered into by and between Myron M. Westlake and Aura D. Westlake and the
City of Bozeman whereby the City of Bozema~ release all of the area contained in the plat of Westlake's Second,

Third and Fourth Subdivisions except a park area of 5.902 acres which is designated on said plat as
"Westlake Park" from the lien of said agreement dated 2l October 1964 and from any future park requirements
in connection therewith was presented.
Said dedication of said park complied with the terms of said Agreement dated 21 October 1964 and
the requirements therein as to dedication of park in connection with the platting of Westlake's Second, Third
and Fourth Subdivisions to the City of Bozeman. I
In connection with this Agreement, Lot 1 of Block 1 of the Plat of Westlake's Fourth Subdivisions
has designated thereon "Future park if required", to be used to satisfy Park requirements on land lying
North of West Oak Street if required when platted.
The Commission concurred in the recommendation of the City Manager and it was moved by Commissioner
Vollmer, seconded by Commissioner Sedivy, that the City enter into the Release of Lien for Park Purposes
Agreement and the Mayor and Clerk of the Commission be authorized and directed to sign the Agreement and
the motion was carried by the following Aye and No vote, those voting Aye being Commissioner Vollmer,
Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer. and Mayor Grabow; those voting No
being none.
License Bond - J. W. Tschache, Gas Fitter $5,000.00
In compliance with Chapter 15 of the Bozeman Municipal Code, the continuation of the Gas fitter
bond of J.W. Tschache in the amount of $5,000.00 was presented, and the Acting City Attorney had approved
the bond as to form. It was moved by Commissioner Sedivy, seconded by Commissioner Lehrkind, that the
aforementioned bond be approved and the motion was carried by the following Aye and No. vote, those voting
Aye being Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer, and
Mayor Grabow; those voting No being none.

The City Manager commented on the following reports and recommended approval thereof. It was
moved by CGmmissioner Lehrkind, seconded by Commissioner Vandeventer, that the reports be approved and
ordered filed and the motion was carried by the following Aye and No vote, those voting Aye being Commissioner
Lehrkind, Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy, and Mayor Grabow; those
voting No being none.
Claims for July
Clatm No's 4451 to 4625 and 15892 thru 16149 inclusive were presented. The City Manager checked
the claims and found them to he true and lawful claims agairist tihe ~t, of Bozeman and recommended they be
approved and the Director of Finance be directed to issue warrants in payment. It was moved by Commissioner
Lehrkind, seconded by Commissioner Vandeventer, that the claims be approved and the motion was carried by
the following Aye and No. vote, those voting Aye being Commissioner Lehrkind, Commissioner Vandeventer,
Commissioner Vollmer, Commissioner Sedivy, and Mayor Grabow; those voting No being none. *
Final Acceptance of Bozeman Sand & Gravel

The certificate of the engineer of Morrision-Mairels, Inc., on the Bozeman Recreation Complex
stating that the site grading for the Bozeman Recreation CompleX has been completed and final inspection
has been made was presented. The City Manager concurred in the recommendation of the engineers and recommended
that the project be accepted and approved by the City Commission and t'inal payment made. This final
acceptance and payment does not relieve the contractor of responsibility for negligence or faulty materials

or workmanship to the extent and period provided by law. It was moved by Commissioner Vandeventer,
seconded by Commissioner Vollmer, that as recommended the project be accepted as completed and the motion
was carried by the following Aye and No. vote, those voting Aye being Commissioner Vandeventer, Commissioner
Vollmer, Commissioner Sedivy, Commissioner Lehrkind, and Mayor Grabow; those voting No being none.
E~ecution of Contract Documents SIn No. 531 - Long Construction Company
The contract documents for the construction of paving and storm drainage, on Circle Drive and a
portion of Spring Creek Drive in Westridge Addition, SID No. 531 in the total amount of $46,522.50 was
presented. The City Manager recommended that the contract documents be approved and the Mayor and Clerk
of the Commission be authorized and directed to sign the contracts for the City of Bozeman and that Long
Construction Company be authorized to proceed with the construction and that the pledge for bid security
be returned to Long Construction Company, Billings and the motion was carried by the following Aye and No
vote, those voting Aye being Commissioner Vollmer, Commissioner Sedivy, Commissioner Lehrkind, Commissioner
Vandeventer, and Mayor Grabow; those voting No being none.
Adjournment
There being no further business to come before the Commission at this time, it was moved by
